with Weld County Environmental Health acknowledged her receipt of this document. This
document was provided to the Weld County Attorney's office on December 21, 2006. A memo
detailing approval of this information dated February 16, 2007 from Gary Mackey is included in
application materials.

The entire Water Service Agreement with North Weld County Water District and the
Preliminary "Subsurface Exploration and Geologic Hazards Report"dated August 24, 2006 was

WELD COUNTY PLANNING
This is a Change of Zone Application submitted to Weld County Planning after our
meeting on Thursday February 8"',2007,held at their office.
The following people were in attendance at this meeting: liana Hippcly, Planning, Jesse
Hein&Brian Venetia, Weld County Public Works, Jerry Robinson, Stewart and
Associates, Gary&Bryon Mackey, the applicants. At this meeting it was determined that
the application was ready to move forward.
The Flood Plain was discussed and all agreed that the flood plain is no longer on the
property. After discussion is was concluded that we could proceed with the change of
zone while Bob Crowing of QED works on the flood plan and the letter to FEMA.
There was a comment to submit another sketch plan, but this was put aside in favor of the
Change of Zone.. There is an application for a Recorded Exemption to change this parcel
to Lots A, B, &C this was submitted to Weld County Planning staff on December 2e,
2006 and according to the planning staff recommendations it will do away with the
internal road system.

PUBLIC WORKS COMMENTS
The flood hazard area is being addressed by Stewart& Associates and Bob()owing of
QED,and will be in contact with Brian Vallella of Weld County Public Works to resolve
these issues of the 100 year flood plain and will be shown on the new plan.
The roadways in the proposed sub-division have been widened to 60 foot right-of-way.
The 60 foot county roadway and the document creating them arc noted on the plat. The
cul-de-sac has been changed to a 65 foot radius, and all other radius within the subdivision
will be 20 foot is also on plan.
A drainage report is included with this submittal. All contours on the property arc shown
on the plan.
One recommendation was to meet with public works,these meeting were very helpful.
Brian Varrella stated in our February 8th meeting that we could move forward to the
Change of Zone and the Final. That no building permits would be issued until all flood
plan issues were resolved.

Dear Hanna,
Gary Mackey provided plans for me to review concerning his PUD as it relates to
a bus stop for the six lots that will be built. The Transportation Director, Lance
Yoxsimer, and I have reviewed the proposed PUD and are advising you that it
meets the standards that we require for a bus stop.
There have been no fees paid to the school district for this recorded exemption
and this letter in no way exempts Mr. Mackey from paying the fees required in
order for the school district requirement to be met for this recorded exemption.
This letter is strictly a statement that the requirements for a bus stop for the six
proposed houses that are to be built in this PUD have been met.

Dear Hannah,
I have received and reviewed the proposal for the PUD Sketch Plan for seven residential lots and one Agricultural
outlot. During the review, Frey Florian- District Wildlife Manager, made a site visit to the parcel. In this letter you
will find the Division of Wildlife comments concerning the proposal.
The site is located east and adjacent to WCR 37, approximately 1/4 mile south of WCR 86. The field appeared to be
an agricultural field irrigated by a Center Pivot Sprinkler system.
The Division of Wildlife recommends that:
U Ground-breaking construction occur between August 15 and April 1 to prevent the destruction of nesting
wildlife.
Q Noxious weed and re-vegetation management plans are developed and implemented in areas where there will
be ground disturbance due to construction activities.
c Any fences built are recommended to be three or four strand fencing with a bottom strand height of 17 inches
and a maximum top strand height of 42 inches, along with installation of double stays between posts.
• Leash covenants are used in the development.
o Future homeowners are made aware of traditional land uses that may impact them.
O Future homeowners arc made aware of nuisance wildlife in the area.
Ground-breaking Construction. Most species of small birds in this area are primarily ground nesting birds,
although some species nest in trees or bushes. Some of these species are permanent residents while others are
migrants or summer (breeding)residents. Many of these small birds are categorized as neo-tropical. Neo-tropical
species are experiencing drastic population declines and the CDOW is concerned about any activities that could
negatively impact them. All of the ground-nesting birds in this area could be subject to habitat loss, displacement and
disturbance from future construction or development. It is possible that human activities around nest sites during.
critical nesting periods can have significant negative impacts. In regards to ground-nesting birds in the area, it is
recommended that any ground breaking construction that takes place on the proposed area occurs before April 1 and
after August 15 to minimize any impacts that human activity may have on these ground nesting birds. USFWS staff
recommends this as well as a way of avoiding violation of the Migratory Bird Treaty Act.

Equipment should be cleaned periodically to remove weed seeds even if no weed:, are recognized. it is recommende
that noxious weeds are actively eradicated. A working weed management and disturbed area reclamation plan shoo:
be developed and implemented throughout construction and until all disturbed areas are properly re-vegetated to
prevent erosion and invasions by weeds. The applicant may want to contact the Weld County Weed Inspector to
facilitate development of reclamation and weed management plans for the development.
Fencing. We are concerned for the safety of the wildlife in the area if fences are erected, as some types of fencing c;
be dangerous and even fatal to wildlife. Therefore, we recommend that if any fencing is to be used within or around
development sites,either during or after the project, it should be the type that would allow the free passage of wildli:
Fencing plans should avoid the use of woven wire type fences that will trap or prevent movement of wildlife. The
Division of Wildlife prefers the use of three or four strand fencing with a bottom strand height of 17 inches and a
maximum top strand height of 42 inches,along with installation of double stays between posts.
Leash Covenants. The residential development should include covenants that prevent domestic dogs and cats from
running at large. Domestic dogs and cats roaming the open space on this development and adjacent property would
have a definite adverse impact on wildlife in the area. CDOW feels strongly that this wildlife corridor encompassing
the adjacent upland should he protected from domestic pets of local residents inclined to walk dogs in this natural
area.
Traditional Land Uses. .As this area develops, it is important to maintain the legacy of traditional agricultural land
uses. Hunting is one such activity that provides recreation and income to landowners and businesses alone the 1-25
corridor. Geese, ducks, pheasants and doves are a few of the wildlife species that are hunted in this area. In fact
surveys indicate that Weld and Larimer Counties are among the most important in Colorado in the popularity of sma
game and waterfowl hunting activities. People travel from all over the United States to hunt waterfowl along the 1-2:
corridor. Hunting is not only a recreational activity and economic asset, but also an important management tool use
---by the Colorado Division of Wildlife to manage wildlife populations. Hunting is used as the primary tool to balance

Living with Wildlife. It is recommended that the developer make future homeowners aware of nuisance animals tha

landowners. i lomeowners should be made aware of the potential problems that coyotes and skunks can cause with
domestic dogs and cats. The new homeowners should be made aware that it is their responsibility to prevent and
handle any:problems that may arise The Division of Wildlife has brochures available for homeowners that talk ahot
living with wildlife and will also he happy to give suggestions on how to prevent any potential problems.

Specific Development Guide
Introduction
The Mackey Circle Planned Unit Development (PUD) proposes six estate single-family residential units
on 3.8963 acre lots. The property is located south of and adjacent to Weld County Road 86 and east of
and adjacent to Weld County Road 37. This Development Guide is submitted with this application
through the Specific Development Guide option. Therefore, we request administrative review of the
Final Plat.
The intent of the entire PUD application process is to Change the Zone of, and Plat, the property for uses
compatible with surrounding land uses, permitting 6 single family Estate lots. Referral Agencies and
Weld County Planning Staff raised several questions at the Sketch Plan phase of this development
review. These questions have been answered with support materials and evidence preceding this
Specific Development Guide.
The development of the site will be compatible with the architectural style of the surrounding land uses
and with the overall character of the area./\This development proposes the ability of each lot to have
Auxiliary Quarters as defined by Weld County Code Section 23-1-90. Proposed land uses within this
property include those allowed by right in both the Estate Zone Districts.
The following Development Guide has been prepared in accordance with Section 27-4-20, Weld County
Code.
Section 27-4-20.E.14. Initial impact plan addressing all impacts this use will have on the proposed
site and surrounding land uses. A listing of potential impacts is cited in Section 27-6-30 of this
Chapter. (SPECIFIC DEVELOPMENT GUIDE)

Development of this proposal should not result in any negative environmental impacts, including the
above listed environmental concerns. The end use of the site will be residential.

All wastewater disposal on the site will be through the use of Individual Septic Disposal Systems.

To the applicant's knowledge, this proposal does not remove wetlands.

Any on-site grading, drilling, ditching or dredging will be done sympathetically. Erosion will be kept to
a minimum. A Drainage Report prepared by Stewart and Associates is included herein.

This proposal will not result in negative impacts to the above listed concerns.

To the applicant's knowledge, there are no radioactive materials located on this site.

The drinking water source is through North Weld County Water District. Support documentation is
included herein.
18. Traffic impacts
The internal roadway in the PUD is designed to meet the requirements of Chapters 24 and 26 of the
Weld County Code. The vehicular circulation system is proposed to be paved. A cross section is
included on the enclosed mapping materials. The primary access to the subdivision is from Weld
County Road 37. No loading zones are proposed as the use will be residential. Additionally, no off-
street parking areas have been depicted as the ample lot size will adequately accommodate residential
parking needs. Each building permit issued on the property shall conform to the Weld County Road
Impact Fee Program. The internal road alignment has been modified based upon comments received
through the Sketch Plan review process.

enforcement, and the Ault Fire Protection District. Various correspondence is included in application

Access to the site has been revised since the Sketch Plan to provide an efficient shared access for the
agricultural uses of Lot B of Recorded Exemption RE-4589 and the proposed six residential lots
represented by this application.

included herein.

agreement was provided to the Weld County Attorney's Office. All wastewater disposal will be handled
through an Individual Sewage Disposal System.

Any landscaping improvements will be focused on the entry treatment and illustrated with the Final Plat

Section 27-6-70 Component Four—site design
1. Unique site features
There are no site features unique to this particular property.
2. PUP rezoning consistent with Chapter 22 of Weld County Code
Section 22-2-190.D.2.a PUD.Policy 4.1 states, "The design of a planned unit development should ensure
compatibility and harmony with existing and planned uses on adjacent properties and within the planned
unit development." The applicant has carefully considered the uses on-site, adjacent properties and the
existing use of the property. The result is consistent with the existing and planned uses on adjacent
properties. The applicant contacted surrounding property owners to discuss this application.
Goal 3 "Discourage urban-scale residential, commercial and industrial development, which is not
located adjacent to existing incorporated municipalities." Chapter 23 of the Weld County Code defines
urban scale development as developments exceeding nine (9) lots and/or located in close proximity to
existing PUDs, subdivisions, municipal boundaries or urban growth corridors and boundaries. This
application is not located adjacent to a municipality or other PUD's, subdivisions, municipal boundaries
or an urban growth corridor or boundary. The site is located approximately 2 miles northeast of Ault
and just northeast of the Town's Intergovernmental Agreement Urban Growth Boundary area. As this
proposal is for nonurban scale development, it is consistent with the Ault IGA.

4. Compatibility with surrounding land uses
The existing design of the subdivision takes into consideration the existing uses of the surrounding
properties and the existing irrigation practices of the area. All recorded plats will include the Weld
County Right to Farm, found in Appendix 22-E of the County Code. The lots will have the opportunity
for Auxiliary Quarters as defined in Section 23-1-90 of the Weld County Code.
The School District has requested a bus stop as illustrated on the enclosed Change of Zone plat.
Evidence of acceptance by the School District is included with application materials.
Animal Units listed in the Weld County Code will serve as a maximum number. Additional animal

restrictions to type and number of animals may be further developed and specified in Covenants to be
submitted with subsequent applications.
5. Overlay districts
Upon review of the geological hazard and airport influence maps, as well as the I-25 Mixed Use
Development Area Map and Chapter 19 of the Weld County Code, this proposal is not located within
these overlay districts. Portions of the property are located within the flood hazard overlay district.
Section 27-6-80 Component Five—common open space usage
The common open space areas within this subdivision are designed and proposed to be consistent with
the requirements of Section 27-6-80 of the Weld County Code.

Future signs require a Building Permit. The Final Plat application will designate a location and design.

The Sheriffs Office recommends the following improvements for this housing sub-division:
1. The Sheriffs Office requests that builders and developers designate an area by the entrance of
the sub-division in which to place a shelter for school children awaiting the school bus. This
area should also include a pull off for the school bus which enables it to safely load and unload
children out of the roadway.
2. Mail distribution within the sub-division should be developed so that residents do not have to
cross a county road or subdivision road to obtain their mail.
3. A permanent sign should be placed at the entrance to the subdivision detailing the name of the
sub-division, address,and a graphical presentation of the roadways within the subdivision.
There should be a plan developed to maintain this sign.
4. If the roadways within this sub-division are not maintained or adopted by the county, individuals
purchasing property in this sub-division should be notified that the Sheriffs Office will have
limited traffic enforcement powers.
5. A plan should be developed to maintain roadways within the sub-division especially during
inclement weather conditions for emergency vehicles.
6. The Sheriffs Office is very supportive of homeowner funded homeowner's associations. These
associations provide a contact for the Sheriffs Office and a means of maintaining common
areas.
7. The names of all streets within the sub-division should be presented to the Sheriffs Office for
approval. This will eliminate duplication of street names within the county.
The Sheriffs Office lacks the ability to absorb any additional service demand without the resources
recommended in the multi-year plan provided to the Weld County Board of County Commissioners or as
indicated by growth not considered at the time the plan was developed. I have no other comments on this
proposal.
