RE: APPROVE DIRECTING PAYMENT OF COLLATERAL TO WELD COUNTY BOARD OF
COMMISSIONERS REGARDING IMPROVEMENTS TO COUNTY ROAD 38 - PLATTE
SAND AND GRAVEL, LLC
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS,on December 8, 2004, by Resolution#2004-3421,the Board approved a Long
Term Road Maintenance and Improvements Agreement for County Road 38 between the County
of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County,
and Platte Sand and Gravel, LLC, 1300 Harlan Street, Lakewood, Colorado 80215,with terms and
conditions being as stated in said agreement, and
WHEREAS, on June 19, 2006, by Resolution #2006-1655, the Board of County
Commissioners of Weld County, Colorado, approved Collateral for said Long Term Road
Maintenance and Improvements Agreement for County Road 38, and accepted Irrevocable Letter
of Credit#00345, drawn on Centennial Bank of the West, 2700 47th Avenue, Greeley, Colorado
80634, in the amount of$911,042.00, and
WHEREAS, on September 13, 2006, by Resolution #2006-2572, the Board of County
Commissioners approved a partial release of said collateral, in the amount of $460,000.00;
retaining $451,042.00, and
WHEREAS, on January 17, 2007, by Resolution #2007-0187, the Board of County
Commissioners approved a partial release of said collateral, in the amount of $268,833.60;
retaining $182,208.40, and
WHEREAS, staff from the Weld County Department of Public Works has conducted a
visual inspection and does not recommend release of said remaining collateral to Platte Sand and
Gravel, LLC, due to the reasons set forth in a letter addressed to Platte Sand and Gravel, LLC,
dated July 2, 2007, from County Engineer Drew L. Scheltinga, a copy of that letter is attached to
this Resolution and made a part hereof, and
WHEREAS, a letter was sent on October 2, 2007, by Pat Persichino, Director of the
Department of Public Works, to Russell B. Sanford, the attorney for Platte Sand and Gravel, LLC,
which letter reiterated the position of the County that Platte Sand and Gravel, LLC, was, and is,
obligated to complete the work described in Mr. Scheltinga's letter of July 2, 2007, and
WHEREAS, one letter was sent to Mr. Sanford on October 16, 2007, advising that the
matter would be set before the Board for a hearing, and a final letter was sent to him on
October 23, 2007, confirming that the Board would take up the matter of the collateral at a meeting
on October 31, 2007, and

WHEREAS, a hearing before the Board was held on the October 31, 2007, at which time
the Board deemed it advisable to continue the matter to November 5, 2007, at 9:00 a.m., to allow
the Department of Public Works to obtain additional information from surrounding property owners,
and
WHEREAS, at said hearing on November 5, 2007, Tom Sharkey, Platte Sand and Gravel,
LLC, and Attorney Russell Sanford, were present and provided testimony, and
WHEREAS, the Board has heard testimony from the Weld County Department of Public
Works that the incomplete work will cause the road to deteriorate more quickly than if the work was
completed, and that the incomplete work creates a potential safety hazard to the citizens of Weld
County and to other users of County Road 38, and
WHEREAS, it has been determined by the Board that the remaining collateral being held
by Centennial Bank of the West for the benefit of Weld County is necessary to secure said Long
Term Road Maintenance and Improvements Agreement for County Road 38, and
WHEREAS, the Board has the right, under the terms of the Long Term Road Maintenance
and Improvements Agreement for County Road 38, to request that Centennial Bank of the West,
2700 47th Avenue, Greeley, Colorado 80634, pay the remaining collateral in the account of Platte
Sand and Gravel, LLC, for Irrevocable Letter of Credit#00345, in the amount of$182,208.40, to
the Weld County Board of Commissioners.
NOW THEREFORE BE IT RESOLVED by the Board that Platte Sand and Gravel, LLC, has
not completed the improvements to County Road 38, pursuant to the terms of the Long Term Road
Maintenance and Improvements Agreement.
BE IT FURTHER RESOLVED by the Board that the following improvements required
through the Long Term Road Maintenance and Improvements Agreement, shall be completed by
the Department of Public Works, or its contractors:
1. Removal or relocation of existing pond at STA -22+50;
2. Removal or relocation of existing pond at STA -74+50;
3. Replacement of cross culverts at STA -9+00 and 14+00 (18" and 24" RCP,
respectively), according to plan;
4. Repair damages to concrete lined ditch;
5. Clean all roadside culverts and barrow ditches of debris and gravel so that drainage
is not impeded;

6. Removal of small piles of material from the SE and SW corners of the intersection
of CRs 25 and 38, adjacent to the gas facility and ditches;
7. Clean spoils from roadway surface at the culvert entry (Paul Gonzales property);
and
8. Relocation of the ditch adjacent to the residence located at the NW corner of the
intersection of CRs 25 and 38, in a manner acceptable to the property owner and
Weld County.
BE IT FURTHER RESOLVED by the Board that the Department of Public Works shall not
be required to relocate the concrete ditch located along the north side of County Road 38, for a
distance of approximately one-half mile west of County Road 25.
BE IT FURTHER RESOLVED by the Board that Centennial Bank of the West, 2700 47th
Avenue, Greeley, Colorado 80634, be, and hereby is, requested to direct payment of remaining
collateral in the account of Platte Sand and Gravel, LLC, for Irrevocable Letter of Credit#00345,
in the amount of $182,208.40, to the Weld County Board of Commissioners, to pay for the
necessary improvements to be completed by the Department of Public Works on County Road 38.
The above and foregoing Resolution was, on motion duly made and seconded, adopted by
the following vote on the 5th day of November, A.D., 2007.

Improvements
Dear Bruce:
Our firm represents Platte Sand and Gravel, LLC.
I have been communicating with Stephanie Arries, regarding the above-referenced
matter. In early October, I requested an informal work session with the Board of County
Commissioners, for the purpose of discussing my client's understanding with respect the
completion and satisfaction of their obligations regarding WCR 38 improvements. For
your information, my client disagrees with the conclusions drawn by the Weld County
Engineering Department, which conclusions we can only assume were conveyed to the
Board at the private work session described below. Stephanie advised me as follows:
1. The Board of County Commissioners was scheduled to hold a work session
regarding the matter; however, we were not invited or entitled to attend
that meeting.
2. Stephanie advised that she would ask the Board of County Commissioners
whether they would be willing to hold an informal work session with us
prior to the October 31, 2007, Board meeting in order to allow my client to
tell its side of the story.
By letter dated October 23, 2007, (two days ago), we were advised that the matter
would be heard by the Board of County Commissioners on October 31, 2007, and by
inference, the Board of County Commissioners was not willing to hold a work session
with us.

Unfortunately, several of the individuals who were substantially involved in the
preconstruction and construction phases of the project are not available to attend the
hearing on October 31, 2007.
I asked Stephanie for a two (2) week extension of the Board's hearing. She
advised that the Board wanted immediate resolution of the WCR 38 issues, and that a two
(2) week extension was improbable. I then requested an extension of the Board's hearing
from next Wednesday to the following Monday, November 5, 2007. Stephanie advised
that I am required to formally request the extension through you, because the Board of
County Commissioners is apparently the only authority entitled to grant the requested
extension.
Please consider this letter as my client's formal request for an extension of the
scheduled Wednesday, October 31, 2007, hearing until Monday, November 5, 2007.
Although, I would prefer a more reasonable extension of two (2) weeks if the Board
is so willing to grant the request. I cannot imagine that a five (5) day extension (or
hypothetically, a two (2) week extension, if the Board is so willing), in any way impairs
the interests of your client, Weld County.

RE: WCR 38 — PS&G Final Inspection / Collateral Release Request
Mr. Pike:
Upon consideration of your request for release of the remaining funds held in collateral related
to the improvements project constructed by your company, we have compiled a list of
uncompleted items as they are shown on the approved plans dated 6.24.05. Additional copies
are available. They are as follows:
• Remove/ relocate existing irrigation ditch to outside of 60' ROW from STA 1+50 to
8+75 LHS. Relocation should be coordinated with property owner
• Remove/ relocate existing irrigation ditch to outside of 60' ROW from STA 5+00
(9+00?)to 14+25 RHS. Relocation should be coordinated with property owner.
• Remove/ relocate existing irrigation ditch to outside of 60' ROW from STA 14+25 to
53+50 LHS. Relocation should be coordinated with property owner.
• Remove / relocate existing pond at STA -22+50. Work to be coordinated with property
owner.
• Remove / relocate existing pond at STA —74+50. Work to be coordinated with property
owner.
• It does not appear as the cross culverts at STA —9+00 and 14+00 (18" and 24" RCP,
respectively) have been replaced according to plan.
• Stop signs at WCR 25 / 38 only 5.5' above ground presently. They need to be a
minimum of 7' off the ground to bottom of sign. Signs should also be installed per
CDOT post requirements.
• Clean all roadside culverts of debris and gravel so that drainage is not impeded.
• Remove small spoil piles of material from SE and SW corners of WCR 25 / 38 adjacent
to gas facility and ditches
• Clean spoils from roadway surface @ Paul Gonzales culvert entry.
Weld County Public Works Staff is currently reviewing the speed control and all pertinent
traffic study related issues. The County will be in contact as soon as a decision is made.
Please contact me 48 hours in advance of any work commencing.

Dear Mr. Sanford:
This letter is written to you with regard to the obligations of your
client, Platte Sand & Gravel, (PS&G) , to complete the work on Weld
County Road 38 according to the terms of the contract between PS&G and
the Board of County Commissioners of Weld County, and with regard to
its ongoing maintenance obligation.
It is imperative that these matters be resolved immediately, as there
are provisions in the contract regarding the expiration of the one year
period following the release of eighty-five percent, (85%) of the
original collateral. In addition, there are provisions in the contract
which address PS&G's ongoing maintenance obligation for the road.
These matters shall be heard by the Board of County Commissioners of
Weld County on the 31a` day of October at the hour of 9:00 a.m. At that
time, the Board will hear a request by the Weld County Department of
Public Works to draw on the remaining collateral so that Weld County
may use the funds to complete the construction of Road 38, and will
hear proposals by the Department as to the implementation of a program
of maintenance of the road. It would be in the best interests of your
client to attend the meeting.

This matter has,been discussed with two former employees of the Weld.County Pblic Works
Department, and:.one current employee,who participated in many of the meetings_with the Platte
Sand 8c Gravel employees, All three have stated unequivocally that the Weld county never
abandoned its;position that the irrigation ditches and ponds.were to be removed and relocated.
All three have stated that at every meeting, Weld-County's position was that Platte Sand &
• Gravel would address those matters..affter the growing season,.so-that the affected farmers would
not be adversely affected. At no time did the County•orits:representatives relieve Platte:Sand &.
Gravel of its,obligations under the:contract.
,:Any:further discussion.regarding.:legal or contractual matters should be::pursued with Stephanie
Ames with the Weld'County Attorney''s office.

Re: Request for Release of Collateral for WCR 38 Road Improvements; Platte River
Sand and Gravel; PEI No. 05-02
Dear Mr. Scheltinga:
Thank you for meeting with us recently at the project site. The purpose of the meeting
was to review whether the project improvements have been satisfactorily completed by my
client, Platte River Sand and Gravel, and whether remaining funds held as collateral for the
related improvements can be released by Weld County. The principal issue appears to be
whether, or not, Platte River Sand and Gravel was required to remove and relocate the existing
irrigation ditch adjacent to WCR 38. In that regard we enclose a letter from Pickett Engineering,
Inc., (R. Sean Phipps, PE) to you, describing the preconstruction meeting with the Public Works
Department, and follow-up conversations and correspondence between Pickett Engineering and
the Public Works Department (the"Pickett Letter"). We have designated the Pickett Letter as
attachment No. "1" to this letter and the letters and profiles attached to the Pickett Letter as Nos.
"la", "lb", and"ic", respectively.
While neither you nor I were participants in the preconstruction meeting, or the
subsequent discussions and correspondence between Pickett Engineering and the Public Works
Department, the (i) Pickett Letter, (ii)the attachments to the Pickett Letter, and (iii) and the
following correspondence and documentation which transpired between the parties, document
the agreement of the County and Platte River Sand and Gravel that the removal and relocation of
the existing ditch line in question was no longer a project requirement.
Please consider the following additional documentation in this regard:
1. Letter dated July 12, 2006, from Perry Eisenach, PE, the Weld County Public
Works Department to Mr. Tim Pike, of Platte River Sand and Gravel (referenced
as attachment No. "2'D. In his letter, Mr. Eisenach states that he will not allow
installation of the final asphalt lift until all of the roadside drainage ditches,
culverts, dry wells, etc., and all utilities are relocated.
2. PRS&G Punch List, dated August 20, 2006, (referenced as attachment No. "3").
As you can see from the punch list, the removal and relocation of the irrigation
ditches is no longer a requirement. Please also note, that the specific irrigation
exemption matters include "correct shoulders at along concrete line ditch". A
requirement to correct the shoulders would not make any sense if the corrective
work and the ditch were required to be ripped out.
3. August 30, 2006 letter from Mr. Tracy A. Dyer, Lead Construction Inspector,
Weld County Public Works (referenced as attachment No. "4"). In his letter, Mr.
Dyer gives formal approval to commence top lift paving subject only to very
specific conditions, none of which included the relocation or removal of irrigation
ditches. His letter also evidences satisfaction of the commencement of paving
conditions required by Mr. Eisenach in his letter of July 12, 2006 (attachment No.
"2"referenced above).
4. PRS&G Punch List, dated September 21, 2006 (referenced as attachment No.
"5"). Again, the removal and relocation of the irrigation ditches is no longer a
requirement. Also, please note the reference on the second page of the punch list
regarding STA 52+80 TO 55+75, which requires correction of shoulders from
concrete line to ditch, as a post irrigation improvement exemption. Again, a
requirement to correct the shoulders would not make any sense if the corrective
work and the ditch were required to be ripped out.
5. Memorandum dated January 3, 2007, from Tracy Dyer to David Bauer, with
copies to Tim Pike and Josh Holbrook, (referenced as attachment No. "6"). In
this memorandum, Mr. Dyer states that he is willing to sign off on the project
subject to five (5) specific conditional terms, none of which include the removal
or relocation of irrigation ditches. In his memorandum Mr. Dyer confirms that
the project is acceptable and complete with respect to the road portion of the
project, Mr. Dyer states:
"While the road is far from perfect, it is complete in
consideration of the fact that ninety five percent (95%)
of the traffic utilizing this road will be trucks from
PRS&G, the road, in its state, is a glorified haul
road. There are several surface irregularities to
this project, however, with consideration/review
of the project with Public Works department members,
it is, in my opinion, to allow the road to stand as is. "
6. Resolution of the Board of Weld County Commissioners, dated January 17, 2007,
(referenced as attachment No. "7"). By the Board's resolution, all but twenty
percent (20%) of the completion bond collateral was released to Platte River Sand
and Gravel as a result of the inspection and approval of the County Road 38
improvements.

meeting was to review the project history:.nd to discus theitems listed on the County's letter to
Platte Sand and Gravel dated Jul) 2,2(X)7. During*..jitonstruction meeting on.May 26,,
2006.one of the construction issueslitiatissed was Platte.S and Gravel's request that the
construction plans be revised to permit them to make drainage improvements to the madway
without hating to impact existing irrigation_ditches. During the meting,Perry Eisenach,former
engineer with Weld County,agreed to consider this request„ As a result,the road plan and
profile sheets C-5.I through C-5.8 were revised and resubmitted for approval to Tracey Dyer of
Weld County on June 6.2007. A follow-up letter was then sent to Perry Eisenach on June 9,.
2006Oo su attmartze all of the changes made to the plans as a result ofihe coordination that took
place during the pre-construction meeting. A.copy of the:follow-up letter and a copy of the
preliminary and revised road plan and profile sheet C-5.1 are attached to this letter for your
review.
The second page of the attached letter outlines the revisions made to the proposed drainage
improvements based on the coordination during the pre-construction meeting. At the end of the
first full paragraph.the letter states that the listed changes were made."In order to avoid.
affecting existing irrigation ditches_.." In addition, the labeling on the plan and profile sheets
was revised, On the preliminary plans,all of the: labels identifying the existing irrigation ditches
located within the right-of-way were called out as"REMOVE/RELOCATE". On the rewind
plate all of these labels were modified to read-1ZEM JYE RELOCATE(AS REQUIRED)".
As a result of maintaining the existing location of the irrigation ditches,the culverts at stations
8+90 and 14+26 did not require extensions.

The attached letter also describes the coordination that Plane Sand and Gravel had with the
adjacent property owner at station 22'H-50 regarding.are existing irrigation and on the south side
of the road. The first full paragraph on page three of the attached letter describes the request to
eliminate a proposed dry well to permit runoff from the roadway to be.conveyed directly to an
existing irrigation ditch.
I hope this letter and the attachments clearly convey the coordination that took place with the
County during and after the pre-construction meeting to eliminate the requirement for the
relocation of the irrigation ditches from the scope of the proposed road improvements. If you

Terracon. The fax indicated that. based on 21 shallow test borings that were drilled through the

Highway 60,it appears that a Hot Mix Asphalt lA;) of fie inches would provide the required
structural number for WCR 38.. In order to consider this proposed change to the approved
paving section;you requested copks of the final geotechnical engineering and updated plan and
profile sheets to review. I believe that by now you have received Terracon's final geotechnicai
etcgineetrinc report.,ktich should support the use of live inches of MIA on top of the existing
road surface. Om the afternoon of June 6. I delivered remised construction drawings to Tracy
Dyer r of your office. This letter is intended to.serve as a follow-up to that submittal and to
summarize the information that was revised.
The plan and prrorJc sheets C_' t through C-5.14 that were delivered to Mr. Dyer indicate the
final centerline profile elevation of the roadway resulting.from.the construction o1 five inches of
H.MA on top of the existing surface. For the remainder of this center,this will be referred to as the
final made profile. The final crude profile was generated based on an as-huih survey that was
Bert;rated by surveying spot'elevations every i 00 feet along the edge of pavement of the.existing;
roadway. You wile notice:that along the majority of the roadway,the final grade profile is
typically parallel to and slightly lower than the approved design erade. When reviewing this

pavement section will not be impacted by the final grade profile being slightly lower that the
approved design grade. The structural integrity of the roadway is more directly related to the
proposed drainage improvements in the adiact,nt roadside swales. The gtading of the roadside
drainage improvements is independent of the road cen•terlirte and should not be impacted by the
lower final grade profile. The approved design grade was initially designed to be as favorable a5
possible given the e1.isting topography. The intent was tch minimize the:amount of cut and till
that would be required for this project with the expectation that.the existing grade would
typically be raised by approximately l2!,. iraches,based on the preliminary pavement design.
the resultant design orate was relatively flat with the centerline having a grade of less tharh
0.51,6 on average. Since the.approved design.Bade is so fiat,we do not anticipate any issues
related to safety or driver comfort.resulting from the slightly lower final profile grade:, Please
notice on the revised.plans that areas alone the final grade profile that appear to.have sliciht dips
or abrupt charge!;in the vertiea!alignrt]m I have been noted as tegtlh°ing additional leveling. We
•have also called for additiotral leveling,in critical areas such as approaches to intersections with
\ CR 25 and WC K 25.5.
As ti result of the final grail prof-11a being sli tlyy lower than the approved design grade and
from some of the observations that were made at the site:during,the pre-construction meeting, we
have trade some changes to the design of the roadside ditches. As indicated on the revised
plans,we have lowered some of the high points in the adjac ni roadside ditches, These[flanges
wem made to help maintain a minimum vertical difference of six.inches between the edges of
•
shoulder and ditch flow lines.thereby helping the adjacent hatches maintain a defined.shape even
at the high points.. As a result, some of tlae adjacent roadside ditches will have a flatter flow Tine
slope—but at no point shall any flow line be flatter than 02%. In order its avoid affecting
e►:fisting irrigation ditches and to eliminate the need fhr dry wells(that tvtre proposed to be 20
t deep), we have made. the followinu changes:
1. The dry well that vw'a5 proposed on the south side of the roadway 3t Sta. 12+41 has been
moved to the east to Sta. 17.00.
2. An additional drr well has been added on the north.side.of the roadway at Sta. 17+00.
3.. The dryweils proposed for both sides of the roadway at Sta. 22+63 have been moved to
Sta. 23+50 and reduced to 10J-toot depths.
-1. An additional dry well has been added on the south side of the roadhvva} at Sta. 72+-00,
5. The dry well that was proposed on the ,ouin side of the roadway at Sta. 7 +,75 has been
moved to the east to Sta. 734-95 and..reduced to a 10-foot depth.
6. An additional dry well has been added on the south side of the roadway at Sta 99+00.
7. The dry well that was proposed on the south side oft the.roadway at Sta. 103- has been
reduced to a 1.0-font depth.
We have also modified the dry well detail shown on C-9.1 to reduce the amount of perforations
in the walls of the dry well. The one-foot-on-ctnttr..pacing shown previously wzs chosen based
on our expectation that •this sprieing would he understood clearly and not create any confusion

durint4 cot traction. We did not anticipate that the excess of perforations would result in a
sitmiticaut crass incrt a c: the spacing shown on the revised detail is still more than adequate and
ovi`ll result in a more efficient use of the contractor's time and money, The soils surrounding, the
dry AVMs.arc actually the controlling factor for the infthrttion rate as noted.in the drainage
report. The revised detail now shows 24. one-inch perforations—k yigttit'tcant reduction front the
108.one-inch perforations that we had ns rti ati•.e'y shown on the previous detail. Mr. Pike
has been coordinating with our office to evaluate an alternative dr. well design using a non-
woven aeotextile fabric to wrap the cokumn of stone in lieu of instilling a perforated metal pipe.
Kris Pickett of our office has cautioned Tin that while the proposed alternative should function
adequately,it may prove difficult to construct. We have recnmm.ended that if Tim.wishes to use
this alternative he use Contech's C-4ON 'non-woven geotextile fabric or equivalent. Although
we do not currently have a detail prepared for this alternative, we request your consideration of
this option.
An adjacent property owner has suggested one final drainage design alternative that we would
life you to consider. I ant sure that you are aware that many of the farmers in this area have been
relying on wells as a stwee of irrigation water. I ani stare that you are also ate re that the state
was forced to shut down more than 400 such well: in May of this year. As a result.an adjacent
propety owner has suggested to Tim Pike that the dry well proposed for the south side of the
roadway at Ste. 23-50 be eliminated and the runoff from the roadside ditch be allowed to flaw
into an existing irrigation pond located on the south side of the roadway at SW- 22- 50. Our
office thought this seemed to be a positive alternative,especially since it was prr7pcised by the
property owner; however, we would recommend that the property owner provide a draua;e
easement at this location.permitting this stormwater discharge from the roadside ditch onto their
property.
In addition to the eereding and drainage revisions shown on the current plan.and ptroJle-s,we have
noted that the improvements to the intersections at WCR 23 and WCR_5.3 are proposed to be
constructed in the fall of this year once the irrigation ditches are no longer flowing We have
also noted that paving construction may stop at Sta. 105+91 just west of Highway 60, as tjte
hnprovettcttus to this intersection are coordinatc,-d with the Colorado Dep truneslt of
'Transportation(CDO'I'F. Fk*wever.when I reviewed these plans with Mr. Dyer,he expressed
his preference that the pavingin this area be completed at the same time as the improvements
immediately west ill this intersection. As cumrently sho'm on the plans, the edge of pavement for
the turning radii at this interNec:ion extend a few feet outside the existing ristht-of-way on both
sides of the roadway. Mr.Dyer suggested that slight adjustments could be made in the field to
allow the paving improvements 5httAVct to he completed.along with the paving to the west. We
;vill work diligently with the contractor. COOT, and Weld County to address this request_
On May.6.2005, Pickett Engineering.subntitteti a letter to Keith Meyer of the Weld County
Public Works Department requestitng that Nil. Meyer prepare a recommendation to the Board of
County Commissioners(BOCCI for acceptance of the change in the stop condition at the
Intersection with WO( 25. Although Mr. Meyer approved the er rsmiction drawings with the

PS&G asked the County if the existing east-west stop sign control could be changed to
northesouth control at the CR 38—CR 25 intersection. The County, in turn, asked that the
request be evaluated as part of this study: Historic:traffic on CR 38 is 75 vehicles per day
from the site to SH 60 while 130vehicles per day use CR 25. With tie addition of site traffic,
CR 38 will have an average daily traffic(ADT)of 273 vehicles white the CR 25 ADT will re-
main at 130 vehicles. Consequently, daily traffic wiE be sigr acantly higher on CR 38. Also,
since CR 36 will be paved and CR 2$wl remain unpaved, it is atypical for traffic on the
paved street to stop for an unpaved roadway.. Therefore,driver expectations are better rrtet
with CR 25 under stop sign control at the CR 38 intersection. Given future conditions, it is
appropriate that the stop signs should be reversed at the OR -CR 25 intersection. This
would result in CR 25 traffic stopping as it approaches CR.38.
CONCLUSIONS
Based upon the above documented investigations and analyses, the following can be
concluded-
• Operating conditions in the area of the proposed PS&G project are acceptable.
• At full operation,this project will generate a modest number of site trips; however, a
significant percentage of the site trips will be large truol s. Under average conditions, .
14 morning peak hour trips, 1$ afternoon peak hour trips, and 198 daily trips are ex-
pected. During peak season conditions. 19 morning peak hour trips,25 afternoon
peak hour trips, and 274 daily trips are expected. These trips are consdered man-
ageable.
• Site trips can be eaasiiy accommodated with the roadway system shown on Figure 1Q..
A r orthbound left terra lane on SH 60 at CR 38 is warranted based upon future traffic
This lane should be built to have 40 feet of storage. 800 feet of deceleration lane and
a.400 foot transtion taper. Truck radii should also be provided along the west side of
Sel 60 at this intersection.

• All traffic movements will operate at lev&1 of service $' or better. Tlis level of service
can be maintained from the opening of operations through the tong-term.
• No additional improvements will be needed in the tang-term.
• Signing modifications should be undertaker,, at the CR 38—CR.25 intersection.. The
existing stop sign control should be changes so that CR 25 traffic stops at CR 38.
In summary. the improvements suggested irr this study fully mitigate the impacts of
PS&G site traffic. If implemented,they will assure very acceptable roadway operations
in this area for the foreseeable future.

Dear Tim:
This letter is to summarize and document the verbal conversations we had the past few
weeks regarding your ongoing efforts to pave WCR 38. As we discussed, the County
will require you to wait until at least August 15 to place the final lift of asphalt so that we
can monitor the performance of the bottom mat of asphalt. In addition, we will also
require that you complete all of the road side drainage ditches, culverts, drywells, etc.
and have all of the utilities relocated before the final lift of asphalt is placed.
In addition,we have also noted some areas of concern regarding the work that has been
completed to date. After we receive all of the testing results from Terracon, Tracy Dyer
will provide you a detailed list of specific areas that need to be addressed before we
allow the final lift of asphalt to be placed. As such, please send Mr. Dyer all testing
results no later than Friday, July 21.
Please note that if the final lift of asphalt is placed before you receive written
authorization from me, the County will not accept the paving improvements.

Weld County Public Works has completed its review/walk through of the improvem nts to Weld County Road 38 in place-
to date. The approval to commence top lift paving has been granted, conditionally, sed on that the requirements stated
below are satisfied:
• Only Westest mix design# 131805 "SX"may be used for leveling coursts work. At no time is the SX mix to be used
in the top lift application.
• Only Westest mix design# 120505 "S" (virgin mix) is to be used on top lift.
• There exist standing water at the paved portions of the intersection f SH 60 and WCR 38. The area's identified
must be corrected before top lift is accepted.
• All remaining items exempt from the punch list date ugust 21',2 ill be required to be completed
immediately following the end of the agriculture/in • on.
• Any derivations from construction specification in the top lift cross slope and ride quality of asphalt are subject to
correction per Weld County—Public Works discretion.

• All traffic control and local access, detour dust control,material testing and general safety practices must be followed
at all times.There will not be a warning for infractions of unacceptable practices;the project will be shut down
immediately at the direction of Weld County personnel.
• Coordination and scheduling of paving at the intersection of WCR 38 and WCR 23 must be relayed to Josh

Subject: Platte Sand and Gravel Collateral Release
Platte Sand and Gravel Co. owners rep (Tim Pike) has place a call to me in request of
release of collateral for the improvements made to WCR 38 from WCR 23 to 5H60.
Typically this would trigger a final walk through of the project to identify any
concerns or outstanding issues that remain with the project. A intermediate walk
through was conducted informally prior to the winter weather received in mid-
December 2006. As a result, I am comfortable with signing off on the project under
the follow terms:
• Utility pole located at the S.W. corner of WCR 25.5 and WCR 38 that needs to
be relocated ASAP.
• Pavement markings need to be completed, including area's that experienced
flaking and non-adherence of the pavement marking material to the road
surface. Pavement marking limits will be defined prior to placement by a Weld
County representative.
• Raise CMP culverts at NW corner property of WCR 38 and WCR 25 to match
existing grade of ditch flow line, and maintain 4-6 inches of cover over pipe's
when completed.
• Complete culvert installation and grading at Gonzales property located at 11165
WCR 38 to the satisfaction of both the owner and Weld County representatives.
• All fore-slopes and back-slopes are seeded with a Weld County approved seed
mix design.
• All additional items of correction found at final walk-through must be completed
within 30 days of written notice from Weld County.
The amount of collateral typically to be retained when all improvements are completed
is 15%. My recommendation is that 25% be retained until 1 year after "final"
inspection, which will occur when the area is free of snow and the above items are
completed.

While the road is far from perfect, it is complete. In consideration of the fact that
95% of the traffic utilizing this road will be trucks from P5&G, the road, it it's state,
is a glorified haul route. There are several surface irregularities to this project,
however, with consideration / review of the project with Public Works department
members, it is, in my opinion, to allow the road to stand as is.

The Board of County Commissioners of Weld County, Colorado, met in regular session
in full conformity with the laws of the State of Colorado at the regular place of meeting
in the Weld County Centennial Center, Greeley, Colorado, January 17 , 2007, at the
hour of 9:00 a.m.
ROLL CALL: The meeting was called to order by the Chair and on roll call the
following members were present, constituting a quorum of the members thereof:

MINUTES: Commissioner Masden moved to approve the minutes of the Board of
County Commissioners meeting of January 15 , 2007, as printed. Commissioner Jerke
seconded the motion, and it carried unanimously.
AMENDMENTS TO AGENDA: There were no amendments to the agenda.
PUBLIC INPUT: Chair Long requested that any members of the audience present to
discuss New Item of Business #4, regarding a Petition to Vacate a Portion of Weld
County Road 25, provide their comments during Public Input. He stated the petition
was never signed by all persons listed as petitioners, and the matter will be formally
withdrawn. He further stated that if a signed petition is submitted in the future, all c
surrounding property owners will be notified of the hearing date and may provide
testimony.
Robert Temmer, resident, stated he has submitted written objection to the petition,
marked Exhibit A, and surrounding property owner Gregory Light has also submitted a a�
letter of objection in regard to the petition, marked Exhibit B. He stated he is opposed sogiam

to the vacation of the portion of Weld County Road 25, since the vacation will present
a public safety issue. He further stated the access to his home in on Weld County Road
25, and he owns property on both sides of Weld County Road 25. Mr. Temmer stated
he is not in support of the petition, therefore, his name should not be listed as a
petitioner; however, his name was mistakenly placed onto the petition by another
property owner. He stated the vacation of the road would inhibit emergency service
vehicles from providing a quick response to any property owner living within the
general vicinity, and the vehicles would have to travel an additional three miles of
detour routes to reach his property. He further stated the additional time to access his
property could be a threat to the property and a threat to the lives of his family
members. Mr. Temmer stated the dust problems may be solved by having the road
paved, and the littering problems can be addressed in other ways besides vacating the
road. In response to Commissioner Masden, Mr. Temmer stated the petition indicates
the reasons for vacating the road include dust problems and problems associated with
partying which is occurring along the road. He further stated he believes the real
reason is that Mr. Windell, the petition originator, is currently in negotiations to sell his
property for gravel mining and water storage purposes, and the potential purchasers
would like the road to be vacated so that the gravel underneath the road may be
mined to create a large storage reservoir. Chair Long stated the letter submitted by
Mr. Temmer has been included as a part of the record.
Jennie Duncan, Southwestern Investment Group, stated her company represents SW
Chambers, LLC, who is the owner of the Heit Pit. She stated SW Chambers, LLC, was
granted a Use by Special Review Permit for sand and gravel mining operations
approximately 2.5 years ago. She further stated slurry wall construction along the
perimeter of the property will commence in March, 2007, and mining operations will
begin in July, 2007. Ms. Duncan stated only one permitted access exists to the Heit
Pit, and it is located on Weld County Road 25. She stated SW Chambers will provide
road improvements, in the amount of approximately $2 million, and the improvements
will commence in Spring, 2007. She further stated her objection to the petition, and
she believes a vacation of a portion of Weld County Road 25 will affect the health,
safety, and welfare of area residents. In response to Chair Long, Ms. Duncan stated
she sent a letter to Don Carroll, Department of Public Works, and she would like the
letter to become a part of the record if a valid petition is submitted at a later date.
CONSENT AGENDA: In response to Chair Long, Bruce Barker, County Attorney,
stated the Board considered a Zoning Permit for a Commercial Vehicle (ZPCV #0010)
for applicant Fred Jackson on Monday, January 15, 2007. He stated Mr. Jackson was
not present at the hearing, and the matter was denied by the Board. He stated the
applicant was wrongly informed by security guards that no hearings were being held
on Monday morning, due to the Courts being closed in observance of a holiday. He
further stated Mr. Jackson will most likely request that the Board reconsider the
matter, and if the Board decides to reconsider the matter, notification of the hearing
date will need to be resent to surrounding property owners.
Fred Jackson, applicant, stated he arrived at the front entrance for the hearing, and he
was informed by a security guard that no offices were open, and that no hearings
would be held. He stated he left the building, and figured the hearing would be
continued to the next day, therefore, he called the Department of Planning Services,
and was informed that the hearing was held and that the matter was denied. Chair
Long expressed his apologies to Mr. Jackson for the miscommunication. Commissioner
Jerke stated all parties have a right to be heard and represented, therefore he moved
to reconsider Zoning Permit for a Commercial Vehicle, (ZPCV #0010), for applicant
Fred Jackson, on February 12, 2007, at 9:00 a.m. The motion was seconded by
Commissioner Masden, and it carried unanimously.

Commissioner Masden moved to approve the consent agenda as modified.
Commissioner Rademacher seconded the motion, and it carried unanimously.
COMMISSIONER COORDINATOR REPORTS: There were no Commissioner
Coordinator Reports.
WARRANTS: Barb Connolly, Controller, presented the following warrants for approval
by the Board:

Commissioner Garcia moved to approve the warrants as presented by Ms. Connolly.
Commissioner Masden seconded the motion, which carried unanimously.
BIDS:
PRESENT BIDS: Ms. Connolly stated there were no bids to present.
ACTION OF THE BOARD CONCERNING CIVILIAN VEHICLES BID - SHERIFF'S OFFICE:
Ms. Connolly stated the Sheriff's Office recommends rejection of the bid, which was
previously approved on January 10, 2007. She stated the Sheriff's Office has
requested a smaller vehicle than the one approved through the bid. In response to
Chair Long, Mr. Barker recommended the Board move to reject the bid, and the bid
may then be reconsidered. In response to Commissioner Jerke, Ms. Connolly stated
the Sheriffs Office is in the process of determining which size of vehicle would be most
beneficial, and the re-bid will be presented within the next few weeks. Commissioner
Rademacher moved to reject said bid. Seconded by Commissioner Jerke, the motion
carried unanimously.
NEW BUSINESS:
CONSIDER PURCHASE OF SERVICES AGREEMENT AND AUTHORIZE CHAIR TO SIGN -
COMMUNITY MEDIATION PROJECT, INC., C/O CRAIG CONRAD: Walt Speckman,
Director of Human Services, stated the agreement is between the Family Educational
Network of Weld County and Community Mediation Project, Inc. He stated the
agreement is for the Supporting Healthy Marriages Project, and Community Mediation
Project will provide marriage education programs and other required services.
Commissioner Jerke stated accountability measures need to be in place for this
project, and he is concerned that a private party will receive a contract for
approximately $262,000.00 to provide services before accountability measures have
been determined. He further stated the project needs to use objective measurements
for the success of the project, and he is interested in knowing how the project will run,
the number of clients it will serve, where the clients are recruited from, and what
• requirements have to be met to be enrolled in the project. He further stated upon
completion of the project, couples should be measured in an objective way to
determine how they have improved as a result of the project. Mr. Speckman concurred
with Commissioner Jerke and stated the Department of Social Services has entered
into a contract with the University of Northern Colorado for the evaluation portion of
the project, and the University will also assist with the intake process which includes
detailed questionnaires. He stated the application process is very thorough, questions
are answered by the couple together, and then as individuals, and the questionnaire
process takes approximately three hours to complete. He further stated the project
provides supportive services, and the real measure of success will be the success of
couples and families who still have a healthy family relationship several years later.
Responding to Commissioner Jerke, Mr. Speckman stated funding was applied for to
provide a control group for research purposes; however, the funding was denied,
therefore, a control group will not be utilized. He further clarified the University of
Northern Colorado will monitor the progress of the project. Chair Long stated the

project has completed a large amount of assessment for accountability measures, and
the project does not have a scientific component. He stated the project will provide a
large amount of internal assessment and documentation, and the goal is to promote
success within marriage relationships among residents of Weld County. Chair Long
stated an upcoming work session has been scheduled for the Board to provide
information regarding the project. Commissioner Jerke clarified his concerns that the
project seems to be more subjective rather than objective. Commissioner Masden
moved to approve said agreement and authorize the Chair to sign. Seconded by
Commissioner Garcia, the motion carried unanimously.
CONSIDER NONEXCLUSIVE LICENSE AGREEMENT FOR THE UPGRADE AND
MAINTENANCE OF WCR 27 AND AUTHORIZE CHAIR TO SIGN - ED ORR: Don Carroll,
Department of Public Works, stated the agreement is required through Recorded
Exemptions #4516 and #4517, and Subdivision Exemption #1098. He stated Weld
County Road 27 is classified as a strategic roadway, and the County is currently
studying realignment possibilities. He stated the parcel is located on the north side of
the existing railroad tracks, and the existing access to the parcel is from Weld County
Road 66 to Weld County Road 27. Mr. Carroll stated 30 feet of right-of-way is available
in Section 30, and no negative feedback has been received from any surrounding
property owners. In response to Commissioner Masden, Mr. Carroll stated staff is
studying the possibility of realignment of the Two Rivers Parkway, and upon
realignment, 140 feet of right-of-way would be reserved as future right-of-way along
the Orr property. He further stated all improvements associated with the realignment
would be done at the County's expense. Responding to Commissioner Jerke, Mr.
Carroll stated the corner property on the west side of the road is approximately 1.6
acres in size, and it may be a non-buildable lot. He further stated the County may
seek to acquire right-of-way on the property if the realignment occurs. Commissioner
Jerke moved to approve said agreement and authorize the Chair to sign. Seconded by
Commissioner Masden, the motion carried unanimously.
CONSIDER APPLICATION FOR LICENSE TO CONDUCT PUBLIC DANCE OR DANCES AND
AUTHORIZE CHAIR TO SIGN - THE FORT 21, LTD., DBA THE FORT 21: Bruce Barker,
County Attorney, stated the renewal of the liquor license for The Fort 21 was approved
several months ago, and the dance license is for calendar year 2007. Commissioner
Rademacher moved to approve said application and authorize the Chair to sign.
Seconded by Commissioner Garcia, the motion carried unanimously.
CONSIDER PETITION TO VACATE A PORTION OF WELD COUNTY ROAD 25 BETWEEN
WELD COUNTY ROADS 20.25 AND 22.5 - MULTIPLE PETITIONERS: Mr. Barker stated a
petition was received by the Department of Public Works, and was reviewed and
forwarded for consideration by the Board. He stated the property owner originating the
petition drafted several versions, and it came to the attention of staff that the
petitioner was seeking review and approval from the County before moving forward
with receiving signatures from the rest of the surrounding property owners. He further
stated John Windell, the original petitioner, has apologized for the misunderstanding,
and has requested that the application be withdrawn. Mr. Barker advised the Board to
make a motion to accept the withdrawal of the petition. Commissioner Garcia moved
to accept said withdrawal. Seconded by Commissioner Rademacher, the motion
carried unanimously.
PLANNING:
CONSIDER PARTIAL CANCELLATION AND RELEASE OF COLLATERAL FOR WELD
COUNTY ROAD 38 - PLATTE SAND AND GRAVEL, LLC: David Bauer, Department of
Public Works, stated staff received a request from Platte Sand and Gravel, to reduce
and release an additional amount of collateral held for improvements completed on
Weld County Road 38. He stated the collateral, currently held in the amount of

$268,833.60, will be reduced to an amount of $182,208.40, which is approximately
twenty percent of the original amount. He stated fifteen percent will be held as a
paving warranty, and the additional five percent covers improvements which ill n ed
final approval. In response to Commissioner Jerke, Mr. Bauer sta e he fifteen
percent paving warranty amount will be held for a period of one year after final
approval of the project.
Tim Pike, Platte Sand and Gravel, stated he concurs with the recommendation of the
Department of Public Works. He stated the intersection improvements have been
completed and the culverts have been installed; however, the final inspections cannot
be completed since snow is currently covering the ground. He stated a final inspection
may be scheduled when the snow melts and after Xcel Energy can make the necessary
arrangements to relocate an existing utility pole. He further stated the striping needs
to be completed; however, it must wait until the temperatures are warmer. Mr. Pike
stated upon completion of the required improvements, the cost sharing agreement
between Platte Sand and Gravel and Weld County will be finalized and Weld County
will pay its portion for the completed improvements. Commissioner Masden moved to
approve said cancellation and release of collateral. Seconded by Commissioner Jerke,
the motion carried unanimously.
RESOLUTIONS AND ORDINANCES: The resolutions were presented and signed as
listed on the consent agenda. No Ordinances were approved.
Let the minutes reflect that the above and foregoing actions were attested to and
respectfully submitted by the Acting Clerk to the Board.

Re: Platte Sand and Gravel Hearing
Gentlemen of the Board:
I am the Manger of Berry Farm, which is the only farm serviced by the concrete
"farmers ditch", located in the North right-of-way of Weld County Road 38 (the
"Ditch").
I understand that you are requesting that Platte Sand and Gravel remove and
relocate the Ditch.
We oppose this proposal for the following reasons:
1. The Ditch is totally functional.
2. Pursuant to Weld County policy, which we understand has been in
existence for many decades, farmers are permitted to locate their irrigation
ditches within Weld County rights-of-way.
3. If the Ditch is relocated, we lose 8 to 12 feet of fertile farming land over a
2400 foot stretch of property.
4. If the Ditch is relocated, several historic trees will be required to be
removed by our home, one of which is 40 feet tall and serves as a habitat
for the local aviary population. These trees also create beneficial shade in
our yard, keeping the temperature of the home lower(also lowering our
electric bills).
5. To my knowledge in many years, there has never been a car, truck,
motorcycle, 18 wheeler, bicycles, or pedestrians which have ever fallen
into the Ditch. Now that the road has been reconstructed by Platte Sand
and Gravel, the likelihood of an accident related to the Ditch has been
substantially reduced. The Ditch is not a safety hazard.
6. The removal of the Ditch is an unnecessarily expensive project, the cost of
which vastly exceeds the benefits derived.

7. If you require the relocation of the Ditch, it will cause our side yard to
become small and unusable. We feel that this is an unreasonable burden
for us to bear.
8. As a result of Platte Sand and Gravel paving our road, which is 32 feet in
width, whereas most Weld County Roads are 24 feet in width, the value of
our property has increased due to the improved safety. The paving of the

In closing, we do not support the proposal to relocate the Ditch, which
also entails the removal of several historic trees on our property. Since the road has been
paved, the amount of dust and noise generated by large trucks and cars running up and
down Weld County Road 38, has substantially diminished. We appreciate all the work
that Platte Sand and Gravel has done during the construction and completion of the road.
They have been very easy to work with and we look forward to our continuing
relationship with Platte Sand and Gravel and Weld County. We believe that the removal
and relocation of the Ditch on the North side of Weld County Road 38, is a waste of time,
money and resources.

I listened to the tape and talked to Bruce. The items Public Works wanted to add were to
remove the requirement on the stop signs - Item 4, and replace it with Repair of the
concrete ditch. I think this is fine, as there was a fair amount of discussion on the
subject and apparent consensus that it should be repaired - just not moved.
The other addition was to add "barrow ditches" to the requirement to clean out culverts of
debris.
Bruce agrees that these changes are appropriate.
I made the changes and have them here.

I still really need to get this to the Bank tomorrow.
