RE: APPROVE VACATION OF USE BY SPECIAL REVIEW PERMIT #731 - HALL-IRWIN
CORPORATION
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS,by Resolution dated May 14, 1986,the Board approved Use by Special Review
Permit#731 for a Wet, Open-Cut Sand and Gravel Operation for Reynold Herbst on the following
described real estate, to-wit:
Part of the NW 1/4/4 of Section 31, Township 6, North,
Range 66 West of the 6th P.M., Weld County,
Colorado
WHEREAS, the Board has received a request from Jeff Gregg, on behalf of the current
property owner, Hall-Irwin Corporation, 301 Centennial Drive, Milliken, Colorado 80543, to vacate
said Use by Special Review Permit#731, and
WHEREAS,the Board of County Commissioners heard all of the testimony and statements
of those present, studied the request of the applicant and the recommendations of the Department
of Planning Services staff and all of the exhibits and evidence presented in this matter and, having
been fully informed, deems it advisable to approve said vacation.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that Use by Special Review Permit#731 be, and hereby is, vacated.

Request for Vacation of USRs
Hall-Irwin Company, applicant
DMG Permit# M-1986-031
The Department of Planning Services received a letter dated October 6, 2007 from Jeff Gregg,
Resource Manager for the Hall-Irwin Company, requesting vacation of USR-731 and USR-875.
Staff research also identified USR-927 as a land use permit for the Herbst gravel pit. Verbal
confirmation from Mr. Gregg was received indicating that it was their desire to vacate all County
permits associated with the Herbst Mine.
The Department of Public Works, in their letter received October 24, 2007 indicated that there
are no outstanding issues and recommended that the request to vacate all Use by Special
Review land use permits for the Herbst mining operation be approved.
The Department of Planning Services and the Department of Public Works therefore requests
on behalf of the applicant, that the Board of County Commissioners approve the vacation of
USR-731, USR-875 and USR-927 and their amendments, for the Herbst Mine.

RE: Vacation of USR-731 and USR-875
Dear Mr. Ogle,
Hall-Irwin Corporation is requesting a full release of USR-731 and USR-875 for the Herbst gravel pit. Hall-
Irwin Corporation owns the property which is located in the northwest one-quarter of the northwest one-
quarter,the south half of the northwest one-quarter,the north half of the southwest one-quarter, the
northwest one-quarter of the southeast one-quarter and the southwest one-quarter of the northeast one-
quarter all in Section 31, Township 6 North, Range 66 West of the 6th P.M.
The USR permits established Hall-Irwin Corporation's right to mine the Herbst gravel pit site. Hall-Irwin
Corporation wishes to vacate the USR permits as the Herbst gravel pit site is now fully reclaimed. Evidence
of this is provided with this letter in the form of the Division of Reclamation and Mine Safety(DRMS)
reclamation bond release. I am also attaching a Statement of Authority indicating that I am authorized to
sign for Hall-Irwin Corporation in this request.

Dear Mr. Jeff:
At your request, I am writing this letter to verify that the Weld County Public Works Department
has no outstanding issues in the request to release the Herbst Gravel Pit M-1986-031, a 112 C
Permit.
In verifying with Greg Nelson, our mining supervisor, we have mined that particular pit and
moved on to the 83rd Avenue Gravel Pit directly east of this gravel pit. The 83rd Avenue Gravel
Pit is now identified as the Poudre Learning Center site. We are currently working with the
Poudre Learning Center on some reclamation adjacent to the water storage reservoir.
The Weld County Public Works recommends release of the USR associated with the Herbst
Gravel Pit, as we have no outstanding issues.
