RE: ACTION OF BOARD CONCERNING USE BY SPECIAL REVIEW PERMIT#1565 FOR
AN OIL AND GAS PRODUCTION FACILITY(THREE(3)OIL AND GAS WELLS)IN THE
R-1 (LOW DENSITY RESIDENTIAL) ZONE DISTRICT - TARH E AND P HOLDINGS,
L.P.
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners held a public hearing on the 8th day of
November,2006,at the hour of 10:00 a.m.in the Chambers of the Board for the purpose of hearing
the application of C. B.Keirnes Land Company,c/o TARH E and P Holdings, L.P.,41017th Street,
Suite 1610, Denver, Colorado 80202, for a Site Specific Development Plan and Use by Special
Review Permit#1565 for an Oil and Gas Production Facility(three (3) oil and gas wells) in the
R-1 (Low Density Residential)Zone District on the following described real estate, to-wit:
Parts of Lots C and D of Recorded Exemption#3868;
encompassing the entire W1/2 SE1/4 of Section 23,
Township 6 North, Range 66 West of the 6th P.M.,
Weld County, Colorado
WHEREAS,at said hearing on November 8,2006,the Board deemed it advisable to continue
the matter to December 20, 2006, at 10:00 a.m., to allow adequate time for re-notification of the
request, excluding C. B. Keirnes Land Company, LLC, from the title as applicant, and
WHEREAS,at said hearing on December20,2006,the applicant requested a continuance
to February 21,2007,at which time they requested another continuance to March 28,2007,at which
time they requested another continuance to May 23, 2007, at which time they requested another
continuance to June 20, 2007, to allow additional time to negotiate an Oil and Gas Surface Use
Agreement, and
WHEREAS,on June 20,2007,the Board heard all of the testimony and statements of those
present and reviewed the request of the landowner and,having been fully informed,finds that this
request be continued to August 1, 2007, at 10:00 a.m., to allow the applicant additional time to
complete an Oil and Gas Surface Use Agreement, and
NOW,THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County,Colorado,that the abovementioned matter be,and hereby is,continued to August 1,2007,
at 10:00 a.m.
