Environmental Health Services has reviewed this proposal for one or more microwave,
radio, television or other communication transmission or relay tower over 70 feet in
height per lot including a transmission building. We have no objections to the proposal,
however, we do recommend that the following conditions be part of any approval:
We recommend that the following requirements be incorporated into the permit as
conditions that must be met prior to operation:
• 1. A stormwater discharge permit may be required for a
development/redevelopment/construction site where a contiguous or non-
contiguous land disturbance is greater than or equal to one acre in area. The
applicant shall inquire with the Water Quality Control Division (WQCD) of the
Colorado Department of Public Health and Environment at
www ci',phe_state.co us/wq/PermitsUnit if they are required to obtain a
stormwater discharge permit. Alternately, the applicant can provide evidence
from WQCD that they are not subject to these requirements.
We recommend that the following requirements be incorporated into the permit as
development standards:
1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and
Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for
final disposal in a manner that protects against surface and groundwater
contamination.
2. No permanent disposal of wastes shall be permitted at this site. This is not
meant to include those wastes specifically excluded from the definition of a solid
waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S.,
as amended.

• 3. Waste materials shall be handled, stored, and disposed in a manner that controls
fugitive dust, fugitive particulate emissions, blowing debris, and other potential
nuisance conditions.
4. Fugitive dust and fugitive particulate emissions shall be controlled on this site.
5. This facility shall adhere to the maximum permissible noise levels allowed in the
Commercial Zone as delineated in 25-12-103 C.R.S., as amended.
6. Adequate handwashing and toilet facilities shall be provided for employees and
patrons of the facility.
7. Adequate toilet facilities (port-a-potty) shall be provided during the construction of
the facility.
8. Bottled water shall be utilized for drinking and hand washing during construction
of the project.
9. If applicable, the applicant shall obtain a stormwater discharge permit from the
Colorado Department of Public Health & Environment, Water Quality Control
Division.
10.The operation shall comply with all applicable rules and regulations of the State
• and Federal agencies and the Weld County Code.

The Weld County Public Works Department has reviewed this proposal. This project falls primarily under the
purview of the Use by Special Review Standards, Weld County Code, Chapter 23, Article II, Division 4, Section
23. Our comments and requirements are as follows:
Access: Access is being gain through an existing access from US Highway 85 from the south parcel with a
30-foot access easement.
The Colorado Department of Transportation (CDOT) has jurisdiction over all accesses to the state highways.
Please contact Gloria Hice-Idler at the Greeley office to verify the access permit or for any additional
requirements that may be needed to obtain or upgrade the permit. (US Highway 85)
The easement shall be a graded and drained road to provide an all-weather access.
storm Water Drainage: The applicant is proposing to use erosion control measures at the site including a silt
fence. Details are being identified through notes and a detail sheet.
The historical flow patterns and run-off amounts will be maintained on site in such a manner that it will
reasonably preserve the natural character of the area and prevent property damage of the type generally
attributed to run-off rate and velocity increases, diversions, concentration and/or unplanned ponding of storm
run-off.
The applicant must take into consideration storm water capture/quantity and provide accordingly for best
management practices.

Site Specific Development Plan and Special Review Permit for a Microwave tower located in the A
(Agricultural) District.
USR-1619
There are no historical permits for these parcels.
1. A building permit shall be obtained prior to the construction of any tower.
2. A plan review is required for each building for which a building permit is required. Plans shall
include a floor plan. Plans shall bear the wet stamp of a Colorado registered architect or
• engineer. Two complete sets of plans are required when applying for each permit. Include a
Code Analysis Data sheet provided by the Weld County Building Department with each Building
permits application. Building plans shall also be submitted to Ault Fire Protection District.
3. Buildings shall conform to the requirements of the various codes adopted at the time of
permit application. Currently the following has been adopted by Weld County: 20061nternational
Building Code; 2006 International Mechanical Code; 2006 International Plumbing Code; 2006
International Fuel Gas Code; and the 2005 National Electrical Code and Chapter 29 of the Weld
County Code.
4. The buildings will probably be classified as follows: U Occupancy Plans should include
detailed drawings showing the exiting and how accessibility will be maintained through out the
facility. Fire resistance of walls and openings, construction requirements, maximum building
height and allowable areas will be reviewed at the plan review. Distances between buildings are
not shown on the referral drawings. Setback and offset distances shall be determined by the
Zoning Ordinance.
6. Building height shall be measured in accordance with the 2006 International Building Code for the
purpose of determining the maximum building size and height for various uses and types of
construction and to determine compliance with the Bulk Requirements from Chapter 23 of the Weld
County Code. Building height shall be measured in accordance with Chapter 23 of the Weld County
Code in order to determine compliance with offset and setback requirements. When measuring
buildings to determine offset and setback requirements, buildings are measured to the farthest
projection from the building. Property lines shall be clearly identified and all property pins shall be
• staked prior to the first site inspection. 7. All building plans shall be submitted to the Fire District
having jurisdiction for review and approval prior to issue of Building Permits

Although this these communications towers are not located in the Airport Zoning Overlay

District and are compatible with the Greeley-Weld County Airport Surrounding Land
Use Guidelines,the Greeley-Weld County Airport Authority strongly recommends that
an FAA Aeronautical Study under Part 77 of the Code of Federal Regulations be
conducted prior to approval of this Special Review Permit for any obstacle of this height.

Upon review of my case files and computer,an active Violation(VI-0700104)was noted. This violation was
issued due to an un-permitted mobile home being placed on the property prior to the submittal of a USR for
a radio tower. This case was presented to the Board of County Commissioners through the Violation
Hearing process on May 8,2007 and referred to the County Attorney's office. Legal action was delayed for
30 days to allow adequate time for them to submit their USR application.
This application, if approved, will correct the violation. If for any reason, this application is denied, the
Violation Case will proceed accordingly.
