COLORADO June 26, 2007 Howard Cantrell 11016 County Road 23 Fort Lupton, CO 80621 RE: Weld County Road 24 Corridor Study Dear Dear Mr. Cantrell: Thank you for your letter dated June 6, 2007, regarding our Weld County Road 24 Corridor Study. It is our understanding that the alignment chosen for the future roadway (Alternative #4) could encroach on your property depending on the exact horizontal location chosen. Please understand that we are not currently in the process of designing this roadway to enough detail to determine the exact horizontal alignment and therefore cannot offer you a fair market compensation for the Right of Way necessary for the roadway. At the same time, we can assure you that one of the goals of any future roadway design would be to minimize the disruption to private property to the greatest extent possible. We are charged with the responsibility to design the safest, most cost effective roadway as possible. This requires us to avoid costly R.O.W. purchases whenever possible. To make an exact determination of the horizontal location of this roadway at this time would not be an effective use of County Resources. As stated in the report and at the Open House meetings, the roadway is not currently in the five (5) year plan and no development plans are pending that would require the necessary R.O.W. reservations. We can also assure you that our Public Works and Planning staff will continue to keep you informed of any future development that would require this roadway to be constructed. Although we are not opposed to the road going through this area,certain conditions must be meet to enable us to continue living in our home. The road would need to be moved 200 feet south of our property line. At this time there is open land to the south of our property with no building structures. Allowing us to keep the 30 foot easement from the property line would enable us to construct a dirt berm for noise abatement. Any further encroachment onto out property beyond said 30 foot easement would cross over the septic leach field which was approved by the county and force the evacuation of our home. Should that be the case we feel we should be compensated at this time so that we would be able to build a new home. If we wait for compensation until the actual construction of the road we would no longer be physically able to do the construction. In any case we need some type of decision in writing so that we can continue construction projects in our current home or plan construction of a new home. We understand the need for progress but feel it should not come at the cost of private ownership without just treatment and compensation. Such a small deviation in the alignment of the road could enable us to stay in the home we love.
