Notes: 1. For purposes of this report, liens, easements, rights of way and other
encumbrances on the surface estate have not been examined.
2. The mineral ownership shown above was based on examination of certain
recorded instruments in the Weld County Clerk and Recorder's Office as reflected by the
Tract Index in the offices of LandAmerica Lawyer's Title Insurance Company in
Greeley, Colorado. In addition, the records of the Weld County Assessor's Office were
also examined. Please understand that this report does not represent a complete search of
the records from Patent to the present.
3. The documents that were examined reflect the mineral ownership as
shown above; however, the press of time prevented a more complete search of the
records for mortgages, deeds of trust, public trustee deeds, foreclosures, tax sales and
redemptions, and other documents that might adversely affect the title. Therefore, this
report and Witwer Oldenburg Barry & Johnson, LLP's liability must be so limited and
considered accordingly. At your request, a more thorough search from Patent to the
present can be conducted, and we would appreciate the opportunity to do so.
4. Taxes are current; and while we did not examine the Weld County Court
records, there is no indication of liens or pending litigation affecting the SE/4 of Section
34, T7N, R66W.
