This administrative decision can be appealed per Section 23-6-20 of the Weld County Code. At this same work session, however, the Board also acknowledged that you may request an early grading permit, under the condition that you acknowledge that such permit is issued at your risk and expense. Such risk could include removal and/or modification of the proposed structure, should a special use permit or any other required permit be denied or be found to be unobtainable. In discussions with Planning Staff last month about this specific request, you have been advised that the building permit requested represents an increase in the non-conforming use of a dairy currently on the site. As such, a use by special review is required. Per Section 23-3-40.8.16, livestock confinement operations are allowed in the Agricultural Zone District only through a special use permit. We look forward to receiving your application for a USR on this site. Currently, a hold has been placed on the recent Building Permit associated with the site, withholding a Certificate of Occupancy until a USR application has been submitted. Once a complete USR application has been received, the permit will be able to be finaled. Please feel free to contact me, Bryon Horgen, or any planner-on-call with questions about the USR process. In association with these 18 uses,the applicant also informed the Board that they would be actively pursuing the development of a 3,500 head dairy, with approximately 2,600 head for milking, and the remainder used as replacement stock. Because the Board of County Commissioners accepted these permits,I do not believe that it is necessary for the applicant to pursue a Use by Special Review permit on this particular dairy. The Department of Plann rig Services will follow up with a Non-Conforming Use on this property, and document any changes In use from the original proposal. • Because of the uniqueness associated with this request, I am forwarding you this memo to allow you the opportunity to evaluate whether or not this site meets CAFO regulations. While the applicants may have a Non-Conforming Use associated with the property,for the dairy,it's my belief that CAFO regulations still need to be enforced and applied to the site. Some timeline info: • I met with Tom in mid-August, when he gave a general overview of changes. Trevor was there, too. I asked for info in writing, and sent a note to Roger V. and Kim about what they were contemplating. • In September and October, I reminded Dusty several times about their intention to send some writing description. • On November 2, 2006, I sent Tom Haren an e-mail, reminding him of their intention to give us more information. I explained that the east property was not currently under a USR (he had thought it was), explained that there could easily be issues with the worker mobile homes and floodplain, and emphasized that we could help them sort through this if they got us something in writing. • We have never gotten any detailed written description of their overall plans. Since it was just a meeting notice, requested by Dusty McCormick (AgPro) and approved by Comm. Jerke, we are not completely sure what the topic is supposed to be, but we suspect it has to do with staff's recent response to their request for a building permit. The building permit would expand an existing building, which we have told them would trigger a USR (essentially expansion of a non-conforming use). As I understand it from Michelle, we advised Dusty that if they have a concern about staff's determination that a USR is triggered, the mechanism for appealing that administrative decision is through the BOA. In that sense—if this is what AgPro wants to talk about— I'm not sure it's appropriate that the Board talk about a potential USR case. Maybe Bruce has an opinion? (Bruce?) What is particularly frustrating, and where I'm involved, is that this is exactly the thing that we warned AgPro about last summer. Tom Haren met with me in August to describe in general terms that changes that AgPro was considering. While many of these were just decreasing uses on the site—taking down pens and buildings— it sounded as some activity could increase the intensity of use. I asked them then —and many, many time since— to give us some overview in writing, so that we could advise them of what might trigger a USR or RE. We never got that. So just a quick note to advise you of the meeting, and to see if Bruce has any concerns about the Board's ability to hear this. If I can participant in any way I would be interested. Also, we need to add two milk tanks that need to be inside the building. This will require a small building expansion of approximately 1,000 square feet. I would like to review this with you, so when you are in the area, call so I can show you the proposed addition. This should be consistent with the USR of a building additions totaling 29,000 square feet and this small addition basically fills in a corner of the existing building.
