HomeMy WebLinkAbout20073078.tiff RESOLUTION RE: APPROVE PARTIAL CANCELLATION AND RELEASE OF COLLATERAL FOR SHILOH ESTATES, AMENDED PLANNED UNIT DEVELOPMENT FINAL PLAN, AMPF #354 - JAMES AND CHERI SCOTT WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, by Resolution dated May 10, 2006, the Board approved the application of James and Cheri Scott, 35236 Cornerstone Way, Windsor, Colorado 80550, to subdivide Lot 7, Shiloh Estates, into 4(four) lots, for a parcel of land located on the following described real estate, to wit: Part of Section 4, Township 6 North, Range 67 West of the 6th P.M., Weld County, Colorado, and WHEREAS, on November 6, 2006, the Board of County Commissioners of Weld County, Colorado, approved an Improvements Agreement According to Policy Regarding Collateral for Improvements (Private Road Maintenance), between the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, and James and Cheri Scott with terms and conditions being as stated in said agreement, and accepted check#1734, from Shiloh, Inc., in the amount of$119,629.00, and WHEREAS, the Board, through Resolution #2007-0734, dated March 21, 2007, released cash collateral, in the amount of$26,195.30, to the applicant as improvements were completed, retaining $93,433.70, and WHEREAS,the Board,through Resolution#2007-1482,dated May23,2007, released cash collateral, in the amount of$27,523.00,to the applicant as improvements were completed,retaining $65,910.70, and WHEREAS, staff from the Weld County Departments of Planning Services and Public Works have conducted a visual inspection and recommend partial release of said collateral, in the amount of$52,094.80, retaining $13,815.90. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that a portion of the collateral being held, in the amount of$52,094.80 be, and hereby is, canceled and released. This request is being made after completion of the requirements for road and drainage improvements. This request was originally made by the applicant in May, but the improvements did not pass Public Works inspections at the time. The applicant has subsequently fulfilled these to the satisfaction of Public Works. Planning Services and Public Works now support this partial release. A warrantee in the amount of 15% of the improvements($13,815.90)will continue to be held for one year after the installation of the improvements. The warrantee is based on the core improvements only, and not on utilities. (Please note an error in the applicants written request.
