RESOLUTION RE: APPROVAL OF CHANGE OF OWNERSHIP REQUEST FOR A RETAIL LIQUOR STORE LICENSE NUMBER 82-12 TO JERRY D. AND VICTORIA S. HERNANDEZ, D/B/A WESTVIEW LIQUORS, 5901 W. 10TH STREET, GREELEY, COLORADO 80631, EXPIRES AUGUST 8, 1983 WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the. Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, Jerry D. and Victoria S. Hernandez, d/b/a Westview Liquors, 5901 W. 10th Street, Greeley, Colorado 80631, has presented an application for a Retail Liquor Store License for the sale of malt, vinous and spirituous liquors for consumption off the premises only, and WHEREAS, pursuant. to Weld County Ordinance No. 6, Section II., C., said applicant has paid the sum of $150.00 to the County of Weld for the change of ownership of the existing license, and WHEREAS, said applicants have paid to the County of Weld the fee of $48.75 as provided by law for issuance of such County License, and said applicant has paid to the State Department of Revenue, the sum of $262.50 and has produced a State Liquor License for the sale of malt, vinous and spirituous liquors for consumption off the premises only, outside the corporate limits of any town or city in the County of Weld at the location described as follows: 5901 W. 10th Street, Greeley, Colorado 80631 NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, having examined said application and the other qualifications of the applicants, does hereby grant License Number 82-12 to said applicants to sell malt, vinous, and spirituous liquors for consumption off the premises only, and does hereby authorize and direct the issuance of said license by the Chairman of the Board of County Commissioners of Weld County, Colorado, attested to by the County Clerk and Recorder of Weld County,"Colorado, which C9%2JJ- license shall be in effect until August 8, 1983, providing that said place where the licensee is authorized to sell malt, vinous and spirituous liquors for consumption off the premises only, shall be conducted in strict conformity to all the laws of the State of Colorado and the rules and regulations relating thereto, heretofore passed by the Board of County Commissioners of Weld County,. Colorado, and any violations thereof shall be cause for revocation of the license. Lessor hereby grants the Lessee the use of the well and septic system already connected to the liquor store for a fee of $600.00 per year payable at $50.00 per month, due on the First and payable by the 10th day of each month commencing on the First day of August, 1982 and continuing until the 31st day of July, 1983. Provided a prompt rental record has been maintained and the rental is current at the end of the lease period, this agreement shall automatically be extended for another year. In the event any change, in terms or price have to be negotiated this must be accomplished 30 days ro prior to the then current lease's expiration date. The Lessee shall be responsible for 1/3 of the cost of any pump, buried line and well repairs and for any portion of the under ground supply line that serves his exclusive use. Lessor has no responsibility and should have no expenses accrued to him for any damage to pipes or fixtures on Lessees property. Lessee shall not be responsible for repair costs on any part of the wat- er line that is for the exclusive use of a third party. Lessee shall be responsible for fifty percent of the maintenance and re- pairs on the septic system. If the problem is diagnosed as being caused by the misuse'of the system by the Lessee, Lessee shall be required to pay the total cost of repairs. If the problem is caused by some other party hooked to the system, Lessee shall not be responsible for any of the repair costs. Lessee shall be responsible for maintaining any sewer pipes that are for his exclusive use. An additional One Hundred Twenty Dollars ($120.00) payable Ten Dollars ($10.00) per month shall be charged for an ingress right over the south east corner of Lessor's property located directly north of the liquor store on Weld Road 59.
