RE: AUTHORIZATION FOR THE WELD COUNTY ATTORNEY TO PROCEED WITH LEGAL
ACTION AGAINST MATHEW AND CHRISTOPHER MCKENNA FOR VIOLATION OF THE
WELD COUNTY CODE
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, Mathew and Christopher McKenna, VI#0600541, are allegedly in violation of
the Weld County Code, and
WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has
not been corrected, and
WHEREAS, on the 8th day of May, 2007, a public hearing was held before the Board of
County Commissioners for the purpose of hearing testimony relating to said violation, and
WHEREAS, Mathew and Christopher McKenna were not present or represented at said
hearing,although all parties were notified of said hearing by Department of Planning Services staff,
and
WHEREAS,the Board of County Commissioners deems it advisable to refer said violation
to the Weld County Attorney's Office for legal action, with an instruction for delay of action upon
such referral until July 10, 2007, to allow adequate time for the property owners to restore or
remove the remaining derelict vehicles to bring the subject property into compliance and for an
inspection of the property by the Department of Planning Services staff.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that VI #0600541 be, and hereby is, referred to the Weld County Attorney's
Office for legal action against Mathew and Christopher McKenna to remedy the violation of the
Weld County Code, and any other persons occupying the properties, any persons claiming an
interest in the properties, and any persons acting in active concert with the identified parties, with
an instruction for delay of action upon such referral until July 10, 2007, to allow adequate time for
the property owners to restore or remove the remaining derelict vehicles to bring the subject
property into compliance.

REMEDY
During a recent inspection, I noted you have made considerable progress. A very nice privacy
fence has been installed; however, there are still DERELICT VEHICLES situated outside of the
SCREENED area.
Please see the enclosed pictures. Also, please keep in mind that should the property be cleanec
prior to the May 8th Hearing, the hearing would be cancelled.
RECOMMENDATION
The Department of Planning Services recommends that this case be referred to the County Attorney's
Office, but to delay legal action for 30 days to allow them more than adequate time to remove or repair
the remaining derelict vehicles.

01/04/2007 Phone Call George McKenna (303-953-9663) called. He said
he and his wife just recently moved in and had to
do it rather quickly. They needed to leave to take
her to her cancer treatment. He said they have a
few vehicles that do not have current plates and
are not in running condition. He said he would
move them into the garage, but the garage is full
of stuff that they moved in there quickly. I
explained that typically my next step is a 30 day
letter, but in this case I would go ahead and grant
a 90 day letter. I explained that by the end of that
90 days, he would need to be able to
communicate to my how he intends to correct the
remaining derelict vehicles, whether it be a fence,
putting them in the garage or repairing them and
maintaining current license plates. He said okay.
He asked what the set backs were from Dunmire
St. I told him that I would get that information for
him as soon as possible and let him know.
12/11/2006 Property Inspected Upon a visual inspection of the property, the
following items were noted: 3+ derelict vehicles.
No pictures were taken during this inspection.
04/09/2007 Property Inspected Upon a visual inspection of the property, the
following items were noted: Green van, Red &
White Scout, Blue (Grey) car, Camper/trailer,
Covered vehicle in the driveway, Red car and a
brown(grey) car. See pictures dated 04/09/07.
04/24/2007 Property Inspected Upon a visual inspection of the property, the
following items were noted: 1 car on tire stands
and 1 car still covered with a tarp. No pictures
were taken during this inspection.
05/01/2007 Phone Call George McKenna called. He said he was
frustrated because he was under the impression
that he had more time. He said he just received a
letter yesterday. I explained that I was sorry, I
didn"t know why the letter took so long to get to
him. I sent it on 04/12/07. He said between
doctor visits and other things they just didn"t
make it to the post office before then. I advised
him that if he couldn"t attend the hearing to write
a letter advising how much additional time he
thought he would need to take care of the 2
remaining vehicles. He said he"d get that off to
me right away.

recommended that you or a representative be in attendance to answer any questions the Board of
County Commissioners might have about the violations.
Please also be advised that I will be taking video and/or pictures from the road or adjacent properties
the business day before or as soon as possible to the above mentioned Violation Hearing date.
The Department of Planning Services' staff will be recommending that the Board of County
Commissioners authorize the County Attorney to proceed with legal action to remedy the violation. Our
records indicate that you were made aware of the nature of the violation including the action necessary
to correct the violation, and that you were given sufficient time to remedy this violation. If you have any
