RE: APPROVE QUIT CLAIM DEED AND AUTHORIZE CHAIR TO SIGN - TOWN OF EVANS
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board has been presented with a Quit Claim Deed from the County of
Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, on
behalf of the Department of Public Works, to the Town of Evans, commencing upon full execution,
with further terms and conditions being as stated in said Quit Claim Deed; said property being
described as the West 30.00 feet of the SW 1/4 of Section 21, and the East 30.00 feet of the
SE 1/4 of Section 20; all in Township 5 North, Range 65 West of the 6th P.M., Weld County,
Colorado, and
WHEREAS, after review, the Board deems it advisable to approve said Quit Claim Deed,
a copy of which is attached hereto and incorporated herein by reference.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the Quit Claim Deed between the County of Weld, State of Colorado, by
and through the Board of County Commissioners of Weld County, on behalf of the Department of
Public Works, to the Town of Evans be, and hereby is, approved.
BE IT FURTHER RESOLVED by the Board that the Chair be, and hereby is, authorized to
sign said Quit Claim Deed.
The above and foregoing Resolution was, on motion duly made and seconded, adopted by
the following vote on the 3rd day of December, A.D., 2007.

660 QUIT CLAIM DEED
THIS DEED is made this 3rd day of December, 2007 ,between Weld County,
Colorado, a body politic and corporate of the State of Colorado of the first part, and the City of
Evans, a municipal corporation, of the second part.
WITNESSETH, that the said party of the first part, for and in consideration of the sum
of Ten Dollars ($ 10.00), and other good and valuable consideration, to the said party of the first
part in hand paid by the said party of the second part, the receipt whereof is hereby confessed
and acknowledged, has remised, released, sold, conveyed and QUIT CLAIMED, and by these
presents does remise, release, sell, convey and QUIT CLAIM unto the said party of the second
part, its heirs, successors and assigns, forever, all the right, title, interest, claim and demand
which the said party of the first part has in and to the following described lots or parcels of land
situate, lying and being in the County of Weld and State of Colorado, to wit:
All of the real property described in the attached Exhibit "A."
TO HAVE AND TO HOLD the same, together with all and singular the appurtenances
and privileges thereunto belonging or in anywise thereunto appertaining, and all the estate, right,
title, interest and claim whatsoever, of the said party of the first part, either in law or equity, to
the only proper use, benefit and behoof of the said party of the second part, heirs and assigns
forever.
IN WITNESS WHEREOF, the said party of the first part has hereunto set its hand and
seal the day and year first above written.
IN WITNESS WHEREOF, I, William H. Jerke, Chair Pro-Tem of the Board of County
Commissioners of said County of Weld, State of Colorado, on behalf of said County and by
virtue of the Order contained in the Resolution made by said Board of County Commissioners on

The above legal description was prepared by Leon Sievers, Right-of-Way Agent, for and
on behalf of Weld County, Colorado and is based on road petition records found in Book
48 at Page 392, in the Clerk and Recorders office of Weld County, Colorado and the Plat

REVIEW/WORK SESSION REQUEST
RE: Conveyance of Road Right of Way
DEPARTMENT: PUBLIC WORKS DATE: September 26, 2007
PERSON REQUESTING: Leon Sievers, Right of Way Agent, Public Works
Brief description of the problem/issue:
In accordance with an Intergovernmental Agreement dated October 13, 2006 between Weld County and the
City of Evans, Weld County is responsible for conveying the right-of-way of 1st Avenue, between 31St Street
and 37th Street to the City of Evans. A map and a copy of this agreement are attached. Weld County has
completed all other requirements of this agreement except for this conveyance. The west half of this street is
presently within Evans city limits with the east half is in the County. The right-of-way will be conveyed to the
City of Evans by a Quit Claim Deed. The Board is being asked to authorize this conveyance, per the existing
agreement.
What options exist for the Board? (Include consequences, impacts, costs, etc. of options)
The Board may accept or reject this right-of-way conveyance. Authorization of this conveyance is in
accordance with the existing Intergovernmental Agreement with the City of Evans that was previously approved
by the Board. Denial of this conveyance is contrary to the terms of that agreement
Recommendation to the Board:
Public Works Department recommends that the Board authorize conveyance of this right-of-way.
