RE: APPROVE VACATION OF USE BY SPECIAL REVIEW PERMIT #748 - DONNA
CHRISTIAN
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, by Resolution dated October 8, 1986, the Board approved Use by Special
Review Permit#748 for a Furniture Manufacturing Facility in the A (Agricultural) Zone District for
Billy and Donna Christian on the following described real estate, to-wit:
Lot 2, Ranch Eggs Subdivision; being located in the
N1/2 NE1/4 of Section 33, Township 1 North, Range
68 West of the 6th P.M., Weld County, Colorado
WHEREAS, the Board has received a request from Donna Christian, 873 County Road 7,
Erie, Colorado 80516, to vacate said Use by Special Review Permit#748, and
WHEREAS,the Board of County Commissioners heard all of the testimony and statements
of those present, studied the request of the applicant and the recommendations of the Department
of Planning Services staff and all of the exhibits and evidence presented in this matter and, having
been fully informed, deems it advisable to approve said vacation.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that Use by Special Review Permit#748 be, and hereby is, vacated.
The above and foregoing Resolution was, on motion duly made and seconded, adopted by
the following vote on the 26th day of November, A.D., 2007.

SUBJECT: Vacation of USR-748
The Department of Planning Services has received the attached email dated October 31, 2007
from Billy and Donna Christian. Mrs. Donna Christian is requesting that USR-748 for a furniture
manufacturing facility be vacated since the use is no longer being utilized on site.
Background information:
Legal Description: Lot 2 Ranch Eggs Subdivision Part of N2 NE4 of Section 33, Ti N, R68W
of the 6th P.M., Weld County, CO.
Location: West of and adjacent to County Road 7 and approximately IA mile north
of County Road 2.
USR-748: USR-748 was approved by the BOCC on October 6, 1986, for a furniture
manufacturing facility in the A (Agricultural) Zone District.

Just to clarify, it was my understanding that you mentioned your dad quit operating "Once a Tree Furniture" in
around 1990. Did I remember correctly?

I sent you an email quite some time ago stateing we were no tuseing the permit however I also stated
that we paid for it and did not know why we should give it up again to clarify we are not useing the
special use permit for Once a Tree Furniture manufacturer at this time

I sent an e-mail quite some time ago requesting clarification and I have not been able to find a response:
I just need to verify you acknowledge the business has not been conducted from the property for many years and
as a result, USR-748 can be vacated. By vacating this USR, it will not prohibit you from re-applying for another
similar use or completely different use in the future. However, if we do not receive a response by Friday the 19th
of October, we will need to proceed with a Probable Cause case to revoke USR-748. I believe this option (the
Probable Cause route) does limit how soon you could re-apply for a similar use on the property.
