This project falls primarily under the purview of the Use by Special Review Standards, Weld County Code, Chapter 23, Article II, Division 4, Section 23. Our comments and requirements are as follows: COMMENTS: Weld County Road Classification Plan (FHU): WCR 2 is a major arterial road, which requires a 140-foot right-of-way at full build out. There is presently a 60-foot right-of-way. This road is maintained by Adams County. Pursuant to the definition of SETBACK in the Weld County Zoning Ordinance (23-1-90), the required setback is measured from the future right-of-way line. The Parker/Dersham properties are adjacent to the original Hall-Irwin USR-1172. ^EQUIREMENTS: The applicant has entered into a Road Maintenance and Improvements Agreement with Adams County for the haul route east from the entrance on WCR 2 (168th Avenue) to U. S. Highway 85. A copy of the approved agreement should be carried across to this borrow. A note shall be placed on the plat drawing which states that the applicant shall enter into a Road Maintenance and Improvement with the Board of County Commissioners if, at any time in the future, maintenance of WCR 2 becomes the responsibility of Weld County. The applicant shall utilize the existing access to WCR 2 (168th Avenue) as approved in USR=1172. Setback for mining/reclamation should be determined from future rights-of-way. The standard typical setback shall be 20 feet fro the property line or future right-of-way. There shall be no heavy hauling permitted on WCR 23.5 adjacent to the proposed gravel operations. Our ingress and egress will occur on to WCR 2. The applicant has provided an existing traffic study. The applicant is indicating that the facility will not generate any new mining traffic to the system, as they are proposing to move all their aggregate internally by a conveyor belt or trucking system. Storm Water Drainage: e-The historical flow patterns and run-off amounts will be maintained on site in such a manner that it will easonably preserve the natural character of the area and prevent property damage of the type generally attributed to run-off rate and velocity increases, diversions, concentration and/or unplanned ponding of storm run-off. ,The applicant must take into consideration storm water capture/quantity and provide accordingly for best ianagement practices. The applicant is required to comply with all Colorado Department of Health and Environmental (CDPHE) regulations regarding berming and spill prevention for materials and liquids stored on site. FLOOD HAZARD DEVELOPMENT STANDARDS: This area is in the FEMA Flood Zones. pc: USR-1611 USR-1172 M:\PLANNING-DEVELOPMENT REVIEW\USR-Use by Special Review\USR-1611.doc a MEMORANDUM it TO: JACQUELINE HATCH, PLANNING SERVICES FROM: CHARLOTTE DAVIS, ENVIRONMENTAL HEALTH '11 C CORPORATION SUBJECT:USR-1611 PARKER/DERSHAM-HALL-IRWIN COLORADO DATE: 05/17/2007 Environmental Health Services has reviewed this proposal for a mineral resource development facility in Gravel mining, export and import of materials, scale house and office. Water Division 1, Water District 2 Dear Ms. Hatch: • This referral does not appear to qualify as a "subdivision" as defined in Section 30- 28-101(10)(a), C.R.S. Therefore, pursuant to the State Engineer's March 4, 2005 memorandum to county planning directors, this office will only perform a cursory review of the referral information and provide comments. According to the mining permit application filed with the Colorado Division of Reclamation Mining and Safety for the proposed operation, the Gravel Mining operation will cause depletions to the South Platte River due to evaporative losses from exposed ground water and operational losses. A Substitute Water Supply Plan (SWSP) or court approved augmentation plan must be obtained to replace the depletions caused by the operation. Additionally, a well permit must be obtained for the gravel mining operation prior to exposing ground water. Gravel pit operators typically must first obtain approval from the Colorado Division of Reclamation Mining and Safety prior to mining. As part of that process the applicant will need to address the potential concerns of State Engineer's Office as they relate to water rights. Should you have any questions, please contact Joanna Williams of this office. Sincerely, QQ Kevin G. Rein, P.E. Broderius Date: April 29,2007 Re: USR-1611 The Sheriffs Office recommends the following improvements for this business: 1. Mail distribution for the business should be limited to as few locations as possible with a central drop off location within the property. It should be developed so that residents do not have to cross a county road to obtain their mail. 2. A permanent sign should be placed at the entrance to the property that meets the planning and zoning standards and is approved by the county commissioners, detailing the name of the j1 business, address, and a graphical presentation of the roadways within the property. There should be a plan developed to maintain this sign. 3. If the roadways within this property are not maintained or adopted by the county, individuals residing on this property should be made aware that the Sheriffs Office will have limited traffic enforcement powers in regard to traffic complaints. 4. A plan should be developed to maintain roadways on the property, especially during inclement weather conditions for emergency vehicles. 5. If there are oil or gas production facilities within this property, they need to be fenced off in order to mitigate the potential for tampering. These facilities are known to create an attractive nuisance for young people. Tampering not only creates a significant danger to safety but also of environmental damage with extensive mitigation and clean-up costs. 6. If you intend to name any of the roads on the property you should be present these names to the Sheriffs Office for approval. This will eliminate duplication of street names within the county. If you do name any of the roads they will need to be properly marked with clearly visible reflective signs. The Sheriff's Office lacks the ability to absorb any additional service demand without the resources recommended in the multi-year plan provided to the Weld County Board of County Commissioners or as indicated by growth not considered at the time the plan was developed. I have no other comments on this proposal. r67„c_m _ 0N -P-7- 617 • STATE OF COLORADO Colorado Water Conservation Board oRCON%p Department of Natural Resources Weld County Planning Department q°: • '')% 1313 Sherman Street,Room 721 GREELEY OFFICE o a -. a ' o Denver,Colorado 80203 t, a •,'• Phone:(303)866-3441 MAY 3 1 2007 • FAX:(303)866-4474 .1937 ' www.cwcb.state.co.us RECEIVED Bill Ritter,Jr. May 23, 2007 Governor Harris D.Sherman Jacqueline Hatch Executive Director Weld County Department of Planning Services Rod Kuharich 1555 N. 17th Ave. CWCB Director Greeley, CO 80631 Dan McAuliffe Deputy Director Thank you for your referral letter dated April 16, 2007 regarding the proposed gravel mining operation by Parker/Dersham-Hall-Irwin Corporation. The project takes place within the SFHA as shown on the attached Flood Insurance Rate Map. No base flood elevations are given, and no floodway is delineated for this reach.
