RE: APPROVAL OF AMENDED RECORDED EXEMPTION NO. 370 - MARVIN
AND MILDRED BAY
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, it was determined by the Board of County Com-
missioners of Weld County, Colorado, at a public meeting held
on the 29th day of January, 1979 in the Chambers of the Board
of County Commissioners of Weld County, Colorado, that a certain
parcel of land, being the property of Marvin and Mildred Bay,
did not come within the purview of the definition of the terms,
"subdivision" and "subdivided land" , pursuant to its authority
under Section 30-28-101 (10) (d) , CRS 1973 , as amended, and
WHEREAS, said Board of County Commissioners did approve
Recorded Exemption No. 370 by Resolution, attached hereto and
incorporated herein by reference, and
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, has now been informed by the Weld County Department of
Planning Services that the aforementioned Recorded Exemption
needs to be amended to exclude a parcel of land in order to
allow for Subdivision Exemption No. 169 , said parcel being
more particularly described as follows :
A tract of land located in the East Half of Section 1
Township 6 North, Range 65 West of the 6th Principal
Meridian, Weld County, Colorado and being more parti-
cularly described as follows:
Beginning at the Southeast Corner of said Section 1,
and considering the East line of said Section 1 to
bear North 00°02 ' 03" West and with all other bearings
contained herein being relative thereto:
Thence North 00°02 ' 03" West along the East line of
said Section 1, 40. 01 feet to the True Point of
Beginning: Thence North 88°50 ' 46" West, parallel
with the South line of said Section 1, 1411. 74 feet;
Thence along the outer boundary of a tract of land,
being Recorded Exemption No. 0803-1-4-RE 138 and
filed under Reception No. 1689160 Weld County Records,
by the following four courses :
North 30°19 ' 54" West, 463. 01 feet;
North 17°02 ' 16" West, 445. 13 feet;
North 02°10 ' 53" East, 765. 31 feet;
Thence North 55°19 ' 43" West, 408. 06 feet;

on the East-West centerline of said Section 1;

bank of an irrigation ditch by the following three
(3) courses :
North 28°17 ' 00" West, 175..5 feet;
North 22°10 ' 20" West, 130. 90 feet;
North 01°46 ' 30" East, 510. 85 feet;
Thence South 80°09 ' 50" East along an existing fence
and its easterly extension, 1708 . 83 feet to a point
on the East line of said Section 1, from which point
Northeast corner of said Section 1 bears North 00°02 ' 03"
West, 2094. 23 feet; thence South 00°02 ' 03" East along
the East line of said Section 1, 544. 14 feet to the
East Quarter corner of said Section 1; thence
continuing South 00°02 ' 03" East, along said East line,
2598. 36 feet to the True Point of Beginning. Said
tract of land contains 138 . 141 acres more or less and
is subject to any rights-of-way or other easements as
granted or reserved by instruments of record or as now
existing on said tract of land.

A tract of land being part of Lot B of Recorded
Exemption No. 0803-1-4-RE 370, located in the
east half of Section 1, Township 6 North, Range 65
West of the 6th P.M. , Weld County, Colorado, recorded
February 1, 1979 in Book 859 , Reception No. 1780520 ,
Weld County Records, and being more particularly
described as follows :
Commencing at the Southeast corner of said Section 1
and considering the East line of said Section 1 to
bear North 00°02 ' 03" West with all other bearings
contained herein being relative thereto; Thence
North 00°02 ' 03" West, 1917 . 89 feet along said East
line to the True Point of Beginning:
Thence South 89°57' 57" West 30 . 00 feet to a point
on the West right-of-way line of Weld County Road
No. 49;
Thence along the arc of a curve to the left whose
radius is 1715. 00 feet, central angle is 31°25 ' 25"
and chord bears North 21°27 ' 58" West, 928 . 84 feet,
(the radius point of said curve is the center pivot
of an existing sprinkler) ;
Thence North 89°57 ' 57" East, 369 . 39 feet along the
South line of Lot A of said Recorded Exemption to
a point on the East line of said Section 1; Thence
South 00°02 ' 03" East, 864. 62 feet along said East
line to the True Point of Beginning.
Said tract of land contains 3 . 049acres more or less
including 0. 595 acres in County Road right-of-way
and is subject to any rights-of-way or other easements
as granted or reserved by instruments of record or
as now existing on said tract of land.
WHEREAS , after considering the facts presented to the Board
of County Commissioners, said Board has agreed that Recorded
Exemption No. 370 be amended to reflect the acreage excluded by
Subdivision Exemption No. 169 , and
WHEREAS, the Board of County Commissioners of Weld County,

Colorado, deems it would be in the best interests of Weld
County to approve amended Recorded Exemption No. 370 .
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of Weld County, Colorado, that the amendment
to Recorded Exemption No. 370 to exclude a parcel of land
created by Subdivision Exemption No. 169 be, and hereby is,
approved.
The above and foregoing Resolution was, on motion duly
made and seconded, adopted by the following vote on the 6th
day of October, A.D. , 1982 .

The Department of Planning Services staff recommends approval of amended
Recorded Exemption #370 on a parcel of land described as part of the
E', Section 1, T6N, R65W of the 6th P.M. , Weld County, Colorado.
On September 29, 1982, Subdivision Exemption case number 169 was approved
by the Board of County Commissioners amending Lot "A".
