The Weld County Public Works Department has reviewed this proposal. This project falls primarily under the
purview of the Use by Special Review Standards, Weld County Code, Chapter 23, Article II, Division 4, Section
23. Our comments and requirements are as follows:
COMMENTS:
Weld County Road Classification Plan (FHU): WCR 2 is a major arterial road, which requires a 140-foot
right-of-way at full build out. There is presently a 60-foot right-of-way. This road is maintained by Adams
County. Pursuant to the definition of SETBACK in the Weld County Zoning Ordinance (23-1-90), the required
setback is measured from the future right-of-way line.
The Parker/Dersham properties are adjacent to the original Hall-Irwin USR-1172.
^EQUIREMENTS:
The applicant has entered into a Road Maintenance and Improvements Agreement with Adams County for the
haul route east from the entrance on WCR 2 (168th Avenue) to U. S. Highway 85. A copy of the approved
agreement should be carried across to this borrow.
A note shall be placed on the plat drawing which states that the applicant shall enter into a Road Maintenance
and Improvement with the Board of County Commissioners if, at any time in the future, maintenance of WCR 2
becomes the responsibility of Weld County.
The applicant shall utilize the existing access to WCR 2 (168th Avenue) as approved in USR=1172.
Setback for mining/reclamation should be determined from future rights-of-way. The standard typical setback
shall be 20 feet fro the property line or future right-of-way.
There shall be no heavy hauling permitted on WCR 23.5 adjacent to the proposed gravel operations. Our
ingress and egress will occur on to WCR 2.
The applicant has provided an existing traffic study. The applicant is indicating that the facility will not generate
any new mining traffic to the system, as they are proposing to move all their aggregate internally by a conveyor
belt or trucking system.
Storm Water Drainage:
e-The historical flow patterns and run-off amounts will be maintained on site in such a manner that it will
easonably preserve the natural character of the area and prevent property damage of the type generally
attributed to run-off rate and velocity increases, diversions, concentration and/or unplanned ponding of storm
run-off.
,The applicant must take into consideration storm water capture/quantity and provide accordingly for best
ianagement practices.
The applicant is required to comply with all Colorado Department of Health and Environmental (CDPHE)
regulations regarding berming and spill prevention for materials and liquids stored on site.
FLOOD HAZARD DEVELOPMENT STANDARDS: This area is in the FEMA Flood Zones.

Environmental Health Services has reviewed this proposal for a mineral resource
development facility in Gravel mining, export and import of materials, scale house and
office. We have no objections to the proposal, however, we do recommend that the
following conditions be part of any approval:
We recommend that the following requirements be met prior to allowing the plat to be
recorded:
1 . The applicant shall submit evidence of an Air Pollution Emission Notice
(A.P.E.N.) and Emissions Permit application from the Air Pollution Control
Division, Colorado Department of Health and Environment, if applicable.
2. The applicant shall submit a dust abatement plan for review and approval, to the
Environmental Health Services, Weld County Department of Public Health &
Environment.
3. The applicant shall provide current evidence that the facility has an adequate
water supply (i.e., well or community water system).
4. The applicant shall submit evidence of a Colorado Discharge Permit System
(CDPS) from the Water Quality Control Division of the Colorado Department of
Health and Environment for any proposed discharge into State Waterways, if
applicable.
5. The applicant shall submit a waste handling plan, for approval, to the
Environmental Health Services Division of the Weld County Department of Public
Health & Environment. The plan shall include at a minimum, the following:
1) A list of wastes which are expected to be generated on site (this should
include expected volumes and types of waste generated).
2) A list of the type and volume of chemicals expected to be stored on site.
3) The waste handler and facility where the waste will be disposed (including
the facility name, address, and phone number).
We recommend that the following requirements be incorporated into the permit as
conditions that must be met one month prior to construction activities:
1. A stormwater discharge permit may be required for a
development/redevelopment /construction site where a contiguous or non-
contiguous land disturbance is greater than or equal to one acre in area. Contact
the Water Quality Control Division of the Colorado Department of Public Health
and the Environment at www.cdphe.state.co.us/wq/PermitsUnit for more
information.
We recommend that the following requirements be incorporated into the permit as
conditions that must be met prior to the issuance of the Certificate of Occupancy:
1. An individual sewage disposal system is required for the proposed office/scale
house and shall be installed according to the Weld County Individual Sewage
Disposal Regulations.
2. The septic system is required to be designed by a Colorado Registered
Professional Engineer according to the Weld County Individual Sewage Disposal
Regulations.
We recommend that the following requirements be incorporated into the permit as
development standards:
1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and
Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for
final disposal in a manner that protects against surface and groundwater
contamination.
2. No permanent disposal of wastes shall be permitted at this site. This is not
meant to include those wastes specifically excluded from the definition of a solid
waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S.,
as amended.
3. Waste materials shall be handled, stored, and disposed in a manner that controls
fugitive dust, fugitive particulate emissions, blowing debris, and other potential
nuisance conditions.

4. The applicant shall operate in accordance with the approved "waste handling
plan".
5. Any vehicle washing area(s) shall capture all effluent and prevent discharges
from drum washing and the washing of vehicles in accordance with the Rules
and Regulations of the Water Quality Control Commission, and the
Environmental Protection Agency.
6. Fugitive dust and fugitive particulate emissions shall be controlled on this site.
The facility shall be operated in accordance with the approved dust abatement
plan at all times.
7. This facility shall adhere to the maximum permissible noise levels allowed in the
Industrial Zone as delineated in 25-12-103 C.R.S., as amended.
8. A permanent, adequate water supply shall be provided for drinking and sanitary
purposes.
9. Bottled water shall be provided to employees at the temporary locations of the
working face at all times.
10.Adequate handwashing and toilet facilities shall be provided for employees and
patrons of the facility.
11.Sewage disposal for the facility shall be by septic system. Any septic system
located on the property must comply with all provisions of the Weld County Code,
pertaining to Individual Sewage Disposal Systems.
12.Portable toilets may be utilized on sites that are temporary locations of the
working face and portable processing equipment, etc. for up to six months at
each location.
13.The applicant shall remove, handle, and stockpile overburden, soil, sand and
gravel from the facility area in a manner that will prevent nuisance conditions.
14.If applicable, the applicant shall obtain a stormwater discharge permit from the
Colorado Department of Public Health & Environment, Water Quality Control
Division.
15.The operation shall comply with all applicable rules and regulations of the
Colorado Division of Minerals and Geology.
16.The operation shall comply with all applicable rules and regulations of the State
and Federal agencies and the Weld County Code.

Dear Ms. Hatch:
• This referral does not appear to qualify as a "subdivision" as defined in Section 30-
28-101(10)(a), C.R.S. Therefore, pursuant to the State Engineer's March 4, 2005
memorandum to county planning directors, this office will only perform a cursory review of
the referral information and provide comments.
According to the mining permit application filed with the Colorado Division of
Reclamation Mining and Safety for the proposed operation, the Gravel Mining operation will
cause depletions to the South Platte River due to evaporative losses from exposed ground
water and operational losses. A Substitute Water Supply Plan (SWSP) or court
approved augmentation plan must be obtained to replace the depletions caused by
the operation. Additionally, a well permit must be obtained for the gravel mining
operation prior to exposing ground water.
Gravel pit operators typically must first obtain approval from the Colorado Division of
Reclamation Mining and Safety prior to mining. As part of that process the applicant will
need to address the potential concerns of State Engineer's Office as they relate to water
rights.

Site Specific Development Plan and a Use by Special Review Permit for a Mineral Resource Development facility
including Gravel Mining, export & import of materials, scale house and office in the A(Agricultural)Zone District.
1. A building permit shall be obtained prior to the construction or placement of any structure such as the scale house
and office. An electrical permit will be required for any electrical service to equipment. A plot plan shall be submitted
when applying for building permits showing all structures with accurate distances between structures, and from
structures to all property lines.
2. A plan review is required for each building for which a building permit is required. Plans shall bear the wet stamp of a
Colorado registered architect or engineer. Two complete sets of plans are required when applying for each permit.
3. Buildings shall conform to the requirements of the various codes adopted at the time of permit application. Currently
the following has been adopted by Weld County:2006 International Building Code;2006 International Mechanical Code;
2006 International Plumbing Code;2005 National Electrical Code;2006 International Fuel Gas Code and Chapter 29 of
the Weld County Code.
4. Each structure set on a foundation will require an engineered foundation based on a site-specific geotechnical report
or an open hole inspection performed by a Colorado registered engineer. Engineered foundations shall be designed by a
Colorado registered engineer.
5. Building wall and opening protection and limitations and the separation of buildings of mixed occupancy classifications
shall be in accordance with the Building Code. Setback and offset distances shall be determined by the Zoning
Ordinance.
6. Building height shall be measured in accordance with the Building Code for the purpose of determining the maximum
building size and height for various uses and types of construction and to determine compliance with the Bulk
Requirements from Chapter 27 of the Weld County Code. Building height shall be measured in accordance with Chapter
23 of the Weld County Code in order to determine compliance with offset and setback requirements. Offset and setback
requirements are measured to the farthest projection from the building.
7. Provide letter of approval from Brighton Fire Protection District prior to new construction.
9. There are no historical building permits on record for these parcels.

The Sheriffs Office recommends the following improvements for this business:
1. Mail distribution for the business should be limited to as few locations as possible with a central
drop off location within the property. It should be developed so that residents do not have to
cross a county road to obtain their mail.
2. A permanent sign should be placed at the entrance to the property that meets the planning and
zoning standards and is approved by the county commissioners, detailing the name of the
j1 business, address, and a graphical presentation of the roadways within the property. There
should be a plan developed to maintain this sign.
3. If the roadways within this property are not maintained or adopted by the county, individuals
residing on this property should be made aware that the Sheriffs Office will have
limited traffic enforcement powers in regard to traffic complaints.
4. A plan should be developed to maintain roadways on the property,especially during
inclement weather conditions for emergency vehicles.
5. If there are oil or gas production facilities within this property, they need to be fenced off in
order to mitigate the potential for tampering. These facilities are known to create an attractive
nuisance for young people. Tampering not only creates a significant danger to safety but also of
environmental damage with extensive mitigation and clean-up costs.
6. If you intend to name any of the roads on the property you should be present these names to
the Sheriffs Office for approval. This will eliminate duplication of street names within the county.
If you do name any of the roads they will need to be properly marked with clearly visible
reflective signs.
The Sheriff's Office lacks the ability to absorb any additional service demand without the resources
recommended in the multi-year plan provided to the Weld County Board of County Commissioners or as
indicated by growth not considered at the time the plan was developed. I have no other comments on this
proposal.

Thank you for your referral letter dated April 16, 2007 regarding the proposed gravel mining
operation by Parker/Dersham-Hall-Irwin Corporation. Weld County participates in the National
Flood Insurance Program, and Community Panel No. 080266 0955 C identifies the Special Flood
Hazard Areas (SFHA) affected by the project.
The project takes place within the SFHA as shown on the attached Flood Insurance Rate Map. No
base flood elevations are given, and no floodway is delineated for this reach. The applicant is
reminded that ANY work performed in an SFHA requires the issuance of a Floodplain Development
Permit (FDP). This may require certain conditions according to local ordinances. An FDP should
be obtained from the Weld County prior to the beginning of construction.
