Approved with Conditions The Weld County Department of Planning Services has determined through an administrative review that the standards of Section 24-8-40 of the Weld County Code have been met. This Recorded Exemption is approved with the following conditions in accordance with information submitted in the application and the policies of Weld County. 1. A Weld County septic permit is required for any proposed home. The septic system shall be installed according to the Weld County Individual Sewage Disposal System (I.S.D.S.) regulations. All septic systems must be located on their respective lots and meet all lot line set back requirements. X107-- 5Fq? 2. Topographic or physical features of the proposed Lots, such as ravines, ditches, streams etc. may limit the area available for a new or replacement septic system. Prior to recording the plat the Weld County Department of Public Health and Environment recommends that the applicant review the Weld County Code pertaining to septic systems to assure that any installed septic system will comply with all setback requirements found in the Code. In the event the proposed lot is not of sufficient size to allow the installation of a replacement septic system the lot may need to be enlarged (Lot A). 3. The West Greeley Soil Conservation District has provided information regarding the soils on the site. The applicant shall review the information and use it to positively manage on site soils. 4. Prior to recording the plat: VR. The plat shall be titled: Recorded Exemption No. 0963-18-3 RE-4717 B. The applicant shall submit to the Weld County Department of Planning Services evidence that any existing septic system meets all requirements of the Weld County Department of Public Health and Environment. The Weld County Department of Public Health and Environment was unable to locate a septic permit for the septic system located at 24081 Highway 34 (proposed Lot A). Any existing septic system which is currently not permitted through the Weld County Department of Public Health and Environment will require an I.S.D.S. evaluation prior to the issuance of the required septic permits. In the event the system is found to be inadequate, the system must be brought into compliance with current I.S.D.S. regulations. County Road 49 is designated on the Weld County Road Classification Plan as a major arterial road, which requires 140 feet of right-of-way at full build out. There is presently zero feet of right-of-way. An additional 70 feet shall be delineated on the plat as future County Road 49 right-of-way. All setbacks shall be measured from the edge of future right-of-way. 0The Colorado Department of Transportation (CDOT) has jurisdiction over all accesses to State Highways. Please contact CDOT to verify the access permit or for any additional requirements that may be needed to obtain or upgrade an access permit to Lot A. J. The applicant shall provide to the Weld County Department of Planning Services a copy of the access permit issued by the Colorado Department of Transportation (CDOT) which grants access to State Highway 34, or written evidence that the applicant has complied with the requirements of the Colorado Department of Transportation (CDOT). The access permit number shall be located on the plat. K. The applicant shall complete and submit the appropriate zoning and building permit applications and pay the appropriate fees to the Weld County Department of Planning Services for the structure currently being stored on beams on the proposed Lot B. The applicant shall obtain a pre-move inspection by the Building Department and apply for a building permit to set the structure permanently. Lot A shall comply with the one (1) acre net minimum lot size required by Section 24-8-40.L of the Weld County Code. Net acreage calculations should not include reserved road right- of-way. titt." Pl/ Any existing oil and gas facilities located on the property shall be delineated on the plat along with their respective setback radii in accordance with section 23-3-50.E of the Weld County Code. P. The applicant shall provide the Weld County Department of Planning Services with a Statement of Taxes from the Weld County Treasurer showing no delinquent taxes exist for the original parcel. Q. The following notes shall be placed on the plat: t7 All proposed or existing structures will or do meet the minimum setback and offset requirements for the zone district in which the property is located. Pursuant to the definition of setback in the Weld County Code, the required setback is measured from the future right-of-way line. No building or structure as defined and limited to those occupancies listed as Groups A, B, E, F,H, I, M and R in Section 302.1 of the 2003 International Building Code, shall be constructed within a 200-foot radius of any tank battery or within a 150-foot radius of any wellhead. Any construction within a 200-foot radius of any tank battery or 150-foot radius of any wellhead shall require a variance from the terms of the Section 23-3-10 of the Weld County Code. 2/ Any future structures or uses on site must obtain the appropriate zoning and building permits. 3) Lot A is not eligible for a future land exemption in accordance with Section 24-8- 20.C.1 of the Weld County Code. • • 4) Prior to the release of building permits, the applicant shall submit a recorded deed describing the Lot upon which the building permit is requested with the building permit applications. The legal description on such deed shall include the Lot designation and Recorded Exemption number. 5) Prior to the release of building permit, the applicant shall submit evidence of approval from the Platte Valley Fire Protection District to the Weld County Building Department. 6) Should noxious weeds exist on the property or become established as a result of the proposed development the applicant/landowner shall be responsible for controlling the noxious weeds, pursuant to Chapter 15, Articles I and II of the Weld County Code. 7) SE-1121 was approved in conjunction with this Recorded Exemption for the purpose of dividing off a second set of existing improvements from the parcel. 8) Building permits shall be obtained prior to the construction of any building. Buildings that meet the definition of an Ag Exempt Building per the requirements of Section 29- 1-20 and Section 29-3-20.6.13 of the Weld County Code do not need building permits, however, a Certificate of Compliance must be filed with the Planning Department and an electrical and/or plumbing permit is required for any electrical service to the building or water for watering or washing of livestock or poultry. 9) Effective January 1, 2003, Building Permits issued on the proposed lots will be required to adhere to the fee structure of the County Road Impact Program. (Ordinance 2002-11) 10) Effective August 1, 2005, Building permits issued on the subject site will be required to adhere to the fee structure of the Capital Expansion Impact Fee and the Stormwater/Drainage Impact Fee. (Ordinance 2005-8 Section 5-8-40) 11) Potential Purchasers are hereby notified that a confined animal feeding operation is located directly northwest of the intersection of County Roads 47.5 and State Highway 34. Off-site impacts that may be encountered include noise from trucks, tractors and equipment; dust from animal pens and odors from animal confinement, silage, and manure. 12) This property lies within the Airport Overlay Zone as determined by Section 23-5-10 of the Weld County Code. The properties are in close proximity to the initial approach fix for Runway 34 Instrument Landing System. Future structures on these properties may be subject to an FAA Aeronautical Study under Part 77 of the Code of Federal Regulations. 13) Prior to the release of building permits on Lot A, the Lot owner shall verify with the nearest Town/City or Sanitation District to determine the location of the nearest sanitary sewer line. In accordance with the Weld County Code, if a sewer line exists within four hundred (400) feet of the property line and the sewer provider is willing to serve the proposed structure, a septic permit cannot be granted by the Weld County Department of Public Health and Environment. Evidence of such shall be submitted in writing to the Weld County Department of Planning Services. 14) WELD COUNTY'S RIGHT TO FARM: Weld County is one of the most productive agricultural counties in the United States, ranking fifth in total market value of agricultural products sold. The rural areas of Weld County may be open and spacious, but they are intensively used for agriculture. Persons moving into a rural area must recognize and accept there are drawbacks, including conflicts with longstanding agricultural practices and a lower level of services than in town. Along with the drawbacks come the incentives which attract urban dwellers to relocate to rural area: open views, spaciousness, wildlife, lack of city noise and congestion, and the rural atmosphere and way of life. Without neighboring farms, those features which attract urban dwellers to rural Weld County would quickly be gone forever. Agricultural users of the land should not be expected to change their long-established agricultural practices to accommodate the intrusions of urban users into a rural area. Well run agricultural activities will generate off-site impacts, including noise from tractors and equipment; slow-moving farm vehicles on rural roads; dust from animal pens, field work, harvest, and gravel roads; odor from animal confinement, silage, and manure; smoke from ditch burning; flies and mosquitoes; and the use of pesticides and fertilizers in the fields, including the use of aerial spraying. Ditches and reservoirs cannot simply be moved out of the way of residential development without threatening the efficient delivery of irrigation to fields which is essential to farm production. Section 35-3.5-102, C. R. S., provides that an agricultural operation shall not be found to be a public or private nuisance if the agricultural operation alleged to be a nuisance employs methods or practices that are commonly or reasonably associated with agricultural production. Weld County covers a land area of over 4,000 square miles in size (twice the State of Delaware) with more than 3,700 miles of state and County roads outside of municipalities. The sheer magnitude of the area to be served stretches available resources. Law enforcement is based on responses to complaints more than on patrols of the county and the distances which must be traveled may delay all emergency responses, including law enforcement, ambulance, and fire. Fire protection is usually provided by volunteers who must leave their jobs and families to respond to emergencies. County gravel roads, no matter how often they are bladed, will not provide the same kind of surface expected from a paved road. Snow removal priorities mean that roads from subdivisions to arterials may not be cleared for several days after a major snowstorm. Snow removal for roads within subdivisions are of the lowest priority for public works or may be the private responsibility of the homeowners. Services in rural areas, in many cases, will not be equivalent to municipal services. Rural dwellers must, by necessity, be more self-sufficient than urban dwellers. Children are exposed to different hazards in the county than in an urban or suburban setting. Farm equipment and oil field equipment, ponds and irrigation ditches, electrical power for pumps and center pivot operations, high speed traffic, sand burs, puncture vines, territorial farm dogs, and livestock present real threats to children. Controlling children's activities is important, not only for their safety, but also for the protection of the farmer's livelihood. Parents are responsible for their children. 5. The applicant shall submit two (2) paper copies of the plat for preliminary approval to the Weld County Department of Planning Services. Upon approval of the paper copies the applicant shall submit a Mylar plat along with all other documentation required as conditions of approval. The Mylar plat shall be recorded in the office of the Weld County Clerk and Recorder by Department of Planning Services' Staff. The plat shall be prepared in accordance with the requirements of Section 24-8-60 of the Weld County Code. The Mylar plat and additional requirements shall be submitted within sixty(60) days from the date the Administrative Review was signed. The applicant shall be responsible for paying the recording fee. 6. The plat for SE-1121 shall be recorded concurrently with the plat for RE-4717. 7. In accordance with Weld County Code Ordinance 2005-7 approved June 1, 2005, should the plat not be recorded within the required sixty (60) days from the date the Administrative Review was signed a $50.00 recording continuance charge may be added for each additional 3 month period. 8. Planning Description of the issue: Mr. Cecil Howard has an 80 acre property on HWY 34 west of Kersey at CR 49. He is wanting to place a house, currently on beams , on a foundation. This property has always had three homes. When the highway was widened, one home was relocated to the north side of the farm. One year ago an RE and SE was recorded to allow a lot for the two additional homes. At that time a condition on the RE plat was that a USR was needed for the house on beams because it would become the second house on one of the lots. The two existing homes and the third Additional home are not intended nor are now used for farm help but are used as rentals. There are three actions the Board can take: 1. Require a Recorded Exemption - $1000 2. Require a USR for a second home - $1200 3. Require the home on beams to be removed Recommendation: Unless Mr. Howard needs a separate lot the USR is the better choice. An RE cannot be supported by Planning as the time limit of five years has not expired. If the Board elects, an early release could be given for a building permit but it would be at Mr. Howard's risk and no CO should be allowed until the plat has been recorded for whichever process he chooses. r • b � 1 MEMORANDUM TO: Weld County Board of Commissioners COLORADO DATE: June 26, 2009 FROM: Tom Honn, Planning Director SUBJECT: Cecil Howard—Building Permit Mr. Howard received a Recorded Exemption (RE-4717)and a Subdivision Exemption (SE-1121) to create two lots for two houses on his property west of Kersey. At some point in the past, US Hwy 34 required additional ROW and two of four houses were moved from the ROW. One was relocated on the farm and one was moved off site. There is one home on each of the lots on the properly. The proposed home Mr. Howard is wanting to place on the property is a move in from off site, not an original house from the US 34 relocation as I had thought it might be. During the Recorded Exemption process a condition of approval did state that if a second house was to be placed on the property a Use by Special Review would be needed. This has been explained to his consultants and most recently during a meeting between Mr. Howard, Kim Ogle and me. There are two primary options that can be pursued: 1. A USR to permit two homes on one legal lot. The fee for this process is $1200. It will typically take 90 to 180 days for completion of a USR. 2. A Recorded Exemption may be requested to divide a property for two dwelling units. The SE lot is 3.1 acres and could be divided as the property is served with domestic water, not a well. A Recorded Exemption Fee is$1000 and the process takes approximately 60 to 90 days. Because the previous exemption is only one year old, the staff can not approve an exemption and Board approval would be required. In either case, the Board could authorize early release of a building permit with a limit that no Certificate of Occupancy is issued without recording of the plat of whichever process is used. I am waiting for a response from CDOT regarding the existing access to insure there is not a glaring issue with access which would be my primary concern for issues for Mr. Howard proceeding. Staff conducted extensive property research into the existing conditions of the property and determined the following: There art existing residential structures on the property, one of which is located on a Subdivision Exemption that was approved in 1996 for the purpose of Financing, only. Planning staff does not consider this a separate legal parcel. There are two farm labor houses constructed prior to 1940, with the third structure permitted as an accessory dwelling, ZPAD. Staff is of the understanding that all structures located on site are served by Central Weld County Water District and have I.S.D.S. sanitary systems. Per your previous statements, all structures are habitable and are not currently vacant. Your client requested confirmation of whether an additional habitable residential structure may be moved to the property given the scenario outlined above. Staff determined that Mr. Howard is eligible to apply for three separate land use applications, thus enabling him to gain one additional dwelling. To facilitate this proposal, staff suggests that a Recorded Exemption in conjunction with a Subdivision Exemption to divide off a second set of improvements be the first application. These two applications will address the placement of the principle dwelling (on SE for Financing Lot) and the ZPAD on the same parcel. This is a requirement of the ZPAD-60 approval and will be identified as Lot B of the RE. The smaller Lot A associated with the first RE will divide off one of the two Farm Labor houses. This parcel is required by Code to support the water and sanitary taps for each residence. The SE to divide off a second set of improvements addresses the second Farm Labor house. Minimum lot size with Central Weld County Water District potable water and an I.S.D.S. sanitary system is one acre net. Should the water be obtained from an on-site well, the minimum lot size is 2.5 acres net. Lot A of the Recorded Exemption is also required to meet this water and sanitary criteria; however, this parcel also is required to be of a size that will allow for an additional residence. The second residence on Lot A will also accommodate a second dwelling under current Code. This action is accomplished through a Site Specific Development Permit and Use by Special Review application. In the Agricultural Zone District, a second residence is permitted on a parcel via approval of this land use permit by the Board of County Commissioners. • • In addition to gaining support and approval for each of the referenced land use applications, staff and referral agencies will demand compliance with current Federal, State, and County rules and regulations. For instance, each parcel will have its own source of water. Water taps may not be shared. This also holds true for sanitary sewer systems. One house one system, and located within the property boundary of each parcel. As each application opens the land and the encumbrances upon the land to scrutiny by referral agencies, there may be large issues to overcome and are not likely to be resolved here. Please note, the Colorado Department of Transportation may determine that a change of use will occur for the two existing access points to this parcel. Domestic use: The existing residents(SE 595) located on the northern part of the parcel haws an existing well and the well permit number is 250105. This well permit is limited to fire protection, ordinary household use, can be used for three (3) single family dwellings, the watering of domestic animals and the irrigation of not more than one(1) acre of home gardens and lawns. See Well Permit Number 250105. At present, the two(2) existing dwellings located in the Southwest corner of the farm are supplied water by the Central Weld County Water District (CWCWD). These dwellings are on the same water meter, tap number 250, see attached letter from CWCWD. Additional water service is available for the proposed RE. b. Irrigation water that is available to the farm is in the form of two (2) shares of Lower Latham Ditch, two (2) shares of Lower Latham Reservoir and an irrigation well located in the Southwest corner of the farm. See Well Permit Number 11611 for additional information. 2. Means of Sewage disposal a. The principal residence located on SE 595, (27249 WCR 49 '/, Greeley, CO), is on a private septic system, Septic Permit # G-920092, see attached Septic Permit. b. The existing residence (labor home) located 200 feet north of HWY 34, (24095 E Hwy 34, Greeley, CO), is on a private septic system, Septic Permit # SP-0000006, see attached Septic Permit. c. The existing residence(labor home) located north of HWY 34, (24081 E Hwy 34, Greeley, CO), is on a private septic system. This system was installed in the early 1970's. A work order for pumping of the tank states that the tank size(amount pumped) is 1000 gallons. With information that is available form the owner, the septic field consists of three(3)trenches, length to be verified. 3. The existing property zoning is Ag. and is farmed with row crops. At present there are three (3)homes located on the parcel. The principal residence is located on SE 595, (27249 WCR 49 ''A, Greeley, CO) and is located in the northern half of the parcel, see attached Weld County GIS map. Two(2) labor homes exist on the property, 24095 E Hwy 34, Greeley, CO and 24081 E Hwy 34, Greeley, CO. A third labor home is proposed. The two (2) existing labor homes and the proposed labor home are/will be located in the Southwest corner of the parcel. To bring the parcel into compliance with the Weld County Code, a three(3) step process will be required. Step one will be a 2 Lot RE, this will create a lot for the house located at 24081 E Hwy 34, Greeley, CO. Step two will be an SE for the house located at 24095 E Hwy 34, Greeley, CO. Step three will be a USR for the proposed house. An existing pole barn exists on the parcel and is located in the Southwest corner of the parcel. The corrals that are present with the pole barn will accommodate about five head of livestock. Our comments and requirements are as follows: COMMENTS: Weld County Road 49 and 47 Arterial Corridor Study: (October 2004) WCR 49 is classified by the County is a major arterial and required 140-foot of right-of-way. There is presently no right-of-way reserve. The applicant shall reserve 70' of ROW from their property line along its entire length adjacent to the proposed alignment of WCR 49 to be constructed in the future. Pursuant to the definition of SETBACK in the Weld County Zoning (23-1-90), the required setback is measured from the future right-of-way line. REQUIREMENTS: The Weld County Public Works Department recommends approval of this application. The Colorado Department of Transportation (CDOT) has jurisdiction over all accesses to the state highways. Since access for these proposed parcels will be off State Highway 34, please contact Gloria Hice-Idler at the Greeley office (970-350-2418) to verify the access permit or for any additional requirements that may be needed to obtain or upgrade the permit. The Runway Zoning Overlay District will probably not be affected, because this area concerns the height of structures. Any future structure proposed on this property could be subject to an FAA Aeronautical Study under Part 77 of the Code of Federal Regulations. During Visual Meteorological Conditions, the proximity to the Initial Approach Fix is not a concern, but during Instrument Meteorological Conditions, this area could receive more frequent over flights. This policy addresses new developments and recorded exemptions that would affect the district. The policy is specifically intended for land use that will create a new residence. A cash-in-lieu payment is required for each new residential lot. It is the interpretation of the district that one new residence will be established with this recorded exemption. This policy is an effort to assist the district in mitigating the increasing capital cost of growth. Please forward this information to potential land developers and individuals requesting recorded exemptions so that they may make arrangements with the school district to satisfy the requirements of the policy. The district also requests that the land developer contact the school in regard to transportation. As the intended use is for residential development, consideration for a school bus stop needs to be examined. The district will not establish an additional stop on Highway 34, but would consider accommodating new students at the existing stop.
