HomeMy WebLinkAbout20070811 RESOLUTION RE: APPROVE MEMORANDUM OF UNDERSTANDING FOR MIGRANT AND SEASONAL HEAD START PROGRAM AND AUTHORIZE CHAIR TO SIGN - MONTROSE VALLEY SCHOOL DISTRICT RE-1J WHEREAS,the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board has been presented with a Memorandum of Understanding for Migrant and Seasonal Head Start Program between the County of Weld,State of Colorado, by and through the Board of County Commissioners of Weld County, on behalf of the Department of Human Services, Family Educational Network of Weld County, and the Montrose Valley School District RE-1J, commencing April 15, 2007, and ending April 14, 2008, with further terms and conditions being as stated in said memorandum, and WHEREAS,after review, the Board deems it advisable to approve said memorandum, a copy of which is attached hereto and incorporated herein by reference. NOW,THEREFORE,BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the Memorandum of Understanding for Migrant and Seasonal Head Start Program between the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, on behalf of the Department of Human Services, Family Educational Network of Weld County,and the Montrose Valley School District RE-1J be,and hereby is, approved. BE IT FURTHER RESOLVED by the Board that the Chair be, and hereby is, authorized to sign said memorandum. The intent of this Memorandum of Understanding is to: 1. Ensure that migrant children eligible for special education services receive free an appropriate public education, as required by law, in the least restrictive environment. 2. Ensure that each Agency cooperatively maintains communication and shares leadership responsibilities at the local level to ensure that available resources are utilized in the most effective manner. 3. Ensure the cooperative arrangements between the LEA and FENWC are developed, implemented, and persevered. Responsibility of the LEA is to: 1. Provide special education services to special needs children participating in the Migrant/Seasonal Head Start Program according to the child's IEP/IFSP. 2. Provide comprehensive evaluations of children with suspected disabilities by appropriate personnel using appropriate instruments, and provide comprehensive evaluations on children who may require special evaluations. 3. Coordinate the development of the lEP/IFSP for children with disabilities based on evaluation information. If you have any questions please contact Janet Flaugher, Director, @ 353-3800, ext. 3340. 2007-0811 MEMORANDUM OF UNDERSTANDING BETWEEN MONTROSE VALLEY SCHOOL DISTRICT RE-1J AND FENWC MIGRANT AND SEASONAL HEAD START PROGRAM (2007) This Agreement is between Montrose Valley School District RE-1J (hereinafter referred to as LEA) and the Family Educational Network of Weld County Migrant and Seasonal Head Start (hereinafter referred to as FENWC), for the period from April 15, 2007 to April 14, 2008. I. PURPOSE STATEMENT The purpose of this Agreement is to establish collaboration and working procedures between the LEA and FENWC in the provision of services to Migrant and Seasonal Head Start children eligible for special education services for 2007-2008 in compliance with IDEA (IDEIA 2004) (34 C.R.F. Part 300), Colorado Rules for the Administration of the Exceptional Children's Education Act, and the Head Start Program Performance Standards on Services for Children with Disabilities and/or developmental delays (45 C.F.R. 1308). The intent of the Agreement is to: 1. Define which services will be provided by each Agency. 2. Ensure that migrant children eligible for special education services receive free and appropriate public education, as required by law, in the least restrictive environment. 3. Ensure that each Agency cooperatively maintains communication and shares leadership responsibilities at the local level to ensure that available resources are utilized in the most effective manner. 4. Ensure that cooperative arrangements between the LEA and FENWC are developed, implemented, and persevered. II. RESPONSIBILITIES OF FENWC 1. Recruit, enroll, and serve eligible FENWC children ages 6 weeks through 5 years. No less than 10 percent of the total number of enrollment opportunities in the FENWC Migrant and Seasonal Head Start Program shall be available for children with disabilities and/or developmental delays who are eligible to participate. 2. Screen all children within two weeks of enrollment for potential health problems and /or developmental delays. FENWC will invite LEA staff to participate in screenings. FENWC will participate in Child Find Activities of IDEA (IDEIA 2004) including but not limited to, participation in staffing, IFSP/IEP development, annual reviews and transition planning. ;9CC I—CcF'// 3. Refer children to LEA or other community resources to obtain appropriate determination of eligibility for children with disabilities or significant developmental delays. 4. Coordinate the development of the IFSP/IEP for children identified with a disability and/or significant developmental delay based on evaluation information. The IFSP/IEP interdisciplinary team that includes FENWC interdisciplinary staff, LEA interdisciplinary staff and the parents/guardians of the child will complete IFSP/IEP development. IFSP/IEP meetings will be held at a location and time convenient for all the interdisciplinary team members. Copies of the IEP will be made available to LEA, FENWC and the parents in English and the preferred language of the family. 5. Based on the IFSP/IEP interdisciplinary team determination, children will be placed in the least restrictive environment. 6. Seek out additional resources in the community for children with disabilities and/or developmental delays as needed. 7. Work collaboratively with LEA to develop cooperative staff training opportunities to increase knowledge and ability to provide quality services to children with disabilities and/or developmental delays. III. RESPONSIBILITIES OF LEA 1. Locate, identify and evaluate children with suspected disabilities and/or developmental delays within their jurisdiction that may be eligible for early intervention/special education and related services, including highly mobile children, private school children and homeless children. 2. Refer identified Migrant and Seasonal Head Start eligible children to FENWC for possible services. 3. Provide comprehensive evaluations of children with suspected disabilities and/or developmental delays by appropriate personnel using appropriate instruments, and provide comprehensive evaluations on children who may be eligible for special services. 4. Coordinate the development of the IFSP/IEP for children identified with a disability and/or developmental delay based on evaluation information. The IFSP/IEP interdisciplinary team that includes FENWC interdisciplinary staff, LEA interdisciplinary staff and the parents/guardians of the child will complete IFSP/IEP development. IFSP/IEP meetings will be held at a location and time convenient for all the interdisciplinary team members. Copies of the IEP will be made available to LEA, FENWC and the parents in English and the preferred language of the family. 5. Provide special education services to identified FENWC children and families according to the IFSP/IEP as determined by the IFSP/IEP interdisciplinary team. 6. Place pre-school children with disabilities and/or developmental delays based upon the IEP process and FENWC eligibility criteria. 7. Maintain documentation for in-kind purposes. 8. Work collaboratively with FENWC to implement specially designed instruction based upon the IFSP/IEP goals and objectives to meet the unique needs of a child with a disability and or developmental delay (content, methodology and/or delivery of instruction). IV. SPECIFIC PROGRAM SERVICE DELIVERY 1. LEA is not required to provide Special Education and related services when regular school is not in session. FENWC will continue to utilize qualified contractual providers to fill gaps in service to Migrant and Seasonal Head Start children and families based on IFSP/IEP process and outcomes. 2. Documentation for in-kind purposes will be recorded. 3. FENWC routinely seeks out related services in the community for children with disabilities and/or developmental delays. V. TRAINING AND TECHNICAL ASSISTANCE 1. LEA and FENWC are required to provide on-going training for staff to increase their knowledge and ability to provide quality services to children with disabilities and/or developmental delays. 2. LEA and FENWC may coordinate efforts by: a. Developing a system for staff needs assessment in the area of training. b. Coordinating training calendars. c. Training staff regarding the regulations and program philosophy of each agency. d. Inviting staff from each agency to share training activities. VI. COUNTING AND REPORTING 1. LEA and FENWC have systems for counting and reporting children with disabilities and/or developmental delays. a. Training staff regarding specific procedures and regulation for each agency. b. Developing a system so the time lines and persons responsible for reporting are clear. VII. TRANSITION PLANNING In and effort to provide for a smooth transition from the preschool setting to a public school setting the following will occur: 1. Prior to the child entering the public school setting, the pre-school staff and the child's elementary teacher will meet to share strategies. Transition plans will be developed jointly at an IEP meeting or Annual Review, and occur prior to the students' exit from FENWC to the K-12 school setting. 2. Information to parents regarding the differences in service delivery will be provided jointly during the Transition Staffing of the child from FENWC to the public school K-12 setting. 3. Placement alternative for students will be generated by the needs of the students as indicated on their currant IEP and as presented and discussed jointly at the Transition Meeting, with neither FENWC nor school personnel predisposing parents to choices that have not been jointly discussed as possible alternatives. VIII. Benson IX. CONFIDENTIALITY 1. Consent for Release of Information Forms that will assist FENWC and LEA in providing optimal services will be generated and signed as each child is identified in accordance with the Family Education Privacy Rights Act and the Health Insurance Portability and Accountability Act. X. MODIFICATION OF AGREEMENT I. All modifications to this agreement shall be in writing and signed by both parties. XI. ASSIGNMENTS I. This Agreement shall be binding upon the parties hereto, their successors, theirs, and legal representatives. IN WITNESS WHEREOF, the parties hereunto have caused this Agreement to be duly executed as of the day and year first hereinabove set forth.
