On March 6, 2007 the Environmental Agriculture Program of the Colorado Department of , public Health and Environment sent to Faulkner Dairy II, LLC a Compliance Advisory citing free observed violations of the the ground water protection provisions in Section 81 .5 of die Animal Feeding Operations Control Regulation (Regulation No. 81) . The Advisory required the dairy to submit certain information by April 13, 2007 . In response, the dairy submitted the following information by letter dated April 13, 2007 : 1 . Evidence that 10 impoundments meet the required seepage rate standard as of February 7, 2007 (4 impoundments) and by April 13, 2007 (6 impoundments) . (Such evidence was due on site by April 13, 2006. ) 2 . Certifications that, since March 8, 2005, manure was removed from the solids settling basin in accordance with its approved Standard Operating Procedure. In addition, the Program received from AGPRO on April 25, 2007 a letter (see attached) via email stating that the dairy will in the future: 1) conduct weekly inspections of liners and maintain records of the inspections 2) Maintain certifications that impoundments were cleaned in accordance with its approved Standard Operating Procedure. Lastly, the Program is in the process of deciding what, if any, formal enforcement action (for example, a Notice of Violation) will be taken to address the violations cited in the Advisory. The compliance advisory was a result of a September 6,2006,inspection. In that letter,AGPROfessionals provided the information requested and attached pond cleaning/manure removal certifications and liner certification documentation. Faulkner Dairy has,for a number of years,kept records of all precipitation received at the dairy,manure taken by a 3rd party,wastewater and manure applied to land application fields,monthly pond inspections,results of yearly soils, manure,and wastewater testing,and the basis for making recommendations for applying manure and wastewater at agronomic rates. Faulkner Dairy will continue to keep these records. They will now also document pond cleaning activities and certify their procedures per Colorado Regulation No. 81.5(3)(c),and will conduct and document weekly inspections of earthen liners per 81.5(2). These records will be kept on site in the facility's environmental maintenance notebook for 5 years.
