I'm sorry we've had challenges connecting; unfortunately, our offices were also closed last Friday.
Attached is the Resolution you requested. That's good news about the water condition (COA).
The .tif file that you sent opens an illegible plan; can you send something else, or a hard copy? From the note
below, I understand that it has been revised to show lighting, and to address the screening through relocation of
the parking.
Without seeing the plan, I can't comment on whether the screening or technique you indicate is adequate.
Generally, some form of landscaping would be appropriate, but we'll certainly look at what you've got to show us.

Hi Brad, It seems we are having a difficult time touching base on this project via phone so I though I would send
you the updated site plan to review via email and a hard copy. We had some conditions of approval to address
prior to scheduling the BOCC hearing and I wanted to discuss a few items specifically. I still have not received
the final Resolution so the development standard conditions read exactly as the draft resolution did. Can you
ji send me a co of the PC hearing resolution that was approved when you get a chance? I have had a number o
iscussions with Char Davis about the water condition. Adequate service is available ancjplreadv exists at the u.
site. In the submittal package I included a letter from Central Weld County Water District that indicates was is
adequate and additional is available if needed. I have faxed Char a copy. Please let me know if you are looking
for something other than the letter I included in the submittal. We have updated the lighting by identifying all the
existing lighting on the site and provided a graphic symbol and photo of the exterior lighting type. Please let me �1
know if this is not acceptable. I; '41
Finally, I wanted to discuss with you screening of the parking area. We understand the need to mitigate the '
potential negative impact and aesthetic concerns surrounding the properties however after reviewing the site
layout, existing properties and taking into consideration the improvements on the site will remain as they have for,
years, we feel tucking the parking along the western property line is a much more effective screening than putting!
a fence or some plant material in the middle of such a large area where parking was originally identified. I was .!
hoping you could take a look and see what you think. We propose relocated the parking areas so it is tucked
back into the site and along the western property line; away from roadways and the adjacent homes.
I have attached the site plan and an aerial of the site to see what you think. If you are comfortable with these
changes and verification from Char that everything is ok we would appreciate the soonest available date for the
BOCC hearing. Please call me when you get a chance.

Tiffane,
I have had a change to review the plat copy that arrived in our office yesterday for the Nix Produce site. As you
know, there were three conditions that needed our consideration prior to scheduling with the Board. Following
each is the status from your submittal:
A. The applicant has not indicated any lighting on the site. If lighting is proposed or existing on site it
shall be noted on the Site Plan. The applicant shall adhere to the lighting standards, in accordance
with Section 23-2-160.U.6 and Section 23-3-250.B.6 of the Weld County Code. (Department of
Planning Services)
The lighting shown on the plan will allow trespass off-site and therefore does not meet the requirements of 23-2-
160.U.6. There needs to be some indication that these will be replaced or retrofitted to ensure shielding.
B. The applicant has not delineated any on-site signs. If an on-site sign is desired, the sign shall adhere
to Section 23-4-60 of the Weld County Code. One identification sign per public and quasi-public uses
shall be allowed, provided that the sign does not exceed sixteen (16) square feet. Further, the
location of the sign, if applicable, shall be delineated on the Plan Map. (Department of Planning

Only one sign is indicated, an existing sign on the larger building. Please verify that no other signs will be
requested.
C. The applicant shall submit a Landscape/Screening Plan to the Department of Planning Services. In
order to mitigate the potential negative impact and aesthetic concerns on surrounding properties, the
applicant shall delineate landscaping or other acceptable screening on all sides of any areas
proposed for parking or outdoor storage. Evidence shall also be provided that the proposed water
source allows for watering of landscaping. The Plan shall also address the type and size of any
fencing proposed. (Department of Planning Services)
The relocation of the parking does help mitigate its effect on neighboring properties, but it seems obvious that the
remaining large gravel expanse in the SE corner would be used for storage or parking unless steps are taken to
prevent it. Since it is probably difficult to take any steps to ensure this area would not be used — by seeding the
entire area, for example — it probably is easier to provide some perimeter landscaping as suggested by this
condition.
I will seek additional potential solutions and input from staff at our weekly meeting on Friday for the screening
issue.
Because these conditions are not yet met, I cannot at this time schedule it for a hearing with the Board. Please
also relay this information to Terry, who called this morning. I know that your client is very eager to have this
heard by the Board before the end of the year, but please recognize that — at this time — this is probably not
achievable.

Hi Brad, The applicants on the USR are making more progress with leasing the space out and it almost seems for
sure they have a contract pending with fracking company called Bison. They will have six trucks onsite and 3 of
the temporary silos. Attached are some photos of the operation. They would move into the most northern
building and place the concrete pads and 3 temporary silos along the north edge of the most northern building
(11,000 sq. ft.)
I explained to them that any operation that adds any structures would need to go through a separate review
process but they wanted to ask one more time about adding this use to the current plan. Does the fact that the
silos are temporary change your opinion at all?
If not, this is what I was thinking. Move forward with this application adding the fracking operation but conditioning
the addition of the silos to an approved amendment to this usr so we can keep moving forward and they can close
on this property. The area north of the building between will most likely be where the trucks are kept and we will

Tiffane,
Thank you for the additional information about the possible fracking company use of this site. I also received the
revised copy of the plan map.
We discussed your question in staff and agree that you have the right to bring what is essentially a revised
request to the Board of County Commissioners, indicating additional uses for the fracking company. To be clear,
the actual business —which would be classified as an "oil and gas support and service" in the Weld Code—would
need to be added to the Request. (That is, where the request previously included "oil and gas storage facilities,"
"oil and gas support and service"would have to be added, since this use is not allowed in either the Commercial
or Industrial Zone Districts that are currently covered by the request.) In addition, the plan map would need to be
revised to show the silos.
Could you please provide additional information about the use? For example, what do you mean by saying the
silos are "temporary"? ("Temporary" is defined in the Weld Code as used for 6 months or less — possibly not what
you intend.) How many employees are anticipated? What would the building be used for? Office space,
storage? Would any flammable or explosive materials be stored? Please provide a brief narrative outlining the
proposed use.
Based on the information you have provided, I do not believe that we will need to provide updated information to
any of the referral agencies, with the possible exception of the Health and Building Departments. I am copying
both of them on this e-mail so that they are aware of our discussions.
At the Board hearing, staff will still present the Planning Commission's recommendation, but we will provide them
with the additional written information you give up about the additional use and explain to them how they could
approve a modified request. At that point, it will be your responsibility to convince them that this chance is minor
enough to not require the Planning Commission to have seen it.
Finally, about scheduling with the BCC . . . At this point, you have satisfied two of the three conditions of approval
needed prior to our scheduling, those concerning lighting and signage. The third concerning
landscaping/screening is a good start, and the revised plan you provided has adequate landscaping along the
south and east sides. However, additional screening —fencing or landscaping — is needed along the west
property line, in the vicinities of the parking (north of the house and west of the northern building).
Please provide another revised map showing these additions. Once received, we should be able to get you
scheduled with the Board. (While the electronic copy is helpful, please send two hard copies as well —the last
electronic copy printed partially incorrectly.)
Hopefully this gets us moving towards closure on the project. As always, please feel free to call with any
questions.

The silos will need building permits, when the time comes. (Zoning has to allow them first, through the approved
USR.)
We did look at the west berm, and that will be adequate for the screening on that side, assuming that the farm
field to the west is at-grade with the Nix site. Can you confirm that? If it's high, at grade with the top of the berm,
then we'll have to discuss this further.
To get this scheduled, then, before the Board, please do the following: 1) provide a clean copy of the plat set,
showing the silos in location, and 2) provide a letter (to the Board) requesting the addition of the"oil and gas
support and service" and providing more detail about the business. (See the questions I sent in my previous e-
mail to you.)

Brad, We will request to add the fracking business as "oil and gas support and service" to our USR request. I will
amend the site plan to have four silos placed on concrete pads north of the most northern building. I do need
some clarification on the process or what is required for the silos. They will need to be tied down to the concrete
pad but...does that need to go through the building department for a building permit or is that something the can
just take care of in the field? The concrete pad does not need a "foundation design"does it?
Have you looked at my questions related to landscaping along the western line since the elevated ditch is there?

Thank you for your review of the 2n° Amendment to USR 726. The Use By Special Review request
includes indoor storage and office for MAC Equipment; a single family residence for a MAC
Equipment employee and a number of blanket uses that would be consistent with the surrounding
area that may occur at the site.
On October 3, 2006 the Planning Commission heard a Site Specific Development Plan and Special
Review Permit request for a use permitted as a Use by Right, an Accessory Use, or a Use by Special
Review in the Commercial or Industrial Zone District for Onions Storage and Processing Facility,
Lawn Mower Warehouse, Fencing Manufaa-yrcturing Facility, Offices, Warehousing and Transfer
Facilities, Oil and Gas upport and Sorvicos, and Agricultural Service establishments primarily
engaged in performing agricultural animal husbandry or horticultural services on a fee or contract
basis including, sorting, grading and packing fruits and vegetables; crop dusting or spraying
operations facilities; grain and feed sales; seed production, processing, storage, mixing, blending and
sales; and farm equipment sales, repair and installation facilities, in the A Agricultural Zone District
We of and adjacent to County Road 35; north of and adjacent to CR 44.
The Planning Commission recommended approval with a number of conditions.
The applicant is proposing a variety of blanket uses because of the size of the facility and the
multiple leasing options. The applicant however did not have an "end user" for the site at the time
of the initial submittal or Planning Commission hearing so it was difficult to provide site specific
information for the blanket uses. The nature of the blanket uses created a number of questions at
the time of the Planning Commission hearing and the applicant agreed to remove uses related to Oil
and Gas Support and Services from the USR request during the public hearing to ease concerns the
neighbors had expressed.
After the Weld County Planning Commission hearing, the applicants were contacted by a number
of companies interested in leasing the property and now have a specific use that will accompany the
MAC Equipment Company however; the interested party is Bison Oil Well Company, a well
cementing and fracking business. The activities and needs of Bison fall under the definition of Oil
and Gas Support and Services.
At the request of the applicant, I respectfully request that the uses allowed with Oil and Gas
Support and Services to be reconsidered and reviewed, based on the updated site specific
information, to allow Bison Oil Well Company to be included in the 2n° Amended USR-726.

Bison Oil is a 24 hour on-call oil well cementing business. They will immediately employ seven
people at the proposed site however; they anticipate growth to fourteen employees including office
and administration personnel once they are established in the new facility. Indoor storage of oil
well drilling and cementing tools and equipment will occur in the main 46,000 sq ft. building.
Bison Oil is proposing limited additions to the existing facility (see attached site plan) including:
• One concrete pad (50'x20')
• Four (4) silos, approximately 30' tall (to be located north of the 11,052 sq. ft. building)
• Two cargo storage containers (30'x8'x6')
• Parking (employee and semi-trailer)
There will be three to four silos on the site that will hold cement. They will be located between the
retention pond and the most north building. The silos will be placed upon concrete slabs and will
remain on site as long as Bison operates from this location. When Bison leaves this location the
silos will be removed.
Because Bison is on call 24 hours per day, it is most likely that trucks will be in and out of the site at
any given time to pull up to the silo, load and then proceed to their job site.
We have reviewed the Development Standards and Conditions of Approval and have identified a
