RE: APPROVAL OF AGREEMENT BETWEEN WELD COUNTY AND THE CONTIN-
ENTAL PIPELINE COMPANY FOR IMPROVEMENTS TO WELD COUNTY ROAD
181 AND AUTHORIZATION FOR CHAIRMAN TO SIGN
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, an agreement between Weld County and the Contin-
ental Pipeline Company for improvements to Weld County Road 18'/2
has been presented to the Board of County Commissioners, and
WHEREAS, said agreement provides for Weld County to pay for
50% of the total cost up to a maximum of $1500. 00, and
WHEREAS, said agreement, being attached hereto and incor-
porated herein by reference, provides that after completion and
inspection, Weld County will make payment to Continental Pipeline
Company within thirty days of receipt of invoice, and
WHEREAS, the Board has studied said agreement and deems it
advisable to approve same.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado that the agreement between
Weld County and the Continental Pipeline Company for improvements
to Weld County Road 18# be, and hereby is, approved.
BE IT FURTHER RESOLVED by the Board that the Chairman be,
and hereby is, authorized to sign said agreement.
The above and foregoing Resolution was, on motion duly made
and seconded, adopted by the following vote on the 18th day of
October, A.D. , 1982.

AGREEMENT
THIS AGREEMENT, made and entered into this /87+day of
2c lobe r , 1982, by and between the COUNTY OF WELD, STATE OF COLORADO,
hereinafter called "County" and THE CONTINENTAL PIPELINE COMPANY, here-
inafter called "Continental" .
WHEREAS, Continental desires to improve Weld County Road
18 . 5 from U. S. Highway 85 east to Continental ' s truck unloading facility,
and
WHEREAS, the County has reviewed the proposed improvements
and acknowledges they will enhance the accessibility and safety of that
portion of Weld County Road 18 . 5 .
For and in consideration of the mutual covenants and conditions
hereinafter set forth, the parties mutually agree as follows :
1. Continental will contract the installation of six (6)
inches of new base course and three (3) inches of new asphalt on County
Road 18 . 5 in accordance with the attached drawing labeled "Exhibit A" .
2 . Weld County will bear one-half the cost of the new base
and asphalt up to a maximum of $1500 . 00 for that portion on Road 18 . 5
that would be the normal 24 foot wide through lanes.
3. Continental will be responsible for all utility relocations
and construction along U. S. 85, in accordance with Exhibit A. 1.
4 . All construction and material shall conform to the "State
Department of Highways, Division of Highways , State of Colorado, Standard
Specifications for Road and Bridge Construction" dated 1976 .
5. Weld County will have the right to inspect the work and
the ability to reject any material or construction not meeting specifica-
tion.
6 . After construction has been completed, Continental will
invoice the County and the County will make payment within thirty (30)
days of receipt of invoice.
7 . After receipt of the County ' s payment, Continental will
deed additional right-of-way on Road 18 . 5 to accomodate the proposed
improvements .
IN WITNESS WHEREOF, the parties hereto have duly executed the
agreement the day and year first-above written.
