Our comments and requirements are as follows: COMMENTS: There are no designated County roads associated with the expansion of the transmission line. Utilize existing transmission line easements. REQUIREMENTS: The applicant shall contact Kelly Jenkins in the Weld County Public Works Department to acquire any necessary County permits as this expansion will be crossing Weld County rights-of-way. Our comments and requirements are as follows: COMMENTS and REQUIREMENTS: The applicant proposes to install a 230 KV power line on poles and buried underground. The proposed underground portion includes crossing Liberty Gulch, a natural drainage located to the west of the Town of Mead. At that drainage crossing, the applicant is requested to install trench blockers (either grouted plugs or bentonite slurry plugs) to prevent the subsurface diversion of groundwater either, into the electrical cable trench or from the electrical cable trench into Liberty Gulch. Similarly, all irrigation ditch crossings by buried electrical cables should also be protected with impervious plugs to prevent the contamination of groundwater resources. We have no objections to the proposal, however, we do recommend that the following conditions be part of any approval: We recommend that the following requirements be met prior to allowing the plat to be recorded: 1. The applicant shall submit a dust abatement plan for periods of dry weather for / roadways, parking areas and in areas where soil has been disturbed during construction. The plan shall be submitted for review and approval, to the Environmental Health Services, Weld County Department of Public Health & Environment. We recommend that the following requirements be incorporated into the permit as conditions that must be met one month prior to construction activities: 1. A stormwater discharge permit may be required for a development/redevelopment /construction site where a contiguous or non- contiguous land disturbance is greater than or equal to one acre in area. Contact the Water Quality Control Division of the Colorado Department of Public Health and the Environment at www.cdphe.state.co.us/wq/PermitsUnit for more information. We recommend that the following requirements be incorporated into the permit as development standards: 1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. 2. No permanent disposal of wastes shall be permitted at this site. This is not meant to include those wastes specifically excluded from the definition of a solid waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended. 3. Waste materials shall be handled, stored, and disposed in a manner that controls fugitive dust, fugitive particulate emissions, blowing debris, and other potential nuisance conditions. 4. Fugitive dust and fugitive particulate emissions shall be controlled on this site. The facility shall be operated in accordance with the approved dust abatement plan at all times. 5. The operation shall adhere to the maximum permissible noise levels allowed in the Industrial Zone as delineated in 25-12-103 C.R.S., as amended. 6. Adequate toilet facilities (port-a-potty) shall be provided during the construction of the project. 7. Bottled water shall be utilized for drinking and hand washing during construction of the project. 8. The project will involve adding a 230-kV transmission line circuit to existing poles in Weld County from the existing Fort Saint Vrain Substation toward the I,ong's Peak Substation. There will also be an underground segment in unincorporated Weld County into Boulder County. The new line will cover 22 miles in both counties, with approximately 14 miles of the line in Weld County. The report indicates that preliminary habitat surveys have been conducted for species listed as threatened or endangered under the ESA, and that habitat for the lite ladies'-tresses orchid (Spiranthes diluvialis), the Colorado butterfly plant (Gaura neomexicana ssp. coloradensis), and the bald eagle (Flaliaeetus leucocephalus) potentially occurs along the corridor. The Platte River Power Authority has committed to conducting surveys for these species prior to project commencement, and we look forward to reviewing those survey reports. We are encouraged that the transmission line will be constructed using the Avian Power I,inc Interaction Committee (APLIC) guidelines, thus minimizing the potential that these lines could kill large raptors. lb further protect raptors, and other nesting birds, nest surveys should be conducted prior to removing or pruning trees and shrubs. Removal and pruning should occur during the non-nesting season, which in Colorado is generally August 15 through May 30. Raptors however, may begin nesting activities as early as January. St. Vrain to Fordham transmission line Page 2 Because underground cable installation is scheduled to be conducted during the spring/summer of 2008, we recommend that habitat for ground-nesting birds be cleared prior to the nesting season and that regular surveys for nests in the process of being constructed be conducted. We further recommend that the results of field surveys for nesting birds, along with information regarding the qualifications of the biologist(s) performing the surveys, be thoroughly documented and that such documentation be maintained on file by the project proponent (and/or construction contractor) for potential review by the Service (if requested) until such time as construction on the proposed project has been completed. The Service's Colorado Field Office should be contacted immediately for further guidance if a field survey identities the existence of one or more active bird nests that cannot be avoided by the planned construction activities. Adherence to these guidelines will help avoid the unnecessary take of migratory birds and the possible need for law enforcement action. According to the application materials submitted by the Platte River Power Authority (PRPA), this project involves adding a 230-kV transmission line circuit to existing poles in Weld County. In addition, the project includes the construction of an underground segment for portions of this line in Weld County. The City has a number of comments on this project as it relates to Weld County. These are outlined below. Longmont Power & Communications (LPC) is supportive of this project and has been working closely with PRPA to identify and develop the service enhancements and to minimize conflicts with any existing LPC facilities. The PRPA transmission line project into Longmont will significantly increase the electric reliability for the City by providing a second source of transmission service along a route independent of other sources. In addition, the project will provide additional electric capacity for growth over the long term. In 2005 the City of Longmont annexed approximately 1500 acres in Weld County, which included Union Reservoir and several surrounding properties. According to the application materials, a portion of the proposed 230-kV underground transmission line runs east—west, just north of Union Reservoir. Although the maps submitted as part of this application do not depict a correct municipal boundary for the City of Longmont, it appears that this proposed 230-kV underground transmission line will pass through the City. The City suggests that PRPA revise their information to show the correct city limits for Longmont; this will help ensure coordination with the appropriate jurisdiction. The proposed routing of the 230-kV underground transmission line, along the north side of Union Reservoir, passes through an area that the City will eventually inundate as part of the Union Reservoir Enlargement Project. Consideration for the higher water levels and increased pressure on this portion of the transmission line should be included as part of the design for this segment of the proposed line. The City requests that involvement and review by the Public Works and Water Utilities Department continue throughout the development of this project. The City has a future Capital Improvement Project (CIP)that will widen County Line Road from Highway 119 to Highway 66. The proposed underground transmission line crosses County line Road in this area. Storm drainage and other underground facilities will be constructed as part this future CIP Project. In an effort to avoid underground conflicts, the City requests that PRPA coordinate with the City's Public Works and Water Utilities department. Specifically, the city suggests that PRPA provide information concerning line depth and trench and concrete encasement details for the City's review. We would remind the Platte River Power Authority that because the product they will be installing has a large quantity of copper it is a very attractive item to be stolen. Thus we would request that they develop and implement a comprehensive safety and security plan to protect this valuable asset. The Sheriffs Office lacks the ability to absorb any additional service demand without the resources recommended in the multi-year plan provided to the Weld County Board of County Commissioners or as indicated by growth not considered at the time the plan was developed.
