RESOLUTION
RE: APPROVAL OF USE BY SPECIAL REVIEW FOR A TRUCKING BUSINESS
TO HAUL AGRICULTURAL & FOOD PRODUCTS - ROBERT SALZ
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners held a public
hearing on the 11th day of August, 1982, at the hour of 2 : 00
o'clock p.m. in the Chambers of the Board for the purpose of
hearing the application of Robert Salz, 1924 Carol Drive, Erie,
Colorado 80516, for a Use by Special Review for a trucking busi-
ness to haul agricultural and food products, on the following
described real estate, to-wit:
Lot 2, Carol Heights, Section 27, Township 1
North, Range 68 West of the 6th P.M. , Weld
County, Colorado
WHEREAS, Section 24.4. 2 of the Weld County Zoning Ordinance
provides standards for review of said Use by Special Review, and
WHEREAS, the Board of County Commissioners heard all of the
testimony and statements of those present, has studied the request
of the applicant and the recommendations of the Weld County Plan-
ning Commission and all of the exhibits and evidence presented
in this matter, and having been fully informed, finds that:
1. The submitted materials are in compliance with the appli-
cation requirements of Section 24. 7 of the Weld County
Zoning Ordinance;
2. It is the opinion of the Board of County Commissioners
that the applicant has shown compliance with Section
24.4.2 of the Weld County Zoning Ordinance as follows :
a) The proposal is consistent with the Comprehensive
Plan in that this use does not infringe on continued
agricultural uses in the vicinity or County. No
negative impacts on the environment or County have
been identified with this proposal. The proposal
is consistent with the intent of the Agricultural
Zone District and is provided for as a Use by Special
Review.
b) The use is both compatible with existing agricultural
activity and with land use which is contemplated to
agricultural in the Comprehensive Plan.

3. No overlay districts affect the site. Operation and
design standards provide adequate protection of the
health, safety and welfare of the neighborhood and the
County.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado that the application for a
Use by Special Review for a trucking business to haul agricultural
& food products in an A-Agricultural Zone on the hereinabove
described parcel of land be, and hereby is, granted subject to
the following conditions :
1. The attached standards for Use by Special Review be
adopted.
2. The plat for the use by Special Review Permit be placed
on record by the Department of Planning Services staff
prior to any building permits being issued on the site.
The above and foregoing Resolution was, on motion duly made
and seconded, adopted by the following vote on the 11th day of
August, A.D. , 1982.

I hereby certify that pursuant to a notice dated July 26, 1982,
duly published July 29, 1982 in the LaSalle Leader, a public hearing was
held on the request of Robert Salz for a Use by Special Review for a trucking
business to haul agricultural and food products in an A (Agricultural) zone
district. The Planning Commission recommended that the request with standards
be granted. Mrs. Salz was present and answered questions. She stated that
they have reached an agreement with the neighbors regarding the truck traffic
and time of travel. There were no objections to this request. Commissioner
Steinmark made a motion to approve this request with the standards as recommended
by the Planning Commission. Commissioner Kirby seconded the motion and it
carried unanimously.

DEVELOPMENT STANDARDS
1. The uses permitted on this site shall be a terminal for a trucking
business for the purpose of transporting agricultural and food
products.
2. Design standards for Uses by Special Review, Section 24.5 et. seq.
of the Weld County Zoning Ordinance shall be complied with.
3. Operations Standards for Uses by Special Review, Section 24.6 et.
seq. of the Weld County Zoning Ordinance shall be complied with.
4. The Use by Special Review shall be limited to the plans shown
hereon and governed by the Standards stated above and all applicable
Weld County Regulations. Any material deviations from the plans
and/or Standards, as shown or stated above, shall require the
approval of an amendment to the Permit by the Weld County Planning
Commission and the Board of County Commissioners before such changes
from the plans and/or Standards are permitted. Any other changes
shall be filed in the office of the Department of Planning Services.
5. The property owner and/or operator of this operation shall be
responsible for complying with all of the above stated Standards.
Noncompliance with any of the above stated Standards may be reason
for revocation of the Permit by the Board of County Commissioners.

Our trucking business is hauling agriculture products and food
products to and from Colorado. The products include nursery stock,
cowhides, onions, potatoes, fertilizers and beer. Je use the
building for maintenance and repairs on the trucks and a few
small pieces of farm equipment that we own.
de are located in an agriculture area. There is a dairy business
across Road 6, to the north of us, an excavating business with
trucks and heavy equipment across the road to the west of us, and
two other excavating businesses in this neighborhood.

in the neighborhood. ,Tor do we have much traffic in and out of
here. Cur trucks leave a'i, the beginning of the week and return
at -the end. There is already a lot of truck traffic -on all the
roads we utilize due to a clo:e by aanitrtion fill, chicken
farms, dairy farms, -nd exc?vncing bu,-inc r,m)s.
We do not feel that our small business would ever cause any
problems with future development in the area. We are not _
close to any municipalities and do not see any change in zoning
in the future. We feel that this area will stay zoned Agriculture.
We are not in any Overlay districts.

of those are drivers and are only here long enough to get in their

maintenance on the trucks and the bookwork involved. They arrive
at 8:00 am and leave by 6:00 pm. There is no reason to work
more than one shift. We have no patrons, buyers, etc. that
come here.

H. We have 4 tractors and trailers that travel under the legal
weight limits when they are loaded. 95% of the time that they come
in here, they are already unloaded and weigh 28,000 or under;
The trucks leave on Monday or Tuesday and return during the
week-end. They travel on County Road 7 to Road 6 for a half mile
and then on Carol Drive to our shop. County Road 7 is also
used by Garbage trucks, feef trucks, milk trucks and heavy equipment
trucks. Road 6 is also used by these and both it and Carol Drive
are gravel roads. We only pass one residence on Road 6 coming
tgeoouratsh . and they have told us that the trucks to not bother

I. We hive a house trailer, which was here when we bought the
property 2 ,years ago, right next to the building which has
full facilities for water and sewage with a septic systme and
leach field.
J. There is no stockpiling or waste areas. The only storage is
short term and it is in a trailer. Sometimes we have agriculture
products stored in a trailer while the truck is being serviced.
Usually this is just over night or over the week-end.

K. All debris, junk and other waste are stored in barrels and
hauled to the sanitation fill down the road once a week or once
every two weeks depending on the amount. We do not let it sit
around here.
L. Everything needed is already erected.
M. The property when we bought it 2 years ago had old buildings
tit were about to fall down and lots of old junk all around it.
Vie have cleaned up the area and keep it neat all around here.
The shop is an attractive building and always well kept.
The areas that were full of weeds hayebeen planted with grass
and we have cleaned up all the junk.

2 water hydrants in the building. There are 2 water hydrants
outside the building within 100 feet.
