Environmental Health Services has reviewed this proposal for onion storage and
processing facility, lawn mover warehouse, fencing manufacturing facility, offices,
warehousing and transfer facilities. We have no objections to the proposal, however,
we do recommend that the following conditions be part of any approval:
We recommend that the following requirements be met prior to allowing the plat to be
recorded:
1. The applicant shall provide written evidence to the Weld County Department of
Public Health and Environment regarding property tenants that may produce
air emissions. The applicant/tenant shall contact the Air Pollution Control
Division (APCD), at the Colorado Department of Public Health and Environment
(CDPH&E). This contact shall determine if an Air Pollution Emissions Notice
(A.P.E.N.) and Emissions Permit application is required for each individual
business being leased by the applicant. Written evidence of contact shall
contain the name and phone number of the APCD representative contacted.
Alternately, the applicant/tenant can provide evidence that they are not subject to
these requirements.
2. The applicant shall provide current evidence that the facility has an adequate
water supply (i.e., well or community water system).
3. In the event, the applicant or tenants intend to wash vehicles or equipment on
site the following shall apply:
The applicant and/or tenant shall provide evidence that the washing area will
be designed and constructed to capture all effluent and prevent any
discharges from the washing of vehicles or equipment in accordance with the
Rules and Regulations of the Water Quality Control Commission and the
Environmental Protection Agency.

4. The applicant shall ensure that all property tenants submit a waste handling
plan, for approval, to the Environmental Health Services Division of the Weld
County Department of Public Health & Environment. The plan shall include at a
minimum, the following:
1) A list of wastes which are expected to be generated on site (this should
include expected volumes and types of waste generated).
2) A list of the type and volume of chemicals expected to be stored on site.
3) The waste handler and facility where the waste will be disposed (including
the facility name, address, and phone number).
We recommend that the following requirements be incorporated into the permit as
development standards:
1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and
Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for
final disposal in a manner that protects against surface and groundwater
contamination.
2. No permanent disposal of wastes shall be permitted at this site. This is not
meant to include those wastes specifically excluded from the definition of a solid
waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S.,
as amended.
3. Waste materials shall be handled, stored, and disposed in a manner that controls
fugitive dust, fugitive particulate emissions, blowing debris, and other potential
nuisance conditions.
4. The applicant and tenants shall operate in accordance with the approved "waste
handling plan".
5. No on-site disposal of produce of any type shall be permitted at anytime.
Produce shall be handled and stored at the facility in such a manner so that no
nuisance is created by odor, blowing of debris, fugitive dust, or spoiled produce
on or around the facility.
6. Any vehicle washing area(s) shall capture all effluent and prevent discharges
from drum washing and the washing of vehicles in accordance with the Rules
and Regulations of the Water Quality Control Commission, and the
Environmental Protection Agency.

7. Fugitive dust and fugitive particulate emissions shall be controlled on this site.
8. This facility shall adhere to the maximum permissible noise levels allowed in the
Industrial Zone as delineated in 25-12-103 C.R.S., as amended.
9. Adequate handwashing and toilet facilities shall be provided for employees and
patrons of the facility.
10.Sewage disposal for the facility shall be by septic system. Any septic system
located on the property must comply with all provisions of the Weld County Code,
pertaining to Individual Sewage Disposal Systems.
11.A permanent, adequate water supply shall be provided for drinking and sanitary
purposes.
12.AII potentially hazardous chemicals must be stored and handled in a safe manner
in accordance with product labeling and in a manner that minimizes the release
of hazardous air pollutants (HAP's) and volatile organic compounds (VOC's).
13.The operation shall comply with all applicable rules and regulations of the State
and Federal agencies and the Weld County Code.

The Weld County Public Works Department has reviewed this proposal. This project falls primarily under the
purview of the Use by Special Review Standards, Weld County Code, Chapter 23, Article II, Division 4, Section
23. Our comments and requirements are as follows:
COMMENTS:
Weld County Road Classification Plan (FHU): (June 2002)
WCR 44 is a collector road and requires an 80-foot right-of-way at full build out. There is presently a 60-foot
right-of-way. This road is maintained by Weld County. Pursuant to the definition of SETBACK in the Weld
County Zoning Ordinance (23-1-90), the required setback is measured from the future right-of-way line.
WCR 35 is a local paved road and requires a 60-foot right-of-way at full build out. There is presently a 60-foot
—;fight-of-way. This road is maintained by Weld County. Pursuant to the definition of SETBACK in the Weld
ounty Zoning Ordinance (23-1-90), the required setback is measured from the future right-of-way line.
Our most recent ADT count taken 6/2/2006 reflects 1,185 vehicles taken in a 72-hour period. Other counts in
the same area reflect between 900 and 1000 vehicles taken in 2002 and 2003.
REQUIREMENTS:
Access: There is an existing access to both structures. Utilize these access points from WCR 44 and WCR
35 with no additional accesses granted.
Off-Street Parking and Circulation: Utilize the designated areas for your gravel parking at both locations.
Additional signs for each parking place shall be equipped with wheel guards or curb stops where needed to
prevent vehicles from extending beyond boundaries of spaces and from coming into contact with other
vehicles, walls, fences, or plantings.
Circulation: There is adequate circulation throughout the existing facility.
Storm Water Drainage: I have referred the storm water drainage section to Dave Bauer in our Drainage
Division for comments or any additional requirements that may be necessary for the proposed use of the USR
site.
For additional requirements, the Weld County Public Works Department will forward those conditions to
,. Landmark Engineering for follow-up.

COLORADO USR drainage report
Applicant proposes re-development of the Ralph Nix Produce site to a power mower sales and repair shop on
a 7.8 acre wedge-shaped lot located in the SE quarter of Section 14, T4N, R66W. The site is bound on the
west by the Western Mutual irrigation ditch, south by WCR 44 (paved) and East by WCR 35 (paved). No
drainage facilities are currently on the site which currently is paved with gravel and has 2 existing large steel
commercial buildings (11,000 sq. ft. and 46,500 sq. ft.) previously used for warehousing and onion sorting.
COMMENTS:
No drainage report was submitted. A drainage "memorandum" signed but not stamped by Jeff Olhausen, P.E.
(#37659) was submitted by Landmark Engineering. The memorandum describes the site conditions only; no
calculations of site runoff or flows to the site from offsite areas were provided. Apparently portions of the site
drain to the north corner to an informal (i. e. not designed) retention area. No stormwater detention is provided
^n the site and none is proposed by the drainage memorandum. The existing retention area will overflow onto
J WCR 35 during larger storms.
REQUIREMENTS:
Weld County Code specifies detention of the stormwater runoff from the fully developed site from the 100-year
event and release of the detained water at a rate not to exceed the runoff rate of the 5-year event falling on the
undeveloped site. The drainage design should include offsite contributing offsite areas. All drainage facilities
must be shown in dedicated drainage easements on the final plat.
RECOMMENDATION:
The applicant is proposing changing ownership and changing site use from agricultural (onion warehousing) to
lawn mower sales and service. As the site is severely constrained by county roads, irrigation facilities, and
was initially approved by the County for the onion warehousing use without address to drainage, applicant is
requested to enlarge and deepen the retention pond area by 10,000 cubic feet and place the improved
retention area in a recorded drainage easement with the stipulation that no buildings or equipment are to be
stored or parked in the retention area.

1. A building permit shall be obtained prior any change of use of the building or when any portion of the buildings is leased.
A plot plan is required showing all existing structures,the square footage of each existing structure,the distance between
structures and the distance to all property lines.
2. A plan review is required for each change of use and when portions of the buildings are leased.Plans shall bear the wet
stamp of a Colorado registered architect or engineer. Two complete sets of plans are required when applying for each
permit. Plans shall show the entire floor plan and the use of each space in that particular building. Include stamped
mechanical, and plumbing drawings if heating and plumbing are changed or added. Provide size of electrical service to
each separate building or tenant.Occupancy type may require that the entire buildings be equipped with an automatic fire
sprinkler system. This will be determined at plan review.
3. Buildings shall conform to the requirements of the various codes adopted at the time of permit application. Currently the
following has been adopted by Weld County:2003 International Building Code;2003 International Mechanical Code;2003
International Plumbing Code;2005 National Electrical Code;2003 International Fuel Gas Code and Chapter 29 of the Weld
County Code.
6. Building wall and opening protection in accordance with the Building Code. Setback and offset distances shall be
determined by the Zoning Ordinance.
7. Building height shall be measured in accordance with the Building Code for the purpose of determining the maximum
building size and height for various uses and types of construction and to determine compliance with the Bulk
Requirements from Chapter 27 of the Weld County Code. Building height shall be measured in accordance with Chapter
23 of the Weld County Code in order to determine compliance with offset and setback requirements. Offset and setback
requirements are measured to the farthest projection from the building.
8. Provide letter of approval from LaSalle Fire Protection District prior to any change of use or before leasing any part of the
buildings.
8.There are 9 historical permits on record with final status.There is one historical permit with expired status.

In consultation with the Natural Resources Conservation Service(NRCS), we have reviewed the above
referenced case and have the following comments:
SOILS/LIIVIITATIONS: The proposed use by special review for commercial/industrial uses in a
agricultural zone district is located on Julesburg sandy loam(29,30) and Vona loamy sand (72) soils. For
commercial building foundations. Julesburg soil has moderate limitations due to its low strength.
PRIME FARMLANDS: When irrigated, the Julesburg soil is considered `prime farmland'.
SOIL EROSION POTENTIAL:These soils have a moderate to high potential for wind erosion and
should be protected. Appropriate measures should be taken to minimize wind and water soil erosion
during any future construction activities, such as avoiding disturbances to large areas and preventing soils
from moving offsite. At the conclusion of construction activities, disturbed areas and operation areas
should be stabilized with perennial vegetation, gravel or asphalt to minimize erosion and control dust.
Consideration should be given to increasing the capacity of the storm runoff retention pond in order to
contain runoff from a major storm event(s). The application does not address re-vegetation of the storm
water runoff detention pond. Our recommendation for re-vegetation seeding of the runoff detention pond
is based on soil erosion, both from a wind and water standpoint, as well as from a weed standpoint.
Weeds are very invasive and move into disturbed areas quickly. Some of these can be noxious weeds and
would require control based on the state noxious weed list. By seeding the runoff detention pond the
chances for weed invasion will be lessened, as will the potential for erosion.

CONSERVATION-DEVELOPMENT-SELF-GOVERNMENT
Our normal recommended seeding dates are December P through April 15th. All seeding should take
place on unfrozen soils. A good quality seed drill with an agitator and press wheels is recommended. If
seed is broadcast,the above recommended rates would be doubled.
We recommend mulching with clean weed free straw or native hay. Mulch should be applied at a rate of
4,000 pounds per acre. After the mulch is applied,it should be `crimped' into the soil to help anchor it.
Crimping should be cross slope or on the contour, if at all possible. The State of Colorado has a list of
certified weed-free straw available on the internet or through the local county Extension Service office.
It is suggested that the storm water runoff detention pond have side slopes of 4:1;this moderate slope will
allow the planting, establishment and maintenance of cover vegetation.
OTHER: When native vegetation is disturbed, weed infestation can become a problem. Should this
occur,the applicant can contact Tina Booten, Vegetation Weed Management Specialist with the Weld
County Public Works Department at(970)304-6496X3772 for assistance in developing a weed
management plan.
The District welcomes the opportunity to review and comment on this project. Conservation and wise use
of our natural resources are foremost in our goals and objectives. If you or the applicant should have
