Our comments and requirements are as follows: Weld County Road Classification Plan (FHU): (June 2002) WCR 66 (AA Street) is a collector road and requires an 80-foot right-of-way at full build out. There is presently a 60-foot right-of-way. This road is maintained by Weld County. Pursuant to the definition of SETBACK in the Weld County Zoning Ordinance (23-1-90), the required setback is measured from the future right-of-way line. State Highway 392 borders the north end of the property. REQUIREMENTS: -.,cess: The Colorado Department of Transportation (CDOT) has jurisdiction over all accesses to the state highways. Please contact Gloria Hice-Idler at the Greeley office to verify the access permit or for any additional requirements that may be needed to obtain or upgrade the permit. (State Highway 392) Utilize the existing access. The right-of-way or easement shall be a graded and drained road to provide an all- weather access. We have no objections to the proposal, however, we do recommend that the following conditions be part of any approval: We recommend that the following requirements be met prior to allowing the plat to be recorded: 1. The applicant shall submit evidence of an Air Pollution Emission Notice (A.P.E.N.) and Emissions Permit application from the Air Pollution Control Division (APCD), Colorado Department of Health and Environment. A deferment of 45 days for this requirement will be allowed to give the applicant time to file their first production report. Alternately, the applicant can provide evidence from the APCD that they are not subject to these requirements. 2. Submit a dust abatement plan to the Environmental Health Services, Weld County Department of Public Health & Environment, for approval prior to operation. We recommend that the following requirements be incorporated into the permit as development standards: 1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. 2. No permanent disposal of wastes shall be permitted at this site. This is not meant to include those wastes specifically excluded from the definition of a solid waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended. 3. Waste materials shall be handled, stored, and disposed in a manner that controls fugitive dust, fugitive particulate emissions, blowing debris, and other potential nuisance conditions. 3. The applicant shall operate in accordance with the approved "waste handling plan". 4. Fugitive dust and fugitive particulate emissions shall be controlled on this site. The facility shall be operated in accordance with the approved dust abatement plan at all times. 5, A spillage retention berm shall be constructed around the existing and proposed tank batteries. The volume retained by the spillage berm should be greater than the volume of the largest tank inside the berm. Alternative protective measures may also be allowed. 6. Adequate toilet facilities (portable toilets) shall be provided for employees during drilling/construction. 7. Bottled water shall be provided for employees for drinking and hand washing during drilling/construction. 8. All potentially hazardous chemicals must be stored and handled in a safe manner in accordance with product labeling and in a manner that minimizes the release of hazardous air pollutants (HAP's) and volatile organic compounds (VOC's). 9. Building height shall be measured in accordance with the 2003 International Building Code for the purpose of determining compliance with the Bulk Requirements from Chapter 27 of the Weld County Code. The City of Greeley Planning staff has reviewed the application and wishes to forward the following comments: 1. The tank batteries appear to be located within sensitive areas as identified on the City of Greeley Areas of Ecological Significance Map. The applicant should consult with the Division of Wildlife and obtain recommendations for appropriate site specific and cumulative impact mitigation procedures. 2. There was not any reference to compliance with Regulation 7 of the Colorado Department of Public Health and Environment (CDPHE) regarding controls for ozone precursors from oil and gas production facilities. This project does not indicate that devices are included that control flash emissions. Also, there is no reference to whether or not the operator has, or will be, obtaining a permit (APEN) from the Air Pollution Control Division of CDPHE for these tank batteries. Proof of compliance with State Air Pollution regulations or exemption from them should be provided as part of this USR. Thank you for including the City of Greeley in the review process.
