RE: ACTION OF THE BOARD CONCERNING SITE SPECIFIC DEVELOPMENT PLAN AND
USE BY SPECIAL REVIEW PERMIT #1565 FOR AN OIL AND GAS PRODUCTION
FACILITY (THREE (3) OIL AND GAS WELLS) IN THE R-1 (LOW DENSITY
RESIDENTIAL)ZONE DISTRICT -TARH E AND P HOLDINGS, L.P.
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS,the Board of County Commissioners held a public hearing on the 8th day of
November,2006,at the hour of 10:00 a.m.in the Chambers of the Board for the purpose of hearing
the application of C. B. Keimes Land Company, LLC,c/o TARH E and P Holdings, L.P.,410 17th
Street, Suite 1610, Denver, Colorado 80202, for a Site Specific Development Plan and Use by
Special Review Permit#1565 for an Oil and Gas Production Facility(three(3)oil and gas wells)in
the R-1 (Low Density Residential)Zone District on the following described real estate, being more
particularly described as follows:
Parts of Lots C and D of Recorded Exemption#3868;
encompassing the entire W1/2 SE1/4 of Section 23,
Township 6 North, Range 66 West of the 6th P.M.,
Weld County, Colorado
WHEREAS,at said hearing on November 8,2006,the Board deemed it advisable to continue
the matter to December 20, 2006, at 10:00 a.m., to allow adequate time for re-notification of the
request, excluding C. B. Keirnes Land Company, LLC, from the title as applicant, and
WHEREAS, at said hearing on December 20, 2006, at the request of the applicant, the
Board deemed it advisable to continue the matter to February 21,2007,then to March 28,2007,then
to May 23, 2007, then to June 20, 2007, then to August 1, 2007, at 10:00 a.m., then to
August 22, 2007, to allow the applicant additional time to finalize an Oil and Gas Surface Use
Agreement, and
WHEREAS, at said hearing on August 22, 2007, said applicant was represented by
Thomas Hellerich, 5754 West 11th Street, Greeley, Colorado 80634, and
WHEREAS,the Board of County Commissioners heard all of the testimony and statements
of those present,studied the request of the applicant,and having been fully informed,finds that this
request shall be referred back to the Department of Planning Services to consider the revisions to
the application materials which constitute a substantial change.

NOW,THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the application of TARH E and P Holdings, L.P., for a Site Specific
Development Plan and Use by Special Review Permit#1565 for an Oil and Gas Production Facility
(three(3)oil and gas wells)in the R-1 (Low Density Residential)Zone District on the parcel of land
described above be, and hereby is, referred back to the Department of Planning Services.
The above and foregoing Resolution was,on motion duly made and seconded,adopted by
the following vote on the 22nd day of August, A.D., 2007.
