RESOLUTION RE: APPROVAL OF RECORDED EXEMPTION NO. 477 - MR. AND MRS. LARRY FULTON WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, it has been determined by the Board of County Com- missioners of Weld County, Colorado, at a public meeting held on the 21st day of January, 1981 in the Chambers of the Board of County Commissioners of Weld County, Colorado, that the divi- sion into two parcels of land, as shown on the plat known as Recorded Exemption No. 477 , being the property of Mr. and Mrs . Larry Fulton, described as part of the Southwest Quarter of Section 18, Township 2 North, Range 67 West of the 6th P.M. , Weld County, Colorado, being more particularly described as follows does not come within the purview of the definition of the terms "subdivision" and "subdivided land" , pursuant to its authority under Section 30-28-101 (10) (d) , CRS 1973 , as amended: A part of the Southwest one-quarter of Section 18, Township 2 North, Range 67 West of the 6th Principal Meridian, Weld County, Colorado being more parti- cularly described as follows: Commencing at the West one-quarter corner of said Section 18; thence along the North line of the Southwest one-quarter of said Section 18 North 89°42 ' 08" East, 255 . 90 feet to the True Point of Beginning, said point also being on the Easterly right-of- way line of the Union Pacific Railroad; thence continuing along the last described course North 89°42 ' 08" East, 358 . 51 feet; thence South 01°29 '22" East, 2590 . 53 feet to a point on the Northerly right-of-way line of County Road No. 20 ; thence along said right-of-way line South 90°00 '00" West 385. 51 feet to a point on the Easterly right-of-way line of the Union Pacific Railroad; thence along said Easterly right-of-way line North 00°53 '25" West, 2588. 13 feet to the point of beginning, containing 22 . 11 acres , more or less . WHEREAS, the Board of County Commissioners of Weld County, Colorado finds that this particular division of land is not within the purposes of the Weld County Subdivision Regulations and the Board desires to exempt this particular division of land from the definitions of "subdivision" and "subdivided land" 810561 pursuant to its authority under Section 30-28-101 (10) (d) , CRS 1973, as amended, and Section 2-1A(3) of the Weld County Sub- division Regulations. The parcel of land on which this request has been made is described as part of the SW1, Section 18, T2N, R67W of the 6th P.M. , Weld County, Colorado. This property is located 1 mile north of Firestone at 6071 Weld County Road 20. The property contains approximately 22.11 acres of Class IV and VI nonir- rigated soils. The request is to split the property into parcels of 10.0 acres and 12.11 acres. On September 17, 1980 the Board of County Commissioners approved a request from Mr. and Mrs. Fulton for a lot size variance so that they could make application for this recorded exemption. At the time they made the decision on that request, the Department of Planning Services Staff submitted a letter of recommendation for approval to the Board. A copy of that Staff recom- menation for approval is included in the attached packet. Nothing has been received by, our office that would change our recommendation for approval. On September 25, 1980, the applicant received approval of the Board of Adjustment for a variance from the 180 foot minimum lot width requirement. Mr. and Mrs. Fulton have obtained a written easement for the property which should be recorded with the recorded exemption plat. The Department of Planning Services Staff's approval is conditional upon the applicant placing a note on the recorded exemption plat referencing the easement document prior to recordation of said plat. Larry Fulton. The property on which this request has been made is described as Pt. SWa Secton 18, T2N, R67W of the 6th p.m. , Weld County, Colorado. This property is located z mile north of the incorporated boundaries of the Town of Firestone. • The property under consideration contains approximately 22.1 acres of class IV and VI non-irrigated soils. The request is to obtain a variance from the minimum lot size requirement, Section 9-4 . A. (6) of the Weld County Subdivision Regula- tions , so that they may make application for a recorded exemption. The Fultons wish to sell the north half of their property. The balance of the property will be retained by the Fultons which has their residence located on it. Based upon the information submitted and the adopted policies in the County, the Department of Planning Services Staff recommends this request be approved for the following reasons : 1. The request is in compliance with the policies of the Weld County Comprehensive Plan in that to minimize conflicting land uses , residential development will be encouraged to locate adjacent to the existing towns and in accordance with the comprehensive plans and stated wished of each community. The parcel of land is located just outside the Tri-Area Comprehensive Planning area. The Tri-Area Planning Commission has set forth no objections to this request. 2. The back part is not suitable for farm- ing because it can not be irrigated. The water Board in Denver told us because we have a well in our name. they will not give us another well permit. However when the land is sold and the deed is in the new owners name the well permit will be given. Hope this is the information you will need to help you make your decision.
