RE; FAILURE. TO ESTABLISH CROW VALLEY LIVESTOCK INC, PEST CONTROL
DISTRICT.
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, pursuant to the provisions of Title 35, Article
5, CRS 1973, the Board of County Commissioners of Weld County,
Colorado, caused a ballot to be mailed to landowners in a given
area, requesting the establishment of the Crow Valley Livestock
Inc. , Pest Control District for the eradication of grasshoppers, and
WHEREAS, statutes require that at least sixty six and two-
thirds (66 2/3) percent of said ballots representing more than
sixty six and two-thirds (66 2/3) percent of the land, must
favor the establishment of said district, and
WHEREAS, the ballot counting committee appointed by the
Board of County Commissioners by Resolution dated June 10 , 1981,
have examined all ballots and statements of land ownership, and
WHEREAS, sixty-six and two-thirds (66 2/3) of the acreage
required is 92,368 and the total adres voted was only 45 ,286,
and
WHEREAS, the ballot counting committee found that Sixty (60)
ballots were cast which represented 45,286. 24 acres, thirty-two
(32) votes were cast in favor of said formation and twenty-eight
(28) votes were cast against said formation, and
WHEREAS, the Board pursuant to the results of the ballot
counting committee and the provisions of the statutes must deny
the petitioners request to establish said district.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners
of Weld County, Colorado, that the Crow Valley Livestock Cooperative,
Inc. , be, and the establishment is denied, said ballot counting
committee results are set forth in Exhibit A, attached hereto and
made a part of this Resolution by reference.

TO: Board of County Commissioners
The counting committee of Mike Loustalet, Herb Hansen and Stanley L. Boyes
appointed by the board of County Commissioners to count ballots for the proposed
Crow Valley Livestock Inc. , Pest District have examined all ballots and state-
ments of land ownership.
We have found that fifty ballots were cast which represented 45,286.24
acres.
There were 32 votes in favor and 28 votes against. The law requires that
66 2/3 of those voting must vote in favor and that all those voting must repre-
sent 66 2/3 of the private and state leased land. Neither of these criteria
was met. There needed to be 34 votes out off cast in favor and they only had
32 in favor.
The sixty-six and two-thirds of the acreage that must have been voted is
92,368 acres and they voted only 45,286 acres.

You will find enclosed a petition from 32 landowners requesting
that the County Commissioners call for an election to establish a
Pest Control District as described in the attached sheet with legal
descriptions.
The law requires 25 percent of resident landowners to sign a
petition requesting a ballot. The total resident landowners within
this boundary is 120 and 32 signatures represent 25 percent of resi-
dent landowners.
A ballot must be mailed to all landowners along with a statement
of numbers of acres owned or leased from the state which must be
filled out and returned with the ballot.
Sixty-six and two-thirds voting, must vote in favor of the Dis-
trict and those voting must represent sixty-six and two-thirds of the
acreage.
Acreage owned by Federal governments shall not be considered in
determining the percentage of land voted.
The total acres involved in the District is 252,160 acres. Fed-
eral owned land is 113,607 acres. This leaves 138,553 acres. This
means 92,365 acres need to be voted to represent sixty-six and two=
thirds of the land excluding State and Federal owned land.
The name of this district shall be Crow Valley Livestock Coop-
erative, Inc. , Pest Control District.

We, the undersigned petitioners, constituting at least twenty-five percent of
the resident landowners or lessees within a contiguous territory in said county,
and being desirous of forming a pest control district pursuant to the provisions
of Article 5 of Title 35, CRS 1973•t as amended, do hereby petition said Board of
County Commissioners for that purpose and represent as follows:
