RE: APPROVAL OF SUBDIVISION EXEMPTION NO. 169 - MARVIN AND MILDRED
BAY
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners has reviewed the
rr: request of Marvin and Mildred Bay for an exemption from the defi-
nitions of "subdivision" and "subdivided land" in Section 30-28-101

(10) (d) , CRS 1973 , as amended, and Section 2-1 A. (3) of the Weld
County Subdivision Regulations, and
hi WHEREAS, the Board of County Commissioners finds that Marvin
and Mildred Bay are the owners of a certain parcel of land located
in Part of the Eh, Section 1, T6N, R65W of the 6th P.M. , Weld
County, Colorado, containing 127 Acres, more or less , and

The owners of the property described above have requested an exemption from
Section 2-1 of the Weld County Subdivision Regulations adopted August 30, 1972.
The Department of Planning Services staff has reviewed this request and
recaanends that the request be approved for the followings reasons:

We are requesting a subdivision exemption on our property
located one mile West and one-half mile South of Galeton, Colorado.
When we put the sprinkler on the property, it left' approximately
9 acres in the NE corner of the farm. We sold approximately 6 acres
with the improvements after obtaining a recorded exemption. Of the
3 acres left , we are able to irrigate approximately 2 acres through
flood irrigation. This has not been an economical practice .
EAST
Our neighbor to the geestIR who has a dairy on approximately 14
acres has asked us to sell the 3 acres to him so that he can provide
housing for his hired man. We feel this would put the land to a better
.,se and help put our farm in a better financial position.

appreciated.
