RE: ACTION OF THE BOARD OF COUNTY COMMISSIONERS REGARDING VIOLATION
VI#0701112 AGAINST RANDALL AND TANI OWENS FOR VIOLATION OF THE WELD
COUNTY CODE
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, Randall and Tani Owens, VI #07-01112, are allegedly in violation of the Weld
County Code, and
WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has
not been corrected, and
WHEREAS,on the 5th day of September,2007,a public hearing was held before the Board
of County Commissioners for the purpose of hearing testimony relating to said violation, and
WHEREAS, Randall and Tani Owens were not present or represented at said hearing,
although all parties were notified of said hearing by Department of Planning Services staff, and
WHEREAS, the Board deems it advisable to bring legal action against those individuals
named above to correct said violation.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the Weld County Attorney be, and hereby is, authorized to proceed with
legal action against Randall Owens to remedy the violation of the Weld County Code, and any
other persons occupying the properties,any persons claiming an interest in the properties,and any
persons acting in active concert with the identified parties.

Dear Mr. Chair and the Weld County Board of Commissioners,
It has come to our attention that an unapproved shooting, archery, and paintball business is in operation
at this location. Please note that Grandview Highland Estates is a County enclave surrounded by the
Town of Frederick. The site is accessed via Aggregate Boulevard (WCR 7)and Holly Street and is just
over''/-mile north of CO 52. According to the Assessors records, there are 34 properties within 1,000
feet of this site, several of which are located within the Town of Frederick(±500 feet of the site).
Therefore, despite the County's Agricultural zoning designation this is not a traditional agricultural
neighborhood. Furthermore, the Town has planned, platted and/or issued building permits for over 2,000
homes on properties surrounding this enclave.
Upon review of the photos of the site, it appeared that the back drop, berms, and construction are likely
insufficient in height, girth, or material to prevent noise and errant bullets from exiting the range and
conflicting with neighboring residential uses. In addition, it could not be verified that sufficient measures
have been employed to prevent lead from contaminating the surrounding soils and environment.
Furthermore, this business utilizes roads maintained by the Town for access. Other services, such as
emergency response, have also been utilized for this site. This increases the financial burden of the
Town without the benefit of any tax revenue or impact fees to offset those costs. Please also note that
research of various munitions suggest that a .22 caliber bullet may be lethal for up to 500 feet and a .308
caliber bullet may be lethal for over 3,000 feet, other weapons may be lethal for even greater distances.
Due to the evident potential for significant conflicts with public health, safety and welfare, both within the
County and the Town of Frederick, the site's proximity to Town limits, residential development pattern,
residential uses of neighboring properties, proximity to and density of neighboring development, noise,
nuisances, traffic patterns, and use of Town streets and other services the Town supports the closure of
this unapproved business. While this letter has focused on the shooting range, similar concerns and
incompatibilities exist with the other business uses(paintball/archery). Should the applicant desire to
continue the business, please direct them to the Town of Frederick for annexation, zoning, and other
applicable processes. However, the applicant should note that similar businesses may not be supported
in this location due to incompatibilities with surrounding land uses, as noted above, the Town's
Comprehensive Plan, and an ordinance which prohibits the discharge of weapons on lands within the
Town limits. Alternatively, the Town has several sites that could be developed as an indoor
shooting/archery/paintball range, including properties within the Glacier Business Park located ±'/% mile
south of this site.
