HomeMy WebLinkAbout20072640 RESOLUTION RE: APPROVE TRANSFER OF PROPERTY TO LORETTA CONTRERAZ BY QUIT CLAIM DEED AND AUTHORIZE CHAIR TO SIGN AND AUTHORIZE CHAIR TO SIGN WHEREAS,the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, Weld County is the owner of property known as Outlot C,Casagrande Estates First Addition, County of Weld, State of Colorado, hereinafter referred to as "the Property," and, WHEREAS,the Property is a strip of land being approximately six feet in width, 1,000 feet in length, lying adjacent to property owned by Loretta T. Contreraz, and WHEREAS,the Board has been presented with a Quit Claim Deed transferring ownership of the Property to Ms.Contreraz,without compensation, in order to re-establish private ownership of the Property and thereby place it back on the tax roll for future property taxation, and WHEREAS, Ms. Contreraz is willing to accept the ownership of the property and is willing to be responsible for the maintenance of the property and to pay all future taxes thereon, as evidenced by her execution of the ACCEPTANCE OF TRANSFER OF PROPERTY, a copy of which is attached hereto. NOW,THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the Quit Claim Deed transferring ownership of the Property to Loretta T. Contreraz be,and hereby is,approved,and the Chair be,and hereby is authorized to sign the same. I acknowledge that no warranties as to the title of the property have been made to me, that no representations as to the quality of the property have been made to me, and that, as the adjoining landowner, I am familiar with the property. Contreraz 9032 Apache Road Longmont, Colorado 80504 Re; Transfer of Property to You Parcel described as 1CA-OC OUTLOT C CASAGRANDE ESTATES 15T ADDN Dear Ms. Contreraz: This letter is being written to you regarding the anticipated transfer to you of the above described real property. An aerial photograph of the property and information about the property is enclosed for your reference. The property in question is a strip of property which adjoins your property on the east side, and next to County Road 20. That property is currently owned by Weld County. Weld County is willing to transfer the property to you, free of any past property tax obligation. This property was originally held by the developer to control ingress and egress to the subdivision under code regulations as they existed when the development was created. However, at this time,there is no further need for the separate ownership, and Weld County believes that properties such as these are best transferred to the adjoining landowners. If the property is transferred to you, you will NOT be responsible for any past tax obligation. You will, of course be responsible for future, (2007 and after), tax payments on the property. The annual tax obligation for similar properties has been around $12.00. Please let me know your decision within the next two weeks.
