RE: AUTHORIZATION FOR THE WELD COUNTY ATTORNEY TO PROCEED WITH LEGAL
ACTION AGAINST BECKLES, LLC AND PETE LISCANO FOR VIOLATION OF THE
WELD COUNTY CODE
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, Beckles, LLC and Pete Liscano, ZCV#0701075, are allegedly in violation of
the Weld County Code, and
WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has
not been corrected, and
WHEREAS, on the 11th day of September, 2007, a public hearing was held before the
Board of County Commissioners for the purpose of hearing testimony relating to said violation,and
WHEREAS, Pete Liscano, tenant, was present at said hearing, and
WHEREAS, the Board deems it advisable to bring legal action against those individuals
named above to correct said violation.
WHEREAS,the Board of County Commissioners deems it advisable to refer said violation
to the Weld County Attorney's Office for legal action, with an instruction for delay of action upon
such referral until October 11, 2007, to allow adequate time for the tenant to remove the remaining
vehicles and to submit the proper permits and applications needed to remodel the mobile home to
bring the subject property into compliance and for an inspection of the property by the Department
of Planning Services staff.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that ZCV#0701075 be, and hereby is, referred to the Weld County Attorney's
Office for legal action against Beckles, LLC and Pete Liscano to remedy the violation of the Weld
County Code, and any other persons occupying the properties, any persons claiming an interest
in the properties, and any persons acting in active concert with the identified parties, with an
instruction for delay of action upon such referral until October 11, 2007, to allow adequate time for
the tenant to remove the remaining vehicles and to submit the proper permits and applications
needed to remodel the mobile home to bring the subject property into compliance.

DERELICT VEHICLE: A vehicle that is inoperable (unable to move under its own power); is
partially or totally dismantled; has all or portions of its body work missing or is substantially
damaged; does not have valid registration with the State, as required by Section 42-3-103,
42-3-138 or 42-12-102, C.R.S., and/or the number plate assigned to it is not permanently
attached to the vehicle, as required by Section 42-3-123, C.R.S.; or is lacking proper
equipment to the extent that it would be unsafe or illegal to USE on public road rights-of-way
or otherwise not equipped with lamps and other equipment, as required in Sections d'-^-)nt

VEHICLES; used tires and other manufactured goods that are so worn, deteriorated or
obsolete as to make them unusable in their existing condition.
NONCOMMERCIAL JUNKYARD: An area where any waste,junk or used or secondhand
materials are stored or handled, including but not limited to scrap iron and other metals,
paper, rags, rubber tires, building materials and bottles. A NONCOMMERCIAL JUNKYARD
may also include the storage or keeping of DERELICT VEHICLES registered last or
currently registered under the property owner and/or tenant's name.
This definition does not include COMMERCIAL VEHICLES. If the Zone district allows, the
NONCOMMERCIAL JUNKYARD shall be totally ENCLOSED within a BUILDING or
STRUCTURE or visually SCREENED from all ADJACENT properties and public
rights-of-way.
SCREENED: Construction and maintenance of fences, earth berms or the USE of
LANDSCAPING materials or other materials USED with the approval of the Department of
Planning Services to lessen the noise, light, heat or visual impacts of a USE on surrounding

REMEDY

You are correct that there was a prior zoning violation on this property and yes, the violation was remedied by
constructing a fence completely around the derelict vehicles. However it appears that much of the fence has
become dilapidated, a derelict mobile home appears to have been put on there as well. At least three derelict
vehicles have are not in the "fenced" area and it appears there is a school bus, dump truck (?) and a semi
trailer. The code would allow for one "commercial vehicle" (regardless whether it's screened or not) and I would
need to check in the code as to whether or not a school bus falls in this category of commercial vehicle.
All derelict vehicles shall be completely screened from ALL adjacent properties and public rights-of-way and the
derelict mobile home shall either be restored to it's original condition and building permits obtained for it or it
shall be removed.
I have included three pictures for you that were taken this afternoon.
A violation letter has already been sent and at this point allows for 30 days to bring the property into
compliance. The letter also includes in it the sections of the code that are currently in violation, along with
definitions of things such as "derelict vehicles""commercial vehicles""screening"etc.
Hopefully this has answered some of the questions you have and please contact me if I can assist you any

Ann,
I work for Beckles LLC. We received a letter from you regarding a noncommercial junkyard with commercial
vehicles and derelict vehicles. I think your reference number is ZCV07-01075.
We had a problem with our tenants previously regarding this and they corrected the problem. Before I call
them, I would like to more specifics. I believe to fix the problem previously, they built a fence to screen
everything. Is the fence gone or do they have more and so the fence doesn't screen it all?

42-3-138 or 42-12-102, C.R.S., and/or the number plate assigned to it is not permanently
attached to the vehiN^ as required by Section 42-3-123, C.R.S.; c• is lacking proper
equipment to the ex, .that it would be unsafe or illegal to USE c ublic road rights-of-way
or otherwise not equipped with lamps and other equipment, as required in Sections 42-4-202
to 42-2-227, C.R.S. This definition shall not include implements of husbandry, farm tractors or
vehicles customarily operated in a FARMING operation.
JUNK: Scrap brass, iron, lead, tin, zinc; all other scrap metals and alloys; bones; rags; used
cloth, rope, rubber, tinfoil, bottles, old or used machinery of any type; used tools; used
appliances; used lumber or crates; building materials; fabrication of any material; used pipe or
pipe fittings; used conduit or conduit fittings; used automobile parts; DERELICT VEHICLES;
used tires and other manufactured goods that are so worn, deteriorated or obsolete as to
make them unusable in their existing condition.
NONCOMMERCIAL JUNKYARD: An area where any waste, junk or used or secondhand
materials are stored or handled, including but not limited to scrap iron and other metals, paper,
rags, rubber tires, building materials and bottles. A NONCOMMERCIAL JUNKYARD may also
include the storage or keeping of DERELICT VEHICLES registered last or currently registered
under the property owner and/or tenant's name.
This definition does not include COMMERCIAL VEHICLES. If the Zone district allows, the
NONCOMMERCIAL JUNKYARD shall be totally ENCLOSED within a BUILDING or
STRUCTURE or visually SCREENED from all ADJACENT properties and public rights-of-way.
SCREENED: Construction and maintenance of fences, earth berms or the USE of
LANDSCAPING materials or other materials USED with the approval of the Department of
Planning Services to lessen the noise, light, heat or visual impacts of a USE on surrounding

To bring your property into compliance with the Weld County Code:
THE NONCOMMERCIAL JUNKYARD CONSISTING OF DERELICT VEHICLES AND
POSSIBLY OTHER MISCELLANEOUS DEBRIS SHALL BE REMOVED, RESTORED OR

ADDITIONALLY, THE NUMBER OF COMMERCIAL VEHICLES ON THE PROPERTY
SHALL BE REDUCED TO ONE AND THAT ONE SHALL REMAIN IN RUNNING
CONDITION WITH CURRENT REGISTRATION IF NOT BEING SCREENED.
A USE BY SPECIAL REVIEW (USR)PERMIT SHALL BE OBTAINED IF YOU SHOULD
CHOOSE TO HAVE MORE THAN ONE COMMERCIAL VEHICLE ON THE PROPERTY.
It is the intention of this office to assist and cooperate with you without imposing undue hardhsips;
