Town- ship 12 North, Range 67 West. This right-of-way included a portion of an old right-of-way-go-7-1023, Bk. 10, granted to the Highway Department along old U. S. Highway No. 87. The Highway Department has advised that those lands which they had in Right-of-Way No. 1023, Bk. 10 have been abandoned and that Weld County under a resolution dated April 29, 1964 accepted that portion of the highway which they abandoned for inclusion in the county road system. We are enclosing a copy of the plat which we have made in order that you may better identify the description in the rights-of-way we have indicated. The Colorado Interstate Gas Company has asked for a right-of-way along some of the same land included in the right-of-way abandoned by the Highway Department. Petitioner is the owner of the South Half (S 1/2) of the South Half (S 1/2) of Section Twenty (20) , Township Twelve (12) North, Range Sixty- seven (67) West of the 6th P.M. , Weld County, Colorado, lying South and East of the Colorado and Southern Railroad right of way and West of Interstate Highway No. 25, and is also the owner or lessee of lands lying to the South and West along old U. S. Highway No. 87. Petitioner respectfully directs the attention of the County Commissioners of Weld County, Colorado, to that portion of old U. S. Highway No. 87 (also referred to as Highway 185) , where said road crosses the county line on the East line of Section Eighteen (18) , Township Eleven (11) North, Range Sixty- seven (67) West of the 6th P.M. , running thence northerly to a point where the same crosses into the State of Wyoming near the Northeast corner of Section Twenty (20, Township Twelve (12) yt- a� North, Range Sixty-seven (67) West of the 6th P.M. , a distance of approximately five miles. This portion of the former state highway passed by resolution of the Colorado Department of Highways to Weld County when new Interstate Highway No. 25 was placed in oper- ation. On April 29, 1964, the County Commissioners, by reso- lution in its minutes, accepted said road as it pertains to Section Twenty (20) , Township Twelve (12) North, Range Sixty- seven (67) West of the 6th P.M. from the Colorado Department of Highways and designated the same as County Road No. 24. The maps in the office of the County Commissioners also indicate that a portion of said road in Section Twenty-nine (29) , Town- ship Twelve (12) North, Range Sixty-seven (67) West of the 6th ) P.M. was vacated on April 29, 1964, although there is no refer ence to it in the minutes of the proceedings of the County Com missioners on that date. Petitioner is successor in interest to the Warren Live Stock Company land lying West of Interstate Highway No. 25 and operates its lands as a common grazing pasture supervised by the Association. The existence of the old highway No. 87 as a public highway creates a problem to the Association in that it permits the public in such portions of the road as may be open for public travel to come into the grazing areas of the Association, there to do certain acts which are detrimental, such as the discharge of firearms, the disposal of rubbish and trash, the hunting of game, and on occasion there has been some loss of livestock thought to be the result of theft. Additionally, there are certain bridges and structures on the highway which, as the same deteriorate, would involve an expense to the county to repair and place the same in useable condition. The only parties who would have reason to be in the area other than S/1 34 • n - members of the Meadow Springs Grazing Association would be the operators of certain utilities, principally Colorado Interstate Gas Company, American Telephone and Telegraph Company, Mountain States Telephone and Telegraph Company, and certain power transmission companies. The Association has found that the proximity of this area to Cheyenne poses an especially difficult problem when it comes to involving law enforcement and it is the feeling of the Association and its Board of Directors that if the road were fenced off and closed to the public, there being no public need to go into the area, that the acts constituting violations of the law would be discouraged and would be less apt to occur. WHEREFORE, petitioner prays the Honorable Board of County .( Commissioners of Weld County to vacate that portion of old U.S. Highway No. 87 extending from the state line of Colorado-Wyoming near the Northeast corner of Section Twenty (20), Township Twelve (12) North, Range Sixty-seven (67) West of the 6th P.M. to the point on the county line on the West side of the North- west Quarter (NW 1/4) of Section Eighteen (18) , Township Eleven (11) North, Range Sixty—seven (67) West of the 6th P.M. , and that authority be given to the Meadow Springs Grazing Association to fence off portions of the roadway and to place barriers thereon so as to preclude the use of said roadway by the public, and further, that said action be spread-upon the minutes of the proceedings of the County Commissioners of Weld County, Colorado. Richardson County Attorney Gentlemen: Reference is made to your letter of July 1, 1965, relative to that portion of Highway NoL 8.5,between Wellington and the Colorado and Wyoming state line which has been abandoned as a part of the State Highway System because of the highway relocation. The above mentioned old road was abandoned by Resolution No. 11280, approved February 3, 1964, which became effective March 1, 1964. According to Department records, a copy of the resolution was forwarded to the Weld County Commissioners on February 21, 1964. The 1953 Colorado Statutes Annotated, Chapter 202, Section 6, states that the right-of-way of all abandoned portions of a State Highway shall revert to the adjacent property owners, unless the abandoned portions are necessary for use as a public highway. If it is desired by your Board that the abandoned portions should remain a public highway, your Board should submit within ninety days of abandonment, the necessary resolutions to add them to your County Road System. Dear Sir: The Board has taken up a consideration of the building of the Interstate road from towns in Northern Colo- rado to Cheyenne. It appears necessary that immediate permission be given for the construction of the road across certain state lands, by reason of the presence of the construction outfit in that vicinity and whose work is about completed. There- f 're, you are, hereby, authorized, through the road engineer and those in charge of the work, to lay out and construct a road near the south edge of the South2 of the Southwest 4 of Sec. 6, Twp. 11 N. R. 68 W. In laying out the road, the engineer will follow as close as practicable, the bounderies of the section but where it is necessary to depart from the bounderies, in order to obtain a good road, he is authorized to do so , the object being, first , to obtain a good road; and , Second, to damage the state land as little as practicable . After the road is located, kindly have the engineer furnish the Colorado State L' acid Board with the field notes covering the right of way and have the County Commissioners make application for the right of way.
