Kammerzell Revocable Trust dated January 15, 2001, and The Larry G. Kammerzell Revocable Trust dated January 15, 2001, of 4410 83`1 Avenue, Greeley, Colorado 80634 (collectively the "Owners"), are the successors-in-interest to the Grantor, Larry Kammerzell, under a Valve Site Contract (the "Contract") dated July 9, 1998, concerning a parcel of land located on the NW1/4 of the N1/2 of the N1/2 of the SW1/4 of Section 29, Township 5N, Range 66W of the 6th P.M. Explain, in detail, the proposed use of the property. 2. Explain how this proposal is consistent with the intentof the Weld County Code,Chapter 22 (Corn prehensive Plan). 3. Explain how this proposal is consistent with the intent of the Weld County Code, Chapter23(Zoning)and the zone district in which it is located. 4. What type of uses surround the sie? Explain how the proposed use is consistent and compatible with surrounding land uses. 5. Describe, in detail, the folowing: a. How many people will use this site? b. How many employees are proposed to be employed at this site? c. What are the hours of operation? d. What type and how many structures will be erected (buit) on this site? e. What type and how many anim als, if any, will be on this site? • f. What kind (type, size, weight) of vehicles will access this site and how often? g. Who will provide fire protection to the site? h. What is the water source on the property? (Both domestic and irrigation). What is the sewage disposal system on the property? (Existing and proposed). j. If storage or warehousing is proposed,what type of items will be stored? 6. Explain the proposed landscaping forthe site. The landscaping shall be separatelysubmitted as a landscape plan map as part of the application submittal. 7. Explain anyproposed reclamation procedures when termination of the Use by Special Review activity occurs. 8. Explain how the storm water drainage will be handled on the site. 9. Explain how long it will take to construct this site and when construction and landscaping is scheduled to begin. 10. Explain where storage and/or stockpile of wastes will occur on this site. • -6- • RESPONSES TO USE BY SPECIAL REVIEW QUESTIONNAIRE 1. Explain, in detail, the proposed use of the property: Duke currently operates a booster station on the property. The site will continue to be used this way operated, however, some equipment will be added to modernize the site. The equipment includes compressors, separators, storage tanks, and other associated with gas processing and other equipment to allow gas produced in Weld County to be transported to market and sold. 2. Explain how thisproposal is Consistent with the intent of the Weld County Code Comprehensive Plan: The proposed use is consistent with the Comprehensive Plan because it seeks to use the land to foster the development of the vast natural resources in Weld County. Moreover, given the property's size together with the absence of any water rights attached to the property,it is impractical to use this property for farming. • 3. Explain how this proposal is consistent with the intent of the Weld County Code and the zone district in which it is located: The proposed use is consistent with the intent of the Agricultural Zone District, as it will foster the development of oil and natural gas resources. The Weld County Code provides that Oil and Gas Production Facilities are allowed as a matter of right in the Agricultural Zone District. Further, it will not interfere with any agricultural operations. 4. What type of uses surround the site? Explain how the proposed use is consistent and compatible with surrounding land uses: The site is surrounded by agriculture uses. 5. Describe, in detail, the following: a. How many people will use the site?Unmanned, but 1 man-hour per day may be appropriate for maintenance, etc. b. How many employees will be on site? Only employees of DEFS or contractors, no public • c. What are the hours of operation? 24 hours. • d. What type and how many structures will be erected (built) on this site? Please see the plot plan e. What type and how many animals, if any, will be on this site?No animals. f. What kind(type, size, weight) of vehicles will access this site and how often? Pick up trucks (1 per day), semi-trucks (1 per week) g. Who will provide fire protection to this site? Johnstown Fire Protection District/Milliken Fire Protection District. h. What is the water source on the property? (Both domestic and irrigation). There is no water source used on the property. In the event there are employees, bottled water is brought on site from another plant. • i. What is the sewage disposal system on the property? (Existing and proposed). Porta-toilets provided by commercial service if necessary. j. If storage or warehousing is proposed, what type of items will be stored? There is a proposed garage area for storage for mechanical items. This is not a "shop" for the changing of oil, washing vehicles, etc. 6. Explain the Proposed Landscaping for the site. The landscaping shall be separately submitted as a landscape plan map as part of the application submittal: There is no proposed landscaping. 7. Explain any proposed reclamation procedures when termination of the Use by Special Review activity occurs: No reclamation procedures will be necessary. 8. Explain how the storm water drainage will be handled on the site. The current natural drainage will not be disturbed, as it flows to the east. The equipment will be on pads. 9. Explain how long it will take to construct this site and when construction and • landscaping is scheduled to begin: Weld County Department of Planning Services Page 3 October 26, 2005 Construction will take less than 90 days to schedule and complete. 10.
