MINING ACTIVITIES ADJACENT TO ELECTRIC
POWER LINES
In order to comply with applicable codes and regulations and United Power, Inc. safety
and operational requirements, mining activities must maintain a minimum of 10' radial
clearance from all overhead and underground electric power lines.
No mining excavation shall be allowed within a minimum of 10' of any overhead or under-
ground electric power line paralleling a public road or highway or other permanent access.
• Existing grade must be maintained for a minimum of 10' from the electric power line; from
that point, a minimum 3:1 slope shall extend to a distance of at least 35' from the top of the
excavation.
No mining excavation shall be allowed within a minimum of 35' of either side of any over-
head or underground electric power line with mining activities on both sides of the line. No
excavation shall be allowed within a minimum of 20' of the point that any overhead electric
power line guy wire anchor rod enters the ground.
Continuous all weather access must be provided to and parallel to all electric power lines
within the area of excavation. A 70' wide corridor, 35' on either side of the electric power
line, shall be maintained to allow access to United Power, Inc. to overhead electric power
poles and lines and to underground electric system facilities.
The intent of this Policy is to ensure the integrity of the electric power line and provide for
all weather access to the line for maintenance.
All requests for variance to the Standard shall be subject to review and approval of the
United Power, Inc. Safety Director.

Dear Mr. Ogle:
This referral does not appear to qualify as a "subdivision" as defined in Section 30-28-
101(10)(a), C.R.S. Therefore, pursuant to the State Engineer's March 4, 2005 memorandum to
county planning directors, this office will only perform a cursory review of the referral information and
provide comments. The comments do not address the adequacy of the water supply plan for this
project or the ability of the water supply plan to satisfy any County regulations or requirements. In
addition, the comments provided herein cannot be used to guarantee a viable water supply
plan or infrastructure, the issuance of a well permit, or the physical availability of water.
According to the submitted information, the site will be served by an existing well. According
to the records available in the State Engineer's Office there is a commercial exempt well constructed
in the SW1/4 of the SW1/4 of Section 23, Towship 2 North, Range 65 West. The well was
constructed under well permit no. 71543 and the use of the well is limited to drinking and sanitary
purposes only. Therefore, the well could not be used for intermittent cleaning of the equipment at the
station as stated in item 3.5.7 of the Executive Summary or other industrial uses (i.e. water coolers,
produced water, ect.). If water from the well will be used for any purposes other than drinking and
sanitary, the applicant must repermit the well as a nonexempt well pursuant to C.R.S. 37-90-137(4).
According to the files of the State Engineer's Office the applicant has not yet submitted a well permit
application to change the use of the existing well. The ability of the applicant to obtain a nonexempt
well permit for commercial use and/or industrial use will be evaluated at the time the well permit
application is submitted. Note that the referral information did not specify the well permit number for
the existing well, therefore, if the well referenced above is not the well that will be used to serve the
property, additional information would be required in order for our office to provide comments.

The Weld County Public Works Department has reviewed this proposal. This project falls primarily under the
purview of the Use by Special Review Standards, Weld County Code, Chapter 23, Article II, Division 4, Section
23. Our comments and requirements are as follows:
COMMENTS and REQUIREMENTS;
The main access to the facility is from the 1-76 west Frontage Road to WCR 47 north to the facility on WCR 18
and WCR 45 section line. All roads are maintained by Weld County at this time.
Weld County Road Classification Plan (FHU): (June 2002) WCR 18 is a local gravel road and requires a
60-foot right-of-way at full build out. There is presently a 60-foot right-of-way. This road is maintained by Weld
County. Pursuant to the definition of SETBACK in the Weld County Zoning Ordinance (23-1-90), the required
fitback is measured from the future right-of-way line.
ection Line Access: (right-of-way) (WCR 45)
Access: This is an existing facility with two access points, which are fenced and gated. Utilize these access
points to the facility.
Circulation and Parking: This circulation and off-street parking including the access drive shall be surfaced
with gravel, recycled asphalt, or the equivalent and shall be graded to prevent drainage problems.
Traffic: The applicant indicated that approximately 10 employees/maintenance/construction workers may be
on site at one time. Only one operator currently will man the station four to eight hours per day. This site will
be a 24 hours per day, seven days per week facility 365 days a year operation.
Storm Water Drainage:
The applicant is required to comply with all Colorado Department of Health and Environmental (CDPHE)
regulations regarding berming and spill prevention for materials and liquids stored on site.
The applicant is required to comply with all Colorado Department of Health and Environment, Water Quality
Control Division regulations regarding storm water quality permitting and protection and construction storm
water discharges.

The historical flow patterns and run-off amounts will be maintained on site in such a manner that it will
reasonably preserve the natural character of the area and prevent property damage of the type generally
attributed to run-off rate and velocity increases, diversions, concentration and/or unplanned ponding of storm
run-off.
The applicant must take into consideration storm water capture/quantity and provide accordingly for best
management practices.
Comment:
The Town of Hudson is proposing to place a women's prison directly south of this facility. There is a possibility
that if that does occur through the annexation, the access road would be upgraded and paved.

The Sheriff's Office recommends the following improvements for this business:
1. A permanent sign should be placed at the entrance to the property that meets the planning and
zoning standards and is approved by the county commissioners, detailing the name of the
business, address, and a graphical presentation of the roadways within the property. There
should be a plan developed to maintain this sign.
2. If the roadways within this property are not maintained or adopted by the county, individuals
residing on this property should be made aware that the Sheriffs Office will have
• limited traffic enforcement powers in regard to traffic complaints.
3. A plan should be developed to maintain roadways on the property,especially during
inclement weather conditions for emergency vehicles.
4. If you intend to name any of the roads on the property you should be present these names to
the Sheriffs Office for approval. This will eliminate duplication of street names within the county.
If you do name any of the roads they will need to be properly marked with clearly visible
reflective signs.
The Sheriffs Office lacks the ability to absorb any additional service demand without the resources
recommended in the multi-year plan provided to the Weld County Board of County Commissioners or as
indicated by growth not considered at the time the plan was developed. I have no other comments on this
proposal.

Site Specific Development Plan and Use by Special Review Permit for Mineral Resource Development Facility

1. A building permit shall be obtained prior to the construction or placement of any structure. An electrical permit will
be required for any electrical service to equipment. A plot plan shall be submitted when applying for building permits
• showing all structures with accurate distances between structures, and from structures to all property lines.
2. A plan review is required for each building for which a building permit is required. Plans shall bear the wet stamp
of a Colorado registered architect or engineer. Two complete sets of plans are required when applying for each
permit.
3. Buildings shall conform to the requirements of the various codes adopted at the time of permit application.
Currently the following has been adopted by Weld County: 2006 International Building Code; 2006 International
Mechanical Code; 2006 International Plumbing Code; 2005 National Electrical Code; 2006 International Fuel Gas
Code and Chapter 29 of the Weld County Code.
4. Each structure set on a foundation will require an engineered foundation based on a site-specific geotechnical
report or an open hole inspection performed by a Colorado registered engineer. Engineered foundations shall be
designed by a Colorado registered engineer.
5. Building wall and opening protection and limitations and the separation of buildings shall be in accordance with the
Building Code. Setback and offset distances shall be determined by the Zoning Ordinance.
6. Building height shall be measured in accordance with the Building Code for the purpose of determining the
maximum building size and height for various uses and types of construction and to determine compliance with the
Bulk Requirements from Chapter 27 of the Weld County Code. Building height shall be measured in accordance with
Chapter 23 of the Weld County Code in order to determine compliance with offset and setback requirements. Offset
and setback requirements are measured to the farthest projection from the building.
8. Provide a letter of approval from Hudson Fire protection District prior to setting any equipment or structures.
• 7. There are two historical building permits with final status for this parcel.

We recommend that the following requirements be met prior to allowing the plat to be
recorded:
1. The applicant shall submit evidence of an Air Pollution Emission Notice
(A.P.E.N.) and Emissions Permit application from the Air Pollution Control
• Division (APCD), Colorado Department of Health and Environment. Alternately,
the applicant can provide evidence from the APCD that they are not subject to
these requirements.
2. The applicant shall submit a dust abatement plan for review and approval, to the
Environmental Health Services, Weld County Department of Public Health &
Environment.
3. The Environmental Health Services Division was unable to locate a septic permit
for the septic system serving the existing compressor station. The septic system
shall be reviewed by a Colorado Registered Professional Engineer. The review
shall consist of observation of the system and a technical review describing the
systems ability to handle the proposed hydraulic load. The review shall be
submitted to the Environmental Health Services Division of the Weld County
Department of Public Health and Environment. In the event the system is found
to be inadequately sized or constructed the system shall be brought into
compliance with current Regulations.
4. The applicant shall submit evidence to the Department of Planning Services,
from the Colorado Division of Water Resources, demonstrating that the well is
appropriately permitted for the industrial use.

5. The applicant shall submit a waste handling plan, for approval, to the
•
Environmental Health Services Division of the Weld County Department of Public
Health & Environment. The plan shall include at a minimum, the following:
1) A list of wastes which are expected to be generated on site (this should
include expected volumes and types of waste generated).
2) A list of the type and volume of chemicals expected to be stored on site.
3) The waste handler and facility where the waste will be disposed (including
the facility name, address, and phone number).
We recommend that the following requirements be incorporated into the permit as
conditions that must be met prior to operation:
1. A stormwater discharge permit may be required for a
development/redevelopment/construction site where a contiguous or non-
contiguous land disturbance is greater than or equal to one acre in area. The
applicant shall inquire with the Water Quality Control Division (WQCD) of the
Colorado Department of Public Health and Environment at
www.cdphe.state.co.us/wq/PermitsUnit if they are required to obtain a

stormwater discharge permit. Alternately, the applicant can provide evidence
•
from WQCD that they are not subject to these requirements.
We recommend that the following requirements be incorporated into the permit as
development standards:
1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and
Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for
final disposal in a manner that protects against surface and groundwater
contamination.
2. No permanent disposal of wastes shall be permitted at this site. This is not
meant to include those wastes specifically excluded from the definition of a solid
waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S.,
as amended.
3. Waste materials shall be handled, stored, and disposed in a manner that controls
fugitive dust, fugitive particulate emissions, blowing debris, and other potential
nuisance conditions.
4. The applicant shall operate in accordance with the approved "waste handling
• plan".

• 5. Fugitive dust and fugitive particulate emissions shall be controlled on this site.
The facility shall be operated in accordance with the approved dust abatement
plan at all times.
6. The operation shall comply with all applicable State noise statutes and/or
regulations.
7. Adequate handwashing and toilet facilities shall be provided for employees and
visitors of the site.
8. Sewage disposal for the facility shall be by septic system. Any septic system
located on the property must comply with all provisions of the Weld County Code,
pertaining to Individual Sewage Disposal Systems.
9. A permanent, adequate water supply shall be provided for drinking and sanitary
purposes.
10.All potentially hazardous chemicals must be stored and handled in a safe manner
in accordance with product labeling and in a manner that minimizes the release
of hazardous air pollutants (HAP's) and volatile organic compounds (VOC's).
11 .If applicable, the applicant shall obtain a stormwater discharge permit from the
• Colorado Department of Public Health & Environment, Water Quality Control
Division.
12.The operation shall comply with all applicable rules and regulations of the State
and Federal agencies and the Weld County Code.
