RE: APPROVE VACATION OF USE BY SPECIAL REVIEW PERMIT #1243 - CITY OF
AURORA
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, by Resolution dated November 3, 1999, the Board approved Use by Special
Review Permit#1243 for an Open Cut Gravel Mining Operation in the A(Agricultural)Zone District,
for Golden's Andesite Mining Company, do Paul Gesso, Banks and Gesso, LLC, on the following
described real estate, to-wit:
The SE1/4 of Section 13, Township 1 North,
Range 67 West of the 6th P.M., Weld County,
Colorado
WHEREAS, the Board has received a request from the City of Aurora, do Julie Cozad,
Tetra Tech, 1900 South Sunset Stree, Suite 1-F, Longmont, Colorado 80501, to vacate Use by
Special Review Permit#1243, and
WHEREAS, the Department of Planning Services staff recommends the vacation of Use
by Special Review Permit#1243, since the use is not in operation and the plat was never recorded,
and
WHEREAS,the Board of County Commissioners heard all of the testimony and statements
of those present,studied the request of the applicant and the recommendations of the Department
of Planning Services staff and all of the exhibits and evidence presented in this matter and, having
been fully informed, deems it advisable to approve said vacation.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that Use by Special Review Permit#1243 be, and hereby is, vacated.

SUBJECT: Vacation of USR-1243
The Department of Planning Services has received the attached letter dated December 4, 2007
from Julie Cozad with Tetra Tech representing the City of Aurora. The City of Aurora is
requesting that USR-1243 be vacated since the use is not in operation and the plat was never
recorded.
Background information:
Legal Description: Part of SE4 of Section 13, Township 1 North, Range 67 West of the 6th
P.M., Weld County, Colorado
Location: Approximately 1/2 mile east of CR 23 and north of and adjacent to CR 8.
USR-1243: USR-1243 was approved by the BOCC on November 3, 1999 for an open
cut gravel mining operation in the A (Agricultural) Zone District

RE: City of Aurora,Prairie Waters Project, USR-1582
Condition of Approval 1.C.
Dear Ms. Hatch:
This letter addresses Condition of Approval 1.C. on the Planning Commission Resolution for USR-1582
for the City of Aurora's Prairie Waters project, which states "The applicant shall vacate USR-1243 for a
gravel operation."
We are formally requesting to vacate USR-1243 for the Lewis Farm Open Cut Gravel Mine operation,
which was approved on November 3, 1999. It is my understanding that the plat for this Use by Special
Review was never recorded and the specific use never commenced on the subject property. In a previous
meeting with you, it was indicated that a letter of request would be adequate to meet this condition.
Please contact me to let me know the status of our request and if it will be necessary for me to attend a
meeting with the Board of County Commissioners. Thank you for your consideration of this matter.
