Environmental Health Services has reviewed this proposal for a church and fellowship
hall. We have no objections to the proposal, however, we do recommend that the
following conditions be part of any approval:

r-1.)) The applicant shall abandon the outhouse in accordance with Weld County Code
30-7-70. Written verification or physical evidence that the outhouse has been
properly abandoned shall be submitted to the Weld County Department of Public
Health and Environment.
2. The applicant shall submit evidence to the Department of Planning Services,
from the Colorado Division of Water Resources, demonstrating that the well is
appropriately permitted for the commercial use.
3. The water system shall comply with the Colorado Primary Drinking Water
Regulations (5 CCR 1003-1). Evidence shall be provided to the Weld County
Department of Public Health and Environment that the system complies with the
Regulations. Alternately, the applicant can provide evidence that they are not
subject to these requirements.
We recommend that the following requirements be incorporated into the permit as
conditions that must be met prior to the issuance of the Certificate of Occupancy:
1. An individual sewage disposal system is required for the proposed facility and
shall be installed according to the Weld County Individual Sewage Disposal
Regulations. Septic system permit # SP0500183 has been issued.

2. The septic system is required to be designed by a Colorado Registered
Professional Engineer according to the Weld County Individual Sewage Disposal
Regulations.
3. The septic system must meet all setbacks, including the 100-foot setback to any
well.
4. In the event the septic system requires a design capacity of over 2,000 gallons of
sewage per day the applicants shall provide evidence that all requirements of the
Water Quality Control Division (WQCD) of the Colorado Department of Public
Health and Environment (specifically Policies WQSA-6 and WQSA-8 ) have been
satisfied. Evidence of compliance shall be provided to the Weld County
Department of Public Health and Environment. Alternately, the applicant can
provide evidence from the WQCD that they are not subject to these requirements
4. The applicant shall submit evidence of an Underground Injection Control (UIC)
Class V Injection Well permit from the Environmental Protection Agency (EPA)
for any large-capacity septic system (a septic system with the capacity to serve
20 or more persons per day). Alternately, the applicant can provide evidence
from the EPA that they are not subject to the Class V requirements
We recommend that the following requirements be incorporated into the permit as
development standards:
1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and
Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for
final disposal in a manner that protects against surface and groundwater
contamination.
2. No permanent disposal of wastes shall be permitted at this site. This is not
meant to include those wastes specifically excluded from the definition of a solid
waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S.,
as amended.
3. Waste materials shall be handled, stored, and disposed in a manner that controls
fugitive dust, fugitive particulate emissions, blowing debris, and other potential
nuisance conditions.
4. Fugitive dust and fugitive particulate emissions shall be controlled on this site.
5. This facility shall adhere to the maximum permissible noise levels allowed in the
Residential Zone as delineated in 25-12-103 C.R.S., as amended. I

6. A permanent, adequate water supply shall be provided for drinking and sanitary
purposes. The water system shall comply with the Colorado Primary Drinking
Water Regulations (5 CCR 1003-1)
7. Adequate handwashing and toilet facilities shall be provided for employees and
patrons of the church. Y
8. Sewage disposal for the facility shall be by septic system. Any septic system
located on the property must comply with all provisions of the Weld County Code,
pertaining to Individual Sewage Disposal Systems. Septic system permit # SP-
0500183 has been issued.
9. The operation shall comply with all applicable rules and regulations of the State
and Federal agencies and the Weld County Code.

The Weld County Public Works Department has reviewed this proposal. Our comments
and requirements are as follows:
COMMENTS and REQUIREMENTS:
Weld County Public Works Department recommends approval of this application.
Weld County Road Classification Plan (FHU):
External Roads: Gray Street is a local gravel road and requires an 80-foot right-of-way
at full build out. There is presently an 80-foot right-of-way. This road is maintained by
Weld County. Pursuant to the definition of SETBACK in the Weld County Zoning
Ordinance (23-1-90), the required setback is measured from the future right-of-way line.
5th Street is a local gravel road and requires an 80-foot right-of-way at full build out.

The alleys to the north and east of the site presently show a 20-foot right-of-way.
The applicant shall verify the existing rights-of-way and the documents creating the
rights-of-way shall be noted on the plot plan map. Other utility easements must be
shown on the map. The proposed improvements should be located in a manner as to not
encroach or limit the use of these easements or rights-of-way.
Access: Gray Street is maintained by Weld County. The alley onto 5`h Street shall be
upgraded with 6 inches of class 6 aggregate base coarse for its 20 foot width. 5'h Street
should be upgraded to an all-weather surface between the alley and Gray Street.
The existing access point on Gray Street shall be abandoned and the two proposed
access points shall be utilized.
The right-of-way or easement shall be a graded and drained road to provide an all-
weather access.

A minimum radius of 20 feet is required for all access points to the public right-of-way
(section 23-2-240, part A, number 9, part f of the Weld County Code). The plans
currently show a 10 foot radius.
If a drainage culvert is required, a 15-inch corrugated metal pipe is the County's
minimum size requirement. If the applicant chooses to place a larger culvert, please
contact the Public Works Department to adequately size your culvert.
Off-street Parking: All parking for this site must be off street and internal. Each
parking space shall be equipped with wheel guards or curb blocks to prevent vehicles
from entering the retention pond or pedestrian areas or coming into contact with walls or
other structures.
Off-street parking spaces shall be surfaced with gravel, asphalt, concrete or the
equivalent and shall be graded to prevent drainage problems.
Parking lots shall conform to all standards of the American with Disabilities Act, including
the identification of the ADA space with appropriate symbols and signs.
Setback and Offsets: The proposed fellowship hall shall meet the requirements of
County Code section 23-3-50 for setbacks and offsets.
Storm Water Drainage: The bed of the proposed retention pond shall be checked
periodically and after each rainfall event. Any silt or sediment shall be removed from the
pond to keep the infiltration rate from decreasing.
In order to increase the capacity of the retention pond and thereby alleviate the need to
use the parking lot as freeboard to the pond, it is recommended that the section of earth
'between the ponds' be removed. The resulting pond shape would be an oval
approximately 24 feet wide and 130 feet long. This would also allow more infiltration
surface, reducing the pond's retention time.
General Requirements: Pursuant to Chapter 15, Articles I and II of the Weld County
Code, if noxious weeds exist on the property or become established as a result of the
proposed development, the applicant/landowner shall be responsible for controlling the
noxious weeds.

Site Specific Development Plan and Special Use Permit for a Public and Quasi Public Building including a Church in the
Agricultural Zone District.
1. A building permit shall be obtained prior to the construction of any new building.
2. A plan review is required for each building for which a building permit is required. Plans shall include a floor plan. Plans
shall bear the wet stamp of a Colorado registered architect or engineer. Two complete sets of plans are required when
applying for each permit. Include a Code Analysis Data sheet provided by the Weld County Building Department with each
Alilding permit application.
J. Buildings shall conform to the requirements of the various codes adopted at the time of permit application. Currently the
following has been adopted by Weld County: 2003 International Building Code; 2003 International Mechanical Code; 2003
International Plumbing Code; 2003 International Fuel Gas Code; and the 2005 National Electrical Code and Chapter 29 of
the Weld County Code.
4. The building will be classified as A-3 (Church) occupancy. Occupant load will be determined at the plan review. Occupant
loads of 300 or more require additional requirements of a manual fire alarm system and an automatic fire sprinkler system.
Contact the Nunn Fire Protection District for their requirements. Fire resistance of walls and openings, construction
requirements, maximum building height and allowable areas will be reviewed at the plan review. Setback and offset
distances shall be determined by the Zoning Ordinance.
5. Building height shall be measured in accordance with the 2003 International Building Code for the purpose of determining
the maximum building size and height for various uses and types of construction and to determine compliance with the Bulk
Requirements from Chapter 27 of the Weld County Code. Building height shall be measured in accordance with Chapter 23
of the Weld County Code in order to determine compliance with offset and setback requirements. Offset and setback
requirements are measured to the farthest projection from the building.
7. Provide letter of approval from Nunn Fire Protection District prior to new construction.
8. There is one historical building permit with final status and one pending building permit for the fellowship hall on record
for this parcel.

Landscape Referral
The Department of Planning Services reviewed the above referenced Use by Special Review
Landscape Plat and offers the following comments:
The applicant shall prepare a Use by Special Review Permit Plan Map per Section 23-2-260.D
of the Weld County Code. Alternative scales shall be approved by the Department of Planning
Services.
Section 23-3-50.B and Section 23-3-50.C of the Weld County Code addresses the required
setbacks and offset bulk requirements.
The applicant did not submit a Landscape Plan in the application materials, however the
application materials indicate that the existing landscape will be shrubs, trees and grasses of
unknown quantity, size and species The proposed seed mix for the retention pond is acceptable
to the Department of Planning Services.
Future landscaping shall be maintained at all times. Dead or diseased plant materials shall be
replaced with materials of similar quantity and quality at the earliest possible time.
The applicant shall demonstrate how the proposed plant material will be watered, thus ensuring
adequate growth and established of the feeder root system. Further, the applicant shall provide
evidence that a commercial well permit has been obtained prior to recording the Use by Special
Review Permit Plan Map.
The "Proposed Fellowship Hall" building delineated on the plan is approximately 1680 square
feet on size. Per Appendix 23-B of the Weld County Code, the number of off-street parking
spaces required is 1 space for every four seats of building rating. The applicant shall provide
this office with evidence that adequate parking for the proposed Fellowship Hall has been
accommodated on the property. Given the known information, Staff is unable to determine if
the intent of the Section 23-3-320.C.3 of the Weld County Code has been met.
The existing 1911 Church building is approximately 1160 square feet in size. The Department
of Planning Services will require the minimum number of parking spaces be installed and
accessible to the users of this facility at all times. There shall be no exception to this standard.
The Plan reviewed by this office delineates seventeen parking spaces, with one space identified
as non-ambulatory spaces in the main parking area. The applicant shall provide evidence that
the number of parking spaces delineated meets the intent and requirements of Appendix 23-B.
EXHIBIT
The applicant shall address and adhere to the American with Disabilities Act and ADA
standards for this facility at all times. Non-ambulatory/Ambulatory parking spaces shall be
identified and shown on the plat. This site will be required to meet all requirements of the
Americans with Disabilities Act. At least one space must be van accessible. A certain portion
of the structure will also be required to meet the accessibility requirements. The parking
spaces must be the closest possible to the entrance. Signing will be required. Curb cuts,
ramps and other methods of providing accessibility shall be required to reasonably attempt to
meet the requirements of this Act.
The applicant shall delineate curb stops for the parking spaces to be delineated on the Use by
Special Review Permit Plan Map. One curbs stop for each space is the standard, however, staf
will accept one curb stop for every two parking spaces if curb stop is equally spaced on parking
stripe between every two stalls.
The applicant shall demonstrate a safe and approved access. The proposed access into the
facility appears to be adequate. Points of ingress and egress to this parcel shall be clearly
identified. Appropriate language shall be included on the drawing delineating the access to this
parcel. The Department of Public Works shall be contacted in an effort to address points of
ingress and egress, as applicable. Should the .Department of Public Works not maintain this
section of County Road 1, the appropriate government entity shall review, comment and provide
written evidence of an approved access permit for this facility.
The trash collection area was not identified on the drawing. Areas used for storage or trash
collection shall be screened from adjacent public rights-of-way and adjacent properties. These
areas shall be designed and used in a manner that will prevent wind or animal scattered trash.
The applicant shall address the issue of on-site lighting, including security lighting if applicable.
Any lighting ... shall be designed, located and operated in such a manner as to meet the
following standards: sources of light shall be shielded so that beams or rays of light will not
shine directly onto adjacent properties.
The applicant has delineated any on-site sign. The property identification sign shall adhere to
Section 23-4-90.A and Section 23-4-90.B of the Weld County Code. One identification sign per
principal use shall be allowed, provided that the sign does not exceed sixteen (16) square feet
in area per face. Further, the location of the sign, shall be delineated on the Use by Special
Review Permit Plan Map. All structures, including signs, on site must obtain the appropriate
building permits and meet the appropriate zone district setbacks.
The application materials stated that there is an on-site well located on premises. There was
no evidence of water, specific to a commercial water tap in the referral request. The applicant
shall provide evidence that the water may be utilized for exterior yard and garden watering.
Further, the applicant shall provide evidence of adequacy of water prior to scheduling the PC
Hearing.
The applicant shall provide written evidence from the Fire Protection District of record
stipulating that the approved point of ingress and egress, emergency access and circulation
pattern meet the requirements of the District.
The applicant shall enter into an Improvements Agreement according to policy regarding
collateral for improvements and post adequate collateral for all transportation (access drive,
parking areas, etcetera) and non-transportation (plant materials, fencing, screening, etcetera)
or complete the on-site improvements prior to recording the palt. The agreement and form of
collateral shall be reviewed by County Staff and accepted by the Board of County
Commissioners prior to recording the USR plat.

Dear Mr. Caruso:
We have reviewed the above referenced proposal to construct a new fellowship facility
for the Carr Community Church. Since the submitted material does not appear to qualify as a
"subdivision" as defined in §30-28-101(10)(a), C.R.S., pursuant to the State Engineer's March 4,
2005 memorandum to county planning directors, this office will only perform a cursory review of
the referral information and provide comments. 1 he comments will not address the adequacy of
the water supply plan for this development or the ability of the water supply plan to satisfy any
County regulations or requirements.
From the submittal materials, the water supply for the church and this proposed
improvement will be from an existing well, permit no. 258795. This permit was issued on
August 20, 2004 to construct a well to be used for drinking and sanitary facilities for a
commercial business. Water from the well shall not be used for lawn or landscape irrigation or
for any other purpose outside the business building structure(s). The annual amount of ground
water diverted by this well shall not exceed 1/3 of an acre-foot or 108,600 gallons and the return
flow from the use of this well must be through an individual waste water disposal system of the
non-evaporative type where the water is returned to the same stream system in which the well
is located. The well shall also be the only well on a one acre tract described as lots 13, 14, and
15, block 11, Town of Carr, Weld County. The well was constructed on March 8, 2005 to a
depth of 250 feet and the production rate after a two hour test, was reported as 70 gpm.
According to the Pump Installation and Test Report submitted on March 28, 2005, the design
GPM of the pump installed in this well is 10 gpm, which within the permitted maximum pumping
rate of 15 gpm.
No information was provided on the specific amount of water that will be required to
serve the new fellowship facility. However, as long as the use of this well is in compliance with
the conditions of approval on the well permit, this office does not have an objection to the use of
the well to serve the in-building drinking and sanitary requirements of the proposed new

fellowship facility. Use of this well for lawn or landscaping irrigation or any other outside use is
not allowed.
