HomeMy WebLinkAbout20071181.tiff HEARING CERTIFICATION DOCKET NO. 2007-25 RE: SITE SPECIFIC DEVELOPMENT PLAN AND USE BY SPECIAL REVIEW PERMIT#1599 FOR A PUBLIC AND QUASI-PUBLIC BUILDING, INCLUDING A CHURCH, IN THE A (AGRICULTURAL) ZONE DISTRICT - CARR COMMUNITY CHURCH A public hearing was conducted on April 18, 2007, at 10:00 a.m., with the following present: Commissioner David E. Long, Chair Commissioner William H. Jerke, Pro-Tem Commissioner William F. Garcia Commissioner Robert D. Masden Commissioner Douglas Rademacher Also present: Acting Clerk to the Board, Jennifer VanEgdom County Attorney, Bruce Barker Planning Department representative, Roger Caruso Health Department representative, Char Davis Public Works representative, Jesse Hein The following business was transacted: I hereby certify that pursuant to a notice dated March 30,2007, and duly published April 4,2007, in the Fort Lupton Press, a public hearing was conducted to consider the request of Carr Community Church for a Site Specific Development Plan and Use by Special Review Permit#1599 for a Public and Quasi-Public Building, including a Church, in the A(Agricultural)Zone District. Bruce Barker, County Attorney, made this a matter of record. Roger Caruso, Department of Planning Services, presented a brief summary of the proposal and entered the favorable recommendation of the Planning Commission into the record as written. He stated the site is located within the Townsite of Carr, more specifically north of Grey Avenue and east of 5th Street, on lots 13, 14, and 15 of Block 11. He further stated the proposed fellowship hall will provide restroom facilities since the church currently does not have restrooms, and a commercial well permit has been issued. He stated the surrounding properties are primarily single family residences with agricultural uses,and the closest residence is located 60 feet to the south of the property. He further stated one letter of support has been received from a surrounding property owner,dated January25,2007. Mr.Caruso submitted a memo detailing requested changes to the Resolution, marked Exhibit F. He recommended the deletion of Condition of Approval#1.A.5 and Development Standards#3 and#4. Mr. Caruso displayed photographs of the site, and in response to Chair Long, he stated a new building will be built on the property in addition to the existing church building on the site. Char Davis, Department of Public Health and Environment, stated the fellowship hall facility will be serviced by a commercial well, and a septic system will be installed. Jesse Hein, Department of Public Works, stated the site is located adjacent to 5th Street and Gray Avenue, which are both gravel roads with 80 feet of right-of-way, and access to the facility will be on Gray Avenue,with a secondary access on the alleyway north of the property. Mr. Hein stated the applicant will be required to upgrade the alleyway access with six inches of aggregate base course. 2007-1181 PL1885 /14 ft, /arc! ge_ c15 j0 - 7 HEARING CERTIFICATION - CARR COMMUNITY CHURCH (USR #1599) PAGE 2 Keith Laube, Laube Engineering,represented the applicant and stated a fellowship hall will be built north of the existing church building, and the addition of restroom facilities will be beneficial since the current church building does not have indoor plumbing. In response to Commissioner Jerke, Mr. Laube stated he would prefer not to limit the number of patrons within the facility to 70, as described in Development Standard#3; however, the church intends to adhere to the maximum occupancy figures. Further responding to Commissioner Jerke, Mr. Laube stated the hours of operation had to be listed in the application materials;however,the church desires to have the time limitations in Development Standard#4 removed. In response to Commissioner Masden, Mr. Laube stated the fellowship hall will be approximately 1,600 square feet. Responding to Chair Long, Mr. Laube stated a handicap ramp will be placed along the west side of the church building,which will lead into the fellowship hall. He further stated several code issues would have to be addressed to connect the buildings;therefore,they will remain separate buildings. Chair Long stated he believes the new facility will be a great addition to the community. Ken Gunter, pastor, Carr Community Church, stated the facility will be a great addition, and the church is in need of bathroom facilities. He expressed his supportforthe application and stated the church would like to begin construction as soon as feasibly possible. Following discussion concerning the memo submitted by Mr.Caruso,the Board concurred with the deletion of Condition of Approval#1.A.5, and Development Standards#3 and#4. In response to Chair Long, Mr. Laube stated he and the applicant have reviewed,and concur with,the Conditions of Approval and Development Standards, as amended. Commissioner Jerke moved to approve the request of Carr Community Church for a Site Specific Development Plan and Use by Special Review Permit#1599 fora Public and Quasi-Public Building, including a Church, in the A (Agricultural) Zone District, based on the recommendations of the Planning staff and the Planning Commission, with the Conditions of Approval and Development Standards as entered into the record. His motion included the deletion of Condition of Approval#1.A.5, and Development Standards#3 and#4, and the necessary renumeration. The motion was seconded by Commissioner Garcia,and it carried unanimously.
