LOCATION: North of and adjacent to C R78; east of and adjacent to the intersection of CR 61 and CR 78.

Dear Mr. McNear:
This law firm represents Anadarko Land Corp., formerly known as Union Pacific
Land Resources Corporation ("Anadarko Land"), with respect to your request for a waiver
for Contreras Farms, Inc. relating to an application for a site specific development plan and
special review permit that has been filed with Weld County ("Town") for approximately 140
acres in the SW/4 of Section 19, Township 7 North, Range 63 West (hereinafter referred to
as the "Property").
Anadarko Land owns all of the coal that underlies the Property.
This letter constitutes a waiver by Anadarko Land as a mineral interest owner to the
receipt of timely notice of a hearing scheduled to be held on April 3, 2007 before the
Planning Commission for Weld County pursuant to Colorado Revised Statutes §§ 24-65.5-
103, 30-28-133, and 31-23-215 ("Notice") under the terms and circumstances set forth in this
letter as follows:
1. Anadarko Land agrees to waive timely notice pursuant to C.R.S. § 24-65.5-
102(2) of the April 3 hearing.
2. Notice is waived only to the extent that the application applies to the Property,
so that Notice is not waived for subsequent applications for development that include
property for which Anadarko Land or Anadarko E&P Company LP or Kerr-McGee Oil &

Gas Onshore LP, companies affiliated with Anadarko Land, own minerals other than the
Property.
Anadarko Land understands that Contreras Farms, Inc. intends to provide this letter to
the County as evidence of the waiver by Anadarko Land to timely notice of the April 3, 2007
hearing in accordance with C.R.S. § 24-65.5-101, et. seq.

Waiver of 30 Day Notice
Waier executed this day of March, 2007 by Petro-Canada Resources (USA) Inc., of
1099 18th Street, Suite 400, Denver, Colorado to Weld County Department of Planning
Services of 918 10th Street, Greeley, Colorado.
Petro-Canada Resources (USA) Inc. was provided a specific notice to mineral interest
owners regarding Case Number USR-1590 dated November 8, 2006, whereby the Public
hearing scheduled for January 2, 2007 was postponed until April 3, 2007. The mineral
interest owners or mineral leasehold owners hereby waive their rights to 30 day notice
prior to the April 3, 2007 hearing as provided by Colorado State Statue.
