RE: RESUBDMSION #1136, FOR THE CREATION OF AN ADDITIONAL LOT IN THE
BLACK HOLLOW ACRES SUBDIVISION -JASON AND LISA SLATER
A public hearing was conducted on March 14, 2007, at 10:00 a.m., with the following present:
Commissioner David E. Long, Chair
Commissioner William H. Jerke, Pro-Tem - EXCUSED
Commissioner William F. Garcia
Commissioner Robert D. Masden
Commissioner Douglas Rademacher
Also present:

The following business was transacted:
I hereby certify that pursuant to a notice dated February 23, 2007,and duly published February 28,
2007, in the Fort Lupton Press, a public hearing was conducted to consider the request of Jason
and Lisa Slater for a Resubdivision, RS #1136, for the creation of an additional lot in the Black
Hollow Acres Subdivision. Cyndy Giauque,Assistant County Attorney,made this a matter of record,
and advised Jason Slater,applicant,that he has the option of continuing the matter to a date when
the full Board will be present. However, if he decides to proceed today, it will require three
affirmative votes,or in the case of a tie vote,CommissionerJerke will listen to the record and make
the determining vote. Mr. Slater indicated he would like to proceed today.
Hannah Hippely, Department of Planning Services, presented a brief summary of the proposal and
entered the favorable recommendation of the Planning Commission into the record as written. She
stated the site is located north of Weld County Road 86 and west of Weld County Road19, and all
of the surrounding properties are zoned agriculturally.
Char Davis, Department of Public Health and Environment,stated the site is currently serviced by
well water and a septic system;however,the new lot will be served by the North Weld County Water
District and a septic system.
Don Carroll, Department of Public Works, stated an additional lot will be created, with a flagpole
access from Weld County Road 86. He stated the new lot will maintain its own access;the access
will not be shared between the lots.
In response to Commissioner Masden, Mr. Slater stated he would like to build an additional
residence farther back from the road due to dust problems along Weld County Road 86. He further
stated he intends to plant new trees around the original residence to help with dust mitigation.
Further responding to Commissioner Masden,Mr.Slater stated Weld County Road 86 is maintained

by the County. He stated a property down the road has a Use by Special Review Permit for a
concrete business, therefore, the heavy trucks associated with the business produce excessive
dust. In response to Commissioner Masden, Mr. Carroll stated he will research what is required
of the applicants with the Use by Special Review Permit,and if the applicant would need to provide
dust abatement measures. Responding to Commissioner Rademacher, Mr. Slater stated his
property is surrounded by dry farmland, and no other properties within the Black Hollow Acres
Subdivision have irrigated land or cattle on the property.
No public testimony was offered concerning this matter.
In response to Chair Long, Mr. Slater stated he has reviewed, and concurs with,the Conditions of
Approval and Development Standards, as proposed.
Commissioner Masden moved to approve the request of Jason and Lisa Slater for a Resubdivision,
RS#1136,for the creation of an additional lot in the Black Hollow Acres Subdivision, based on the
recommendations of the Planning staff and the Planning Commission, with the Conditions of
Approval as entered into the record. The motion was seconded by Commissioner Rademacher,
and it carried unanimously. There being no further discussion, the hearing was completed at
10:45 a.m.
This Certification was approved on the 19th day of March 2007.
