RESOLUTION
RE: APPROVE PARTIAL VACATION OF USE BY SPECIAL REVIEW PERMIT #1376 -
JENNIFER BARGEN
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, by Resolution dated September 4, 2002, the Board did approve the request
of Jennifer Bargen and Bart Stoneback, 848 Weld County Road 17, Brighton, Colorado 80603, for
Use by Special Review Permit#1376, for a Business Permitted as a Use by Right or Accessory
Use in the Commercial Zone District (landscaping materials yard) in the A (Agricultural) Zone
District, on the following described real estate, to-wit:
N1/2 NW 1/4/4 of Section 33,Township 1 North, Range
67 West of the 6th P.M., Weld County, Colorado
WHEREAS, the Board has received a request from Jennifer Bargen to vacate a portion of
said Use by Special Review Permit#1376, and
WHEREAS,the Board of County Commissioners heard all of the testimony and statements
of those present, studied the request of the applicant and the recommendations of the Department
of Planning Services staff and all of the exhibits and evidence presented in this matter and, having
been fully informed, deems it advisable to approve said partial vacation, conditional upon the
following:
1. Pursuant to Section 23-2-200.G.5 of the Weld County Code, the applicant shall
submit a revised Partial Vacation Use by Special Review Plat, conforming to
Section 23-2-260.D of the Weld County Code.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that Use by Special Review Permit#1376 be, and hereby is, partially vacated,
with the abovementioned condition.

SUBJECT: Partial Vacation of USR-1376
The Department of Planning Services has received the attached letter dated August 16, 2007
from Jennifer Bargen. Ms. Bargen is requesting that USR-1376 for a landscaping materials
yard be partially vacated. The partial vacation is required as part of Recorded Exemption 4670.
Background information:
Legal Description: Lot B RE-3222 being part of N2 NW4 of Section 33, -11 N, R67W of the
6th P.M., Weld County, CO
Location: South of and adjacent to CR 4; and east of and adjacent to CR 17.
USR-1376: USR-1376 was approved by the BOCC on September 4, 2002, for a
landscaping materials yard in the A (Agricultural) Zone District.
Parcel number: 1469 33 200023
Should the Board of County Commission choose to approve the request for a partial vacation of
SUR-1376, Planning Staff recommends that a revised Partial Vacation USR plat of USR-1376
be submitted as required by Section 23-2-200.G.5.
