RE: ACTION OF THE BOARD OF COMMISSIONERS REGARDING VIOLATION VI#0700031
AGAINST COLORSTAR GROWERS OF COLORADO FOR VIOLATION OF THE WELD
COUNTY CODE
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, ColorStar Growers of Colorado, VI #0700031, is allegedly in violation of the
Weld County Code, and
WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has
not been corrected, and
WHEREAS, on the 9th day of October, 2007, a public hearing was held before the Board
of County Commissioners for the purpose of hearing testimony relating to said violation, at which
time, the matter was continued to November 13, 2007, to allow adequate time for the Fort Lupton
Fire Department to conduct a controlled burn to bring said property into compliance.
WHEREAS, on the 13th day of November, 2007, a public hearing was held before the
Board of County Commissioners for the purpose of hearing testimony relating to said violation,and
WHEREAS,ColorStar Growers of Colorado was not present or represented at said hearing,
although all parties were notified of said hearing by Department of Planning Services staff, and
WHEREAS, the Board deems it advisable to dismiss said matter due to the property being
in compliance.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that VI #0700031 be, and hereby is, dismissed due to the property owners
bringing said property into compliance.

miscellaneous debris shall be removed, restored or completely screened from all adjacent properties anc
rights-of-ways.

01/17/2007 Property Inspected Chris Gathman & Michelle Martin conducted an on-site
inspection. They noted a large amount of pallets and a
red box style truck full of iron/metal, wires, crates &
miscellaneous debris. See pictures taken by Chris &
Michelle dated 01/17/07.
08/02/2007 Phone Call I called Brian Aguiar(303-558-8654) and left him a
message asking to schedule an on-site inspection as a
follow up to the violation issued in Jan of 2007. I asked
him to call me at his earliest convenience.
10/08/2007 Phone Call I called David Harmer. He indicated that they now have
heard from Fort Lupton Fire Department and they have
indicated that they will conduct a control burn on October
20th. Mr. Harmer wants to know if we would be willing to
push out the violation hearing to the next available hearing
after October 20th. I told him that would be November
13th. He said that would be great. I told him to get a
letter from the Fort Lupton Fire Department and fax it into
me and I would present his request to the BOCC
tomorrow morning. He said thank-you.
10/24/2007 Property Inspected During an on-site inspection with David Harmer, Michelle
Martin, Don Dunker(w/ Public Works) and I, the following
items were noted: pallets had been burned. CLOSE

Please also be advised that I will be taking video and/or pictures from the road or adjacent
properties the business day before or as soon as possible to the above mentioned Violation
Hearing date.
The Department of Planning Services' staff will be recommending that the Board of County
Commissioners authorize the County Attorney to proceed with legal action to remedy the
violation. Our records indicate that you were made aware of the nature of the violation including
the action necessary to correct the violation, and that you were given sufficient time to remedy
