Thank you. ASSEMBLAGE APPLICATION OF LOVE-AIR, INC. Review of application: 1. Applicant: Love-Air R/C Inc 2. Purpose: Assembly for pilots of radio-controlled model aircraft 3 . Dates: Aug 18 and 19 4 . Maximum of 600 people 5. Maximum number of tickets: No tickets are being sold 6. As to the plan to limit the number of people, they say that the number of people will be limited by the number of parking spaces available; however, there is no information as to the number of parking spaces. 7. Adequate supply of potable drinking water: They say the food and drinks will be supplied by Heidi's Brooklyn Deli 8. Disposal of solid waste: They say there will be 16 trash barrels and two dumpsters and that the trash barrels will be checked every hour and emptied as needed. 9. There will be 6 porta pots and three washing stations. This is sufficient for 600 attendees. 10. Plans to provide medical facilities: The Code requires people on site. This group says they plan to contact 911 and tell them about the event, providing location, dates, and times. ***I DO NOT BELIEVE THIS MEETS THE CODE'S REQUIREMENTS. 11. Nighttime Illumination: Not needed, the event ends at 4:00 on the first day and 2 :00 on the second day. 12 . Plans for parking: All access to event off of Highway 14 . Traffic control by Northern Colorado Traffic Control. Club members direct traffic to places 13 . Plans to communicate with emergence personnel: The event director will contact emergency services by cell phone. 14 . Identify camping facilities: This is a dry camping area for the pilots, located within the parking area. ***QUERY: IF THERE IS CAMPING, THEN THE ASSEMBLY WILL LAST INTO THE NIGHT, AND PRESUMABLY THERE NEEDS TO BE SUFFICIENT ILLUMINATION, AND THE CAMPING FACILITIES NEED TO BE IN COMPLIANCE WITH STATE AND LOCAL REQUIREMENTS. - THERE IS NO INDICATION OF SUCH COMPLIANCE. 15. Plans for fire protection: Fire extinguishers will be stationed along the flight line. Crops in the immediate fields will have been harvested, and all vegetation in the flying area and spectator area will be trimmed. 16. Plans for security: The only security will be by members of the group. There are over 50 members. They will "tightly" control for pilot and spectator safety. ***I DO NOT BELIEVE THIS MEETS THE CODE REQUIREMENT FOR SECURITY, WHICH CALS FOR AT LEAST 2 SECURITY PERSONS FOR EVERY 350 PEOPLE, WHEN THOSE SECURITY FOLKS MUST BE LICENSED PRIVATE GUARDS OR OFF-DUTY PEACE OFFICERS. 17. Sound Control and Sound Amplification: The club provides a PA system the system has 4 amplifiers. 18. Plans to meet County Health standards for food concessions and concessionaires : All food is provided by Heidi' s Deli, License # 009929 19. Plans for Electrical Systems: Power for the PA system is provided by a generator. 20. Plans to ensure preservation of the site and for dust abatement: This is covered in their lease with the landowner. 21. Bonding Company Statement: They say that no bond is required, as they have to maintain a $4000 damage deposit for the cleanup of the property, as per the conditions of the lease. ***I THINK THEY MISUNDERSTAND THE BOND'S PURPOSE ---THIS WOULD NOT SATISFY THE REQUIREMENTS OF THE CODE. 22 . Insurance Company Statement: The club is chartered by the Academy of Model Aeronautics (AMA) , and has insurance coverage of $2, 500, 000. In addition, each pilot is individually insured for $2,500, 000. 23. Application fee of $100: NOTES ON THE LEASE: This is a 15 year lease for a 12 acre parcel The aerial photo would indicate that parking is adequate. I question that the crops will have been harvested by August 18, as stated above, and wonder if there is more of a fire hazard than stated - hard to say if the 12 acres, which has little to no vegetation is, in and of itself, sufficient to minimize fire danger. Need to get a bond in an amount which is commensurate with those done recently on other cases ($2,500 to $4, 000) . Original Message From: Stephanie Arries Sent: Wednesday, August 01, 2007 1:42 PM To: Bruce Barker Subject: RE: ASSEMBLY APPLICATION The way the section on the escrow reads is as follows: Cleanup or Damage Account "Love Air R/C will maintain an escrow account of $4000.00 plus interest. This account would be in both the landlords and lessees names and can be reviewed at any time by the landlord, and cannot be used for any other purpose other than to return the site to its original condition. Lessee will provide a copy of the most recent statement semi-annually. The statement will be included with the semi-annual payment. " In this case, the lessee was permitted to install a model airstrip, a shade shelter a parking area, etc. The lease then calls for the lessee to return the property to its original condition at the end of the 15 year term. I read that provision quoted above as designed to offset the cost of returning the property to farm ground. If we are requiring them to get a bond to cover the event, what amount sounds right to you? I really do not have any experience with the bonding at all? Also, can I call them or do I need to have a letter go out. I am concerned about the time issue here. Stephanie Original Message From: Bruce Barker Sent: Wednesday, August 01, 2007 1:20 PM To: Stephanie Arries Subject: RE: ASSEMBLY APPLICATION Thanks. Good work. Contact them and let them know 10 and 16 need to be taken care of. Overnight camping in 14 is OK -- those guys do that all the time. The way I understood 21 was that the deposit is to be used for cleanup for events like this if the lessee does not do it. If it is a general security deposit, we need more. Find out how that deposit works, and if the Board can draw off it.
