RE: ACTION OF THE BOARD CONCERNING REQUEST TO PREADVERTISE SITE
SPECIFIC DEVELOPMENT PLAN AND SECOND AMENDED USE BY SPECIAL REVIEW
PERMIT#1405 - AURORA DAIRY CORPORATION
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS,the Board has received a request from Aurora Dairy Corporation, 1401 Walnut,
Suite 500, Boulder, Colorado 80302, do AGPROfessionals, LLC, 4350 Highway 66, Longmont,
Colorado 80504, for preadvertisement of an application for a Site Specific Development Plan and
Second Amended Use by Special Review Permit#1405 for a Milk Processing Plan(98,000 square
feet) in the A (Agricultural) Zone District, and
WHEREAS, said property is described as part of the NE1/4 SE1/4, and the E1/2 NE1/4 of
Section 30, Township 3 North, Range 67 West of the 6th P.M., Weld County, Colorado, and
WHEREAS,after study and review the Board deems it advisable to deny said request,since
the Board is not convinced that failure to grant the preadvertisement request will result in financial
hardship for the Aurora Dairy Corporation, nor will granting the request result in a significant time
savings for the applicant.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the request from Aurora Dairy Corporation for preadvertisement of an
application for a Site Specific Development Plan and Second Amended Use by Special Review
Permit#1405 for a Milk Processing Plan (98,000 square feet) in the A (Agricultural) Zone District
be, and hereby is, denied.

COLORADO SUBJECT: Request for Pre-advertisement
Aurora Dairy Corporation has submitted a request that the application for Second Amended Use
by Special Review Permit #1405, which will be heard by the Planning Commission on
December 18, 2007, be pre-advertised. If you wish to approve this request, a hearing before the
Board on January 9, 2008, will allow adequate time for advertising.

SUBJECT: 2n°AMUSR-1405 for a Site Specific Development Plan
and Special Review Permit for a 98,000 square foot
milk processing plant in the A (Agricultural) Zone
District.
The applicants of Aurora Dairy Corporation are requesting a Pre-Advertisement for
2n°AMUSR-1405. The applicants have indicated that the reason for this request is
economic variables and market demand. According to their letter dated October 29,
2007 Aurora Dairy would like to begin construction in early 2008 if the application is
approved.
The Department of Planning Services understands the concerns of the applicants but
has determined this request doe not satisfies the intent of Section 2-3-40.C of the Weld
County Code because it's not an emergency circumstance, or that the delay caused by
no pre-advertisement is likely to create severe economic hardship for the applicant.
Therefore the Department of Planning Services is recommending denial of the Pre-
Advertisement for 2ndAMUSR-1405.

Amendment to the Use by Special Review permit (USR 1405). Due to economic variables
and market demand, Aurora Dairy Corporation would like to begin construction in early
2008 if this amendment is approved. In order to meet these construction and design goals,
it is necessary to expedite the timeline as much as possible.
