HomeMy WebLinkAbout20070064.tiff RESOLUTION RE: AUTHORIZATION FOR THE WELD COUNTY ATTORNEY TO PROCEED WITH LEGAL ACTION AGAINST RAMON RETANA PENA FOR VIOLATION OF THE WELD COUNTY CODE WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS,Ramon Retana Pena,VI#0600368, is allegedly in violation of the Weld County Code, and WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has not been corrected, and WHEREAS, on the 9th day of January, 2007, a public hearing was held before the Board of County Commissioners for the purpose of hearing testimony relating to said violation, and WHEREAS, Ramon Retana Pena property owner, was present at said hearing, and WHEREAS,the Board of County Commissioners deems it advisable to refer said violation to the Weld County Attorney's Office for legal action, with an instruction for delay of action upon such referral until May 9, 2007,to allow adequate time for the property owner to reduce the number of commercial vehicles to one, or submit a Use by Special Review application for a Home Business to bring the subject property into compliance, and for an inspection of the property by the Department of Planning Services staff. We find that your proposed Certificate of Compliance for an Auxiliary Quarters does not meet the intent of the Code and it has not been approved by staff. This proposal has not been approved by staff because the proposed Auxiliary Quarter does not comply with Section 23-1-90 of the Weld County Code. The Code requires the gross floor area of the single family dwelling be at least 1600 square feet. As proposed the existing single family dwelling is 1152 square feet, 448 square feet below the minimum requirement of 1600 square feet. Adjustments to the proposal can be made which will bring it into compliance with the Weld County Code. In order to comply with the Weld County Code the single family dwelling should be enlarged to meet the minimum 1600 square foot requirement (an addition of 448 square feet). The square footage of the Auxiliary Quarters must not be greater than 50% of the square footage of the single family home and cannot exceed 1000 square feet. For example, increasing the single family home to 1600 square feet would allow a maximum square footage of 800 square feet for the Auxiliary Quarters. Other requirements that must be met in order for the Auxiliary Quarters proposal to be accepted are listed below in the relevant section of the Weld County Code. AUXILIARY QUARTERS: One (1) or more interconnected rooms permanently attached to or located within a single family dwelling unit which are arranged, designed, used or intended for use as a complete independent living facility for one (1)family. All auxiliary quarters shall comply with the following requirements: a. The auxiliary quarters may not be used on any basis as a rental. b. The use is subordinate in purpose, area or intensity and the occupants contribute to the needs of the occupants of the single family dwelling served. c. The gross floor area of the single family dwelling shall be no less than one thousand six hundred (1,600) square feet in size. d. The minimum lot size shall be no less than two and one-half(2%) acres. e. The minimum gross floor area of the auxiliary quarters shall be no less than three hundred (300) square feet in size, and the maximum shall not exceed fifty percent(50%) in size of the gross floor area of the single family dwelling, not to exceed one thousand (1,000) square feet in size. f.The auxiliary quarters shall be attached by common roof and foundation. g. The auxiliary quarters and the single family dwelling shall be connected by a party wall or shall not be separated by more than twice the width of the projected view of the shortest exterior wall of the auxiliary quarters. During site inspection planning staff noticed three (3) Commercial Vehicles parked on the property. Section 23-3-30 of the Weld County Code allows for one (1) Commercial Vehicle per Lot in a Subdivision within the Agricultural Zone District; however, the Commercial Vehicle must be permitted in accordance with Section 23-4-950 of the Code.
