RE: APPROVE PARTIAL VACATION OF USE BY SPECIAL REVIEW PERMIT #1360 -
LAFARGE WEST, INC.
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, by Resolution dated April 24, 2002, the Board did approve the request of
Western Mobile, Inc., for Use by Special Review Permit #1360, for a Mineral Resource
Development Facility, including a Concrete Batch Plant in the A(Agricultural)Zone District, on the
following described real estate, to-wit:
Part of the E1/2 of the NE1/4 of the NE1/4 of
Section 9, Township 2 North, Range 68 West of the
6th P.M., Weld County, Colorado
WHEREAS, the Board has received a request from the current property owner, Lafarge
West, Inc., 10170 Church Ranch Way, Suite 200,Westminster, Colorado 80021,c/o Lauren Light,
Tetra Tech, Inc., 1900 South Sunset Street, Suite I-F, Longmont, Colorado 80501, to vacate a
portion of said Use by Special Review Permit#1360, and
WHEREAS,the Board of County Commissioners heard all of the testimony and statements
of those present, studied the request of the applicant and the recommendations of the Department
of Planning Services staff and all of the exhibits and evidence presented in this matter and, having
been fully informed, deems it advisable to approve said partial vacation, conditional upon the
following:
1. Pursuant to Section 23-2-200.G.5 of the Weld County Code, the applicant shall
submit a revised Partial Vacation Use by Special Review Plat, conforming to
Section 23-2-260.D of the Weld County Code.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that Use by Special Review Permit#1360 be, and hereby is, partially vacated,
with the abovementioned condition.

SUBJECT: Partial Vacation of USR-1360
The Department of Planning Services has received the attached letter dated May 14, 2007 from
Lauren Light with Tetra Tech Inc representing Lafarge West Inc. Lafarge West Inc is requesting
that USR-1360 for a mineral resource facility including a concrete batch plant be partially
vacated. The acreage being vacated out of USR-1360 will be approximately 7.8 acres located
on the western edge of the USR boundary.
Background information:
Legal Description: N2 NE4 of Section 9, T2N, R68W of the 6th P.M., Weld County, CO
Location: South of and adjacent to State Highway 119; and west of and adjacent to CR 7.
USR-1360: USR-1360 was approved by the BOCC on April 24, 2002, for a mineral
resource facility including a concrete batch in the A (Agricultural) Zone
District.
Should the Board of County Commission choose to approve the request for a partial vacation of
USR-1360, Planning Staff recommends that a revised Partial Vacation USR plat of USR-1360
be submitted as required by Section 23-2-200.G.5.

To Whom It May Concern:
This letter is to request partial release of approximately 7 acres of the Use-by-Special-Review for
Lafarge West, Inc. as indicated on the attached map. The partial release is requested so the parcel
can be subdivided through the Recorded Exemption process. The released portion of the USR will
be used for access to the reservoir portion of the property which maybe used as a State Park in the
future.

On April 27, 2007, the Colorado Division of Reclamation, Mining and Safety approved your request for release of a
portion of the permit area from further reclamation responsibility.
The permit area was reduced to 291.58 acres, through the release of 16.42 acres in this permit action. Because the
permit is not totally released,you are still liable for filing annual reports and fees.
