RESOLUTION
RE: APPOINTMENT OF THE GRIEVANCE' BOARD CHAIRMAN AS HEARING OFFI-
CER FOR APPEALS OF CASES INVOLVING VEHICLES TOWED PURSUANT
TO THE WELD COUNTY SHERIFF'S OFFICE POLICY
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, pursuant to. Federal case law involving civil
rights violations, the Weld County Sheriff has adopted a policy
concerning the right to appeal an officer's decision to have a
motor vehicle towed without the consent of the owner of the
motor vehicle, and
WHEREAS, pursuant to such policy, the owner of the motor
vehicle has a right to request a hearing to contest the decision
of the officer, and
WHEREAS, it is necessary to appoint a hearing officer to
hear such appeals, and
WHEREAS, it has been recommended to the Board of County
Commissioners that the Chairman of the County Personnel Grievance
Board, or his designee of such Grievance Board, be appointed as
the hearing officer.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missionerstof Weld-County, Colorado, that the Chairman of the
Weld County Personnel Grievance Board, or his designee of such
Board, be appointed as hearing officer to hear appeals of decisions
of Deputies of the Weld County Sheriff's Office to authorize the
towing of motor vehicles without the consent of the owners of
such motor vehicles pursuant to the policy established by the
Weld County Sheriff's Office.

and seconded, adopted by the following vote on the 20th day of
