Such hearing is the final hearing at which testimony, exhibits, or any other evidence may be introduced. You and the CBOE select an arbitrator from the official list of qualified people. He also has the power to administer oaths, and all questions of law and fact shall be determined by him. The arbitration hearing maybe confidential and closed to the public,upon mutual agreement. Box 758 Greeley, CO 80632 RE: PETITION TO THE COUNTY BOARD OF EQUALIZATION REGARDING WELD COUNTY ASSESSOR'S VALUATION OF PROPERTY Dear Weld County Board of Equalization: We are in receipt of a"Notice of Adjustment"from the Weld County Assessor in response to our "Protest of Real Property Value"letter dated May 31, 2007. While we appreciate the adjustment the Assessor made from $400,487 to $388,840, we still feel the new value is too high. We are unable to understand what the justification could possibly be for assessing our home at a value well above the sales price of three comparable properties in our immediate neighborhood sold between January I, 2005 and June 30, 2006. We also fail to understand why our home was assessed at a higher value than the assessment values of similar homes on our street. Our suggestion continues to be that a more reasonable figure is $360,000. We respectfully request that the Weld County Assessor be required to provide specific evidence supporting the $388,840 assessment, or in the alternative, lower the assessment accordingly. Enclosed with this petition is a copy of our"Protest of Real Property Value" letter(and its accompanying documents)that was sent to the Assessor on May 31, 2007`. This letter explains in detail why we believe our home should be assessed at a lower value. It is our hope that you will read the letter in its entirety, however, for your convenience, we have also duplicated data from the letter immediately below. The following table compares our home with three properties on our street that were sold between January 1, 2005 and June 30, 2006. 'To the best of our knowledge this letter is identical to that which was originally sent to the assessor. Unfortunately we have been traveling the past few weeks and received the"Notice of Adjustment"in mail that was forwarded to us during our travels. We were not able to enclose an exact photocopy of the original letter and its enclosures. We did not have the papers with us on our travels and the July 16, 2007 due date for this petition was prior to our return to Colorado. What is enclosed, however, is a print-out of what we believe to be the electronically saved text of the letter and data sheets extracted a second time from the Weld County Assessor's web page. Two of the homes have more bedrooms and bathrooms on the main floor. All of the homes sold for significantly less than the $388,840 appraisal given our home, an appraisal said to have been based upon the same time period during which the three homes sold. The following table provides a comparison of data from "Weld County Assessor Property Profiles"descriptions of homes in our neighborhood with that of our home. This table illustrates that the Assessor assessed our home at a higher value than the values assessed for other similar homes in the area. While some of these homes may also have been assessed too high compared to the sale prices of the similar homes of Table 1, our concern here is that there appears not to have been consistency in the Assessor's assessment methodology. We don't understand why our home which is both similar to and built at approximately the same time as these homes should be valued thousands of dollars higher. Some of these homes have larger yards, more bathrooms, and more over-all square feet. Based on the information above, we respectfully request that you grant our appeal and lower the assessment of our home to a value of approximately $360,000. This value compares to the actual sale prices of similar homes sold in the area during the period of January 1, 2005 through June 31, 2006. Thank you for your consideration. The notice says the value of our home is $400,487. This reflects an increase of$26,838 in the actual value of our property from the prior year to the current year. This is more than a 7% increase in value! We are unable to understand what the justification for such a substantial increase could possibly be when there is evidence to suggest that home values in the area are not only NOT increasing at such a rate,but instead may be falling. We suggest a more reasonable figure is $360,000. According to a Denver Post news article titled "Housing Slump Deepens", dated September 5, 2006, "Weld County home values fell 0.35 percent in the second quarter,compared with a year ago, a sharp downshift from a 3.7 percent annual gain seen in the first quarter." A copy is attached. Both this decrease of 0.35% and the increase of 3.7% fall within the 18 months prior to June 30, 2006 upon which your appraisal of our property is purportedly based. We have identified three properties in our immediate neighborhood, in fact on our street, that were sold between January 1, 2005 and June 30, 2006.
