RE: ACTION OF THE BOARD OF COMMISSIONERS REGARDING VIOLATION VI#0600074
AGAINST JOE ABEYTA (HEIRS OF), C/O ADOLFO AND BEATRICE AMAYA FOR
VIOLATION OF THE WELD COUNTY CODE
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, Joe Abeyta (Heirs of), do Adolfo and Beatrice Amaya, VI #0600074, are
allegedly in violation of the Weld County Code, and
WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has
not been corrected, and
WHEREAS, on the 13th day of February, 2007, a public hearing was held before the Board
of County Commissioners for the purpose of hearing testimony relating to said violation, and
WHEREAS, Joe Abeyta (Heirs of), c/o Adolfo and Beatrice Amaya were not present or
represented at said hearing, although all parties were notified of said hearing by Department of
Planning Services staff, and
WHEREAS, the Board deems it advisable to bring legal action against those individuals
named above to correct said violation.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the Weld County Attorney be, and hereby is, authorized to proceed with
legal action against Joe Abeyta (Heirs of), c/o Adolfo and Beatrice Amaya to remedy the violation
of the Weld County Code, and any other persons occupying the properties, any persons claiming
an interest in the properties, and any persons acting in active concert with the identified parties.

Currently the property is in violation of Chapter 23, Article 111(3), Division 2 of Sections 23-3-110,
23-3-110.C, 23-3-110.C.4, 23-3-130, 23-3-130.B, 23-3-130.C and 23-3-130.C.1 of the Weld County Code.
REMEDY
To bring the property into compliance the following shall occur:
D. All Commercial Vehicles shall be removed or a Zoning Permit for a Commercial Vehicle
application may be submitted for 1 (one)Commercial Vehicle. The others shall be removed.
► The Noncommercial Junkyard shall be removed from the property. Since the property is
zoned R-3 (Residential) a Noncommercial Junkyard is not an allowed use.
RECOMMENDATION
The Department of Planning Services recommends that this case be referred to the County Attorney's
Office for immediate legal action.

November 29, 2006 Beatrice and Adolfo met with Roger Caruso (Planner) and Jacqueline Hatch
(Planner)to discuss options for compliance.
January 5, 2007 Letter sent to property owner indicating that the violation case was scheduled

To bring the property into compliance:
► The NONCOMMERCIAL JUNKYARD consisting of DERELICT VEHICLES, tires,
metal/iron,wood,automobile parts and miscellaneous debris shall be restored or removed
from the property. SCREENING is not an option in the R-3 (Residential) Zone District,
such as your property is zoned in the Evans Addition.
► Since March the Weld County Code has changed in regards to how it pertains to
commercial vehicle applications. You are allowed to apply for a Zoning Permit for 1 (one)
COMMERCIAL VEHICLE (ZPCV). For your convenience, I have included the ZPCV
application with this letter. For questions, I suggest you speak to one of our "On-Call"
Planners. To better serve the public, we have 2 locations open. Our North office is

located at 918 10th Street, Greeley, Colorado. At our North office, an "On-Call"Pla nner is
available, Monday thru Thursday from 7:30 a.m. - 11:30 a.m. Our Southwest office is
located at 4209 CR 24.5, Longmont, Colorado. At our Southwest office, an "On-Call"
Planner is available Monday thru Thursday from 12:30 p.m.-4:30 p.m. You do not need
to schedule an appointment, because individuals are seen on a sign in basis. Neither
office will have a planner available on Fridays for walk-ins. To better serve you, please
bring this letter with you.
► The remaining semi trucks and trailers shall be removed from your property,the road right-
of-way and the adjacent property. If they are not removed within this time frame, I will be
forced to start a separate violation on the adjacent property owner.
NONCOMMERCIAL JUNKYARD: An area where any waste, junk or used or secondhand
materials are stored or handled, including but not limited to scrap iron and other metals, paper,
rags, rubber tires, building materials and bottles.A NONCOMMERCIAL JUNKYARD may also
include the storage or keeping of DERELICT VEHICLES registered last or currently registered
under the property owner and/or tenant's name.
This definition does not include COMMERCIAL VEHICLES. If the Zone district allows, the
NONCOMMERCIAL JUNKYARD shall be totally ENCLOSED within a BUILDING or
STRUCTURE or visually SCREENED from all ADJACENT properties and public rights-of-way.
JUNK: Scrap brass, iron, lead, tin, zinc; all other scrap metals and alloys; bones; rags; used
cloth, rope, rubber, tinfoil, bottles, old or used machinery of any type; used tools; used
appliances; used lumber or crates; building materials; fabrication of any material; used pipe or
pipe fittings; used conduit or conduit fittings; used automobile parts;DERELICT VEHICLES;used
tires and other manufactured goods that are so worn,deteriorated or obsolete as to make them
unusable in their existing condition.
DERELICT VEHICLE: A vehicle that is inoperable (unable to move under its own power); is
partially or totally dismantled; has all or portions of its body work missing or is substantially
damaged; is not registered with the State,as required by Section 42-3-103, C.R.S.,or by Section
42-3-138 or 42-12-102, C.R.S., and/or the number plate assigned to it is not permanently
attached to the vehicle, as required by Section 42-3-123, C.R.S.;or is lacking proper equ ipment
to the extent that it would be unsafe or illegal to USE on public road rights-of-way or otherwise
not equipped with lamps and other equipment as required in Sections 42-4-202 to 42-2-227,
C.R.S. This definition shall not include implements of husbandry, farm tractors or vehicles
customarily operated in a FARMING operation.
SCREENED: Construction and maintenance of fences, earth berms or the USE of
LANDSCAPING materials or other materials USED with the approval of the Department of
Planning Services to lessen the noise, light, heat or visual impacts of a USE on surrounding
uses. A SCREENING PLAN shall be submitted and approved by the Department of Planning
Services.
COMMERCIAL VEHICLE: Any vehicle, other than an automobile, used or previously used to
facilitate an activity where goods, products or services are bought, sold or transferred in
ownership on a fee, contract or barter basis, excluding those uses listed by right and accessory
uses in the A (Agricultural) Zone District. A COMMERCIAL VEHICLE shall include, but is not
limited to,semi-trailers,dump trucks,construction equipment,railroad cars and cargo containers.
A COMMERCIAL VEHICLE shall not be allowed to deteriorate to the condition of a DERELICT
VEHICLE.

This hearing will take place in our Hearing Room, located at 918 10th Street, Greeley, Colorado. It is
recommended that you or a representative be in attendance to answer any questions the Board of
County Commissioners might have about the violations.
Please also be advised that I will be taking video and/or pictures from the road or adjacent properties
the business day before or as soon as possible to the above mentioned Violation Hearing date.
The Department of Planning Services' staff will be recommending that the Board of County
Commissioners authorize the County Attorney to proceed with legal action to remedy the violation. Our
records indicate that you were made aware of the nature of the violation including the action necessary
to correct the violation,and that you were given sufficient time to remedy this violation. If you have any

Roger and I met with Beatrice and Adolpho to discuss their options today (11/29/06)
There options are as follows;
1. remove the business from the site
2. purchase the neighbors property— apply for a home business —trucks will need to be in
a structure — no employees
3. look for a new piece of property to run the business off of— USR —went over what type
to look for but to contact us prior to make sure it will work
4. look into a site that allow you to rent spaces to store the trucks
Beatrice said that she has a realtor 'Steve' that has been looking for properties for the past
year. She will contact him again and try going that route. I gave her my card and let her know
that she or Steve could contact me with any property they are interested in and I would let
them know the appropriate process to take.
She said that she did have employees in the past.
I remaindered her about the January hearing date and she said she would most likely have to
reschedule because she may be having surgery on her hip or foot. I told her to touch base
with Bethany regarding that. I also let her know that at some point she may be given a
deadline to remove the business and she should look into immediate options (renting space).
She also was very pleasant and Adolpho didn't say anything.

NONCOMMERCIAL JUNKYARD: An area where any waste,junk or used or second hand
materials are stored or handled, including but not limited to scrap iron and other metals,
paper, rags, rubber tires, building materials and bottles.A NONCOMMERCIAL JUNKYARD
may also include the storage or keeping of DERELICT VEHICLES registered last or currently
registered under the property owner and/or tenant's name.
This definition does not include COMMERCIAL VEHICLES. If the Zone district allows, the
NONCOMMERCIAL JUNKYARD shall be totally ENCLOSED within a BUILDING or
STRUCTURE or visually SCREENED from all ADJACENT properties and public rights-of-
way.
JUNK: Scrap brass, iron, lead, tin,zinc;all other scrap metals and alloys; bones; rags; used
cloth, rope, rubber, tinfoil, bottles, old or used machinery of any type; used tools; used
appliances; used lumber or crates; building materials;fabrication of any material; used pipe
or pipe fittings; used conduit or conduit fittings; used automobile parts; DERELICT
VEHICLES; used tires and other manufactured goods that are so worn, deteriorated or
obsolete as to make them unusable in their existing condition.
DERELICT VEHICLE: A vehicle that is inoperable(unable to move under its own power); is
partially or totally dismantled; has all or portions of its body work missing or is substantially
damaged; is not registered with the State, as required by Section 42-3-103, C.R.S., or by
Section 42-3-138 or 42-12-102, C.R.S., and/or the number plate assigned to it is not
permanently attached to the vehicle, as required by Section 42-3-123, G.R.S.; or is lacking
proper equipment to the extent that it would be unsafe or illegal to USE on public road rights-
of-way or otherwise not equipped with lamps and other equipment as required in Sections 42-
4-202 to 42-2-227, C.R.S. This definition shall not include implements of husbandry, farm
tractors or vehicles customarily operated in a FARMING operation.
SCREENED: Construction and maintenance of fences, earth berms or the USE of
LANDSCAPING materials or other materials USED with the approval of the Department of
Planning Services to lessen the noise, light, heat or visual impacts of a USE on surrounding
uses.A SCREENING PLAN shall be submitted and approved by the Department of Planning
Services.
COMMERCIAL VEHICLE:Any vehicle,other than an automobile, used or previously used to
facilitate an activity where goods, products or services are bought, sold or transferred in
ownership on a fee, contract or barter basis, excluding those uses listed by right and
accessory uses in the A(Agricultural)Zone District.A COMMERCIAL VEHICLE shall include,
but is not limited to, semi-trailers, dump trucks, construction equipment, railroad cars and
cargo containers. A COMMERCIAL VEHICLE shall not be allowed to deteriorate to the
condition of a DERELICT VEHICLE.

CERTIFICATE OF COMPLIANCE FOR A HOME OCCUPATION
Prior to submitting a Certificate of Compliance for a Home Occupation, please take a moment to consider
whether the business that you are proposing to operate from your property can be best described with the
definitions from Chapter 23, Section 23-1-90 of the Weld County Code as a "Home Business" or a "Home
Occupation". The definition of a Home Occupation is shown on page 3 of this document.A Home Business
may require a Use by Special Review(USR) permit and is defined as follows:
HOME BUSINESS: An incidental USE to the principal permitted USE for gainful employment of the FAMILY
residing on the property, where:
a. Such USE is conducted primarily within a DWELLING UNIT or ACCESSORY STRUCTURE and
principally carried on by the FAMILY resident therein.
b. Such USE is clearly incidental and secondary to the principal permitted USE and shall not change the
character thereof.
Ordinarily, a HOME BUSINESS shall not be interpreted to include the following: clinic, HOSPITAL, nursing
home, animal hospital, HOTEUMOTEL, RESTAURANT,mortuary and organized classes where more than six
(6)persons meet together for instruction on a regular basis(does not include classes sponsored by a PUBLIC
SCHOOL).
If you are uncertain if your business can be considered a Home Occupation, please submit a letter outlining
the following information. Planning Services will review your letter determine if your proposal will require a Use

The hours of operation.
Situs address.
The exact location of the business(for instance, is it located within a room in the home or is it
located in the garage or an outbuilding?).

conducted?
Is there outside storage of materials or equipment?
How many customers are expected to visit the site per day or per week?
What kind of advertising for the business is there at the site, including signs, the name or
logo on trucks or company cars, etc.?

How will the company vehicle(s)be reasonably concealed and appropriately screened from
all adjacent properties and public rights-of-way?
Is there any offensive noise, vibration, smoke, dust, odors, heat, glare or electrical

the Lot (if the business is conducted within a garage or outbuilding)?

A statement describing the general nature of the Home Occupation.

The following conditions must be met prior to determining if the use is considered a Home Occupation. I,
the undersigned, understand and agree to the following conditions of this zoning permit:
PLEASE READ AND INITIAL EACH ITEM:
I hereby certify, under penalty of perjury and after carefully reading the entire contents of this document, that the below stated
information is true and correct to the best of my understanding and belief.
HOME OCCUPATION: An incidental use of a DWELLING UNIT for gainful employment of the resident therein, where:
1. Such USE is conducted entirely within a PRINCIPAL DWELLING UNIT (excluding accessory parking of a single
vehicle) and carried on by the residents thereof and no others.
2. Such USE is clearly incidental and secondary to the USE of the dwelling for dwelling purposes and shall not change
the character thereof.
_3. The total area USED inside the DWELLING UNIT for such purposes does not exceed three hundred(300)square feet.
_4. There is no advertising or other indication of the HOME OCCUPATION on the LOT or any STRUCTURE located on or
ADJACENT to the LOT,with the exception that one(1)nameplate shall be allowed which may display the name of the
occupant and/or the name of the HOME OCCUPATION where such nameplate does not exceed one(1)square foot in
area, shall be non-illuminated and attached flat to the main STRUCTURE or visible through a window.
5. There is no exterior storage, display or sales of materials, goods, supplies or equipment related to the operation of
such HOME OCCUPATION nor of any highly explosive or combustible materials.
_6. There is no offensive noise, vibration, smoke, dust, odors, heat, glare or electrical interference or other hazard or
nuisance noticeable off the LOT.
7. A home occupation not located within an approved or recorded subdivision plat or LOTS part of a map or plan filed
prior to adoption of any regulations controlling subdivisions may include accessory parking of a single vehicle which
must be primarily associated with a permitted home occupation. One car, truck, delivery van, semi tractor and/or
trailer, dump truck or similar type vehicle may be included. This is not intended to include excavation equipment,
cement mixers,heavy equipment or similar types of generally unlicenced vehicles or equipment.When parked on the
site,the vehicle associated with the home occupation must be reasonably concealed and appropriately screened from
all adjacent properties and public rights-of-way.

THIS AGREEMENT, made in duplicate this -W- day of
April , 1989, between Joe G. Abeyta and Pauline Abeyta, hereinafter
referred to as Sellers, and Adolfo Simental and Beatrice Simental ,
hereinafter called the Buyers,
WITNESSETH:
1. Sellers in consideration of the covenants here set
forth, and other good and valuable consideration, do sell to
Buyers the following described property:
Lot 5, Abeyta Replat, Block D, Sta /[�� umenrane Fe4
Evans Addition, Weld County, Colorado, ! Der l..ar.4.O9.2

also known as 200 Abeyta Street. --.
2. Buyers shall pay the sum of $35,000 as follows: $2,000.00
0 herewith receipted for, and the balance in monthly payments of $300.00,
5 including 8% interest, until paid in full , commencing on the 1st day
R? of May, 1989 , and on the 1st day of each month thereafter. Buyers
shall pay a late charge of $30.00 for installments not made within
10 days of the due date. Pre-payment may be made at any time without
penalty.
3. Possession shall be May 1 , 1989. Sellers shall be respon-
sible for all utility and other costs to date of possession, including
property tax. Thereafter, Buyers shall be responsible for utilities
and taxes, and shall pay a tax impound to Sellers monthly in the
amount of $30.00 to be adjusted annually as taxes are paid.
4. Buyers shall execute a promissory note for $33,000.00 and
Sellers shall execute a warranty deed to Buyers, which Note and Deed
shall be placed in Escrow until successful completion of this contract
whereupon said Note shall be cancelled and warranty deed shall be
delivered to Buyers conveying the above real property free and clear
of all encumbrances.
5. Buyers convenant that during the term of this agreement
to maintain homeowner 's insurance and to endorse and include Sellers
as an additional insured. In the event the subject property is damaged
and such damage is not insured, Buyers shall promptly replace and
repair same.

6. If Buyers fail to make payment due or to perform any
convenant hereunder, and such default continues 60 days after written
