RE: ACTION OF THE BOARD OF COMMISSIONERS REGARDING VIOLATION VI#0600211
AGAINST KEN FAWCETT FOR VIOLATION OF THE WELD COUNTY CODE
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, Ken Fawcett, VI #0600211, is allegedly in violation of the Weld County Code,
and
WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has
not been corrected, and
WHEREAS,on the 13th day of February,2007,a public hearing was held before the Board
of County Commissioners for the purpose of hearing testimony relating to said violation, at which
time this matter was continued to April 10, 2007, to allow adequate time for the property owner to
find documentation allowing the manufactured structure to be placed on the site.
WHEREAS, on the 10th day of April, 2007, a public hearing was held before the Board of
County Commissioners for the purpose of hearing testimony relating to said violation, and
WHEREAS, Ken Fawcett was not present or represented at said hearing, although all
parties were notified of said hearing by Department of Planning Services staff, and
WHEREAS, the Board deems it advisable to bring legal action against those individuals
named above to correct said violation.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the Weld County Attorney be, and hereby is, authorized to proceed with
legal action against Ken Fawcett to remedy the violation of the Weld County Code, and any other
persons occupying the properties, any persons claiming an interest in the properties, and any
persons acting in active concert with the identified parties.

CASE HISTORY
May 18, 2006 Complaint of two connected mobile homes being used as a garage.
May 30, 2006 Site inspection by building inspector.
November 13, 2006 10-day letter to submit demolition permit.
November 21, 2006 Mr. Fawcett was in the office today. He believes the structure was permitted but we
have no record of that. The code does not allow for manufactured structures
to be used as anything but single family dwellings.
November 27, 2006 Left message for Ken Fawcett that the violation case will be scheduled on January 9,
2007.
December 18, 2006 Certified letter mailed indicating the violation case is scheduled before the Board of
County Commissioners.

with the Board of County Commissioners on February 13, 2007, at 10:00 a.m., to consider the violations.
The property is in violation of the following Section of the Weld County Code:
Chapter 23, Article I "General Provision"
Section 23-1-90 "Definitions, Mobile Home states "A mobile home or manufactured
home shall not be converted to any use other than a single family dwelling."
To bring your property into compliance:
A demolition permit shall be obtained and the manufactured structure being used as a
detached garage shall be demolished.
This meeting will take place at the Weld County Planning Department Office, 918 10th Street, Greeley,
Colorado. It is recommended that you or a representative be in attendance at this meeting to answer any
questions the Board of County Commissioners might have regarding the violation.
The Department of Building Inspection will be recommending that the Board of County Commissioners
authorize the County Attorney to proceed with legal action to remedy the violation. Our records indicate that
you were made aware of the nature of the violation,the action necessary to correct the violation, and that you

It has come to the attention of the Department of Building Inspection that two manufactured structures are
being used as a detached garage. This is a use not allowed per the Weld County Code; therefore it will be
necessary to demolish the structure.
I have enclosed a permit application as a demolition permit will be required. Failure to submit the form,plus all
required documents,within 10 days from the date of this letter will result in a violation notice. If you have any
