HomeMy WebLinkAbout20070205.tiff iI RESOLUTION RE: APPROVE PARTIAL CANCELLATION AND RELEASE OF COLLATERAL FOR WATERFORD HILL PLANNED UNIT DEVELOPMENT FINAL PLAN, PF#1095-WHITE WOLF, LLC WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, by Resolution dated August 9, 2006, the Board of County Commissioners approved a Planned Unit Development Final Plan, PF #1095, for White Wolf, LLC, 1719 East Mulberry, Fort Collins, Colorado 80524, for Waterford Hill Planned Unit Development for nine (9) lots with E (Estate)Zone uses on the following described real estate, to wit: Part of the SE1/4 of Section 31, Township 8 North, Range 67 West of the 6th P.M., Weld County, Colorado, and WHEREAS, on September 6, 2006, the Board of County Commissioners of Weld County, Colorado, approved an Improvements Agreement According to Policy Regarding Collateral for Improvements(Private Road Maintenance)for Waterford Hill Planned Unit Development, between the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, and White Wolf, LLC, with terms and conditions being as stated in said agreement, and accepted Irrevocable Standby Letter of Credit, CTCS-277311, drawn on JPMorgan Chase Bank, N.A.,c/o JPMorgan Treasury Services Global Trade Services, 10420 Highland Manor Drive, Tampa, Florida 33610, in the amount of$666,050.00, and WHEREAS, staff from the Weld County Departments of Planning Services and Public Works have conducted a visual inspection and recommend partial release of said collateral, in the amount of$388,962.00, retaining $277,088.00, and WHEREAS, upon the recommendation of staff, the Board deems it advisable to release said collateral. Collateral covered the following items: Site Grading estimate $ 117,000.00 Street base estimate $ 56,000.00 Storm Sewer Facilities estimate $ 9,250.00 Water Mains estimate $ 104,000.00 Street Signs estimate $ 1,000.00 Fencing Requirements estimate $ 64,500.00 Landscaping/Entrance estimate $ 46,142.00 Telephone estimate $ 44,320.00 Gas estimate $ 39,356.00 Electric estimate $ 42,850.00 Engineering and Supervision Costs estimate $ 50,000.00 Total Estimated Cost of Improvements and supervision $ 579,174.00 X 115% = $666,050.00 The applicants are requesting a partial reduction of collateral in the amount of Three-Hundred Eight-Eight Thousand and Nine-Hundred Sixty-Two Dollars ($388,962.00). If granted, this would leave a remaining collateral balance of Two-Hundred Seventy-Seven Thousand and Eight-Eight Dollars ($277,088.00) to cover remaining improvements. As of the date of this letter, a two-year warranty period shall commence on the subject water line improvements. The improvements are now also approved for service upon completion of a tap agreement and payment of all fees, costs and expenses and/or dedication of water, if required. During the two-year warranty period, any repair or maintenance of the improvements shall be the responsibility of the developer. Please note that this approval is for water line improvements only, which includes all delivery lines and lines up to the meters. Individual water service from meters to each individual residence is not the responsibility of the District. Furthermore, please note that such conditional acceptance does not extend to any associated soils compaction.
